08/27/2013 MINUTESMINUTES SPECIAL MEETING CITY OF PARIS BOARD OF ADJUSTMENT CITY OF PARIS - CITY HALL COUNCIL CHAMBERS 107 E. KAUFMAN STREET PARIS, TEXAS TUESDAY, AUGUST 27, 2013 12:00 O'CLOCK P.M. The Board of Adjustment meeting was called to order by Rick Hundley, Chairman, at 12:00 p.m. A. The following members were present: Rick Hundley Jerry Haning Charles Richards Bryan Glass David Hamilton Nathan J. Bell V B. The following members were absent: Marilyn Smith C. Also present was Shawn Napier, Director of Engineering, Planning and Development; and Ashley Fendley, City Staff. 2. Approval of minutes from previous meetings. (May 7, 2013) Motion was made by Bryan Glass, seconded by Nathan J. Bell V to approve minutes for the June 2, 2013 meeting, with corrections. Motion carried 6 -0. 3. Public hearing and consideration of and action on the petition Texas Pro Signs on Lot 1, Block A, of the Mirabeau Square 287 Addition, being located at 3594 Lamar Avenue. To grant a variance of Section 28 -23(2) of the Sign Ordinance which provides that "If the leased or occupied fascia length has multiple frontages, an attached sign may be placed on each frontage in a size not to exceed one(]) square foot offace area per front foot of leased or occupied fascia length; however, signs located on the back of a development shall be limited to one (1) square foot of face area per back foot of leased or occupied fascia length not to exceed thirty - two (32) square feet, whichever is smaller. " The lease space is 20 feet wide. The maximum allowable signage is therefore 20 square feet per frontage (40 square foot total). The applicant is asking for 29.5 square feet of sign area on both the front and rear of the building (59 square foot total). The variance request is for 19 square feet. Public hearing was declared open. A. No one spoke in favor of the petition. B. No one spoke in opposition. Public hearing was declared closed. Motion was made by Bryan Glass, seconded by Nathan J. Bell V to approve the variance request. Motion carried 6 -0. 4. Public hearing and consideration of and action on the petition Guy Slimp (Food Fast Corporation) on Lot 1, Block A, of the CEFCO #1097 Addition, being located at 3750 Lamar Avenue. To grant a variance of Section 28 -8(h) of the Sign Ordinance which provides that "total sign face area of all permanent signs combined on one property, including ground signs, pole signs, attached signs, etc. shall not exceed one (1) square foot per front foot of property line, or maximum of the three hundred (300) square feet, at any time. " The lot width is 289 feet. The maximum allowable signage is therefore 289 square feet. The applicant is asking for 342 square feet, which is a 53 square foot variance over the maximum allowable signage. Public hearing was declared open. A. One individual spoke in favor of the petition. Guy Slimp, representing the Food Fast Corporation, spoke in favor of the petition. Mr. Slimp stated that he was seeking approval for a variance to allow 53 square feet over the maximum allowable signage. B. No one spoke in opposition. Public hearing was declared closed. Motion was made by Charles Richards, seconded by Bryan Glass to approve the variance request. Motion carried 6 -0. 5. Public hearing and consideration of and action on the petition Jesse Fleming on Lot 3, Block E, of the Suburban Estates, being located at 1125 Mockingbird Lane. A. To grant a variance of Zoning Ordinance 1710, Section 15 -102 which provides "If a structure occupied by a nonconforming use is destroyed by fire, the elements or other cause, it may not be rebuilt except to conform to the provisions of this ordinance. In the case of partial destruction of a nonconforming use not exceeding seventy -five (75) percent of its reasonable value, reconstruction will be permitted but the size or function of the nonconforming use cannot be expanded. " The house was burned more than 75 percent. B. To grant a variance of Zoning Ordinance 1710, Section 9 -102 (])which provides that the "minimum lot areas in an Agricultural District (A) be no less than 1 Acre " to allow a minimum lot area of 0.33 acre, which is a 0.67 acre variance. C. To grant a variance of Zoning Ordinance 1710, Section 9 -501 (1) which provides that the "minimum front yard in an Agricultural District (A) be no less than 35 feet" to allow a minimum front yard of 25 feet, which is a 10 foot variance. Public hearing was declared open. A. One individual spoke in favor of the petition. Jesse Fleming, 1120 Mockingbird Lane, spoke in favor of the petition. Mr. Fleming stated that he was seeking approval for a variance to allow the reconstruction of the structure and 10 foot variance for the minimum front yard. Mr. Fleming further stated item (B) is incorrect and does not need a variance for the lot area. B. No one spoke in opposition. Public hearing was declared closed. Motion was made by Charles Richards, seconded by Jerry Haning to approve the variance request for items 5 -A and 5 -C. Motion carried 6 -0. 6.
