08/19/2013 MINUTESMINUTES OF THE REGULAR MEETING OF THE BUILDING AND STANDARDS COMMISSION MONDAY, AUGUST 19, 2013 3:00 P.M. 1. Don Wilson called the Building and Standards Commission Meeting to order at 3:00 P.M. Roll was called. A. The following members were present: Don Wilson Johnny Norris Sally McEwin Zac Saffle Wendell Moore B. Staff present: Robert Talley Audra Lane Larry Wright Stephanie Harris Dale Maberry C. Approval of minutes from previous meetings. (July 18, 2013) Motion was made by Johnny Norris and seconded by Wendell Moore to approve the minutes for the July 18, 2013 meeting. Motion carried unanimously. 5 -0 3. Public Hearing to consider presentations by City of Paris Code Inspectors and owner(s) and /or lien holder(s) of the below properties who have been given notice of a violation of Article III of Chapter 7 of the Code of Ordinances of the City of Paris, Paris, Texas, entitled "Substandard and Dangerous Buildings and Structures ": Request was made by Robert Talley to move to item 3. F., 1535 NE 10th, East Park Addition, Block C, Lot 6 F. 1535 NE 10th, East Park Addition, Block C, Lot 6 Owner: Mable Palmer, %Jesse L Palmer 1535 NE 10th, Paris, TX 75460 Present: Jesse Palmer, 930 NE Center, Paris, TX 75460 No back taxes owed Mr. Talley stated the front of the structure has deterioration along the roof line, the foundation is sinking into the ground, there is damage to the front porch. The south side is missing wood and has deteriorated wood. The roof is buckling and the house is lower than the porch. Robert Talley's recommendation: 30 days to demolish if not the City has the right to demolish and apply a $1000 per day civil penalty. Jesse Palmer stated that he doesn't think he is able to have the house lifted and wanted to know what the city would charge to demolish it and he would make payments. Don Wilson asked Mr. Palmer to clarify that he was not asking to repair the house and that Mr. Palmer did not want an extension from the 30 day recommendation. Mr. Palmer's main concern was the cost of the demolition. Mr. Talley said that he could not give an exact amount but that it was $47 per ton. Mr. Wilson asked him to give him a range and Mr. Talley stated it could be anywhere from $2000 - $3000. Mr. Palmer stated that he is interested in talking to whoever he needs to talk to about payments because he could not fix up the house. Mr. Talley stated that he would be the person to talk to. Motion was made by Johnny Norris, seconded by Wendell Moore to accept Robert Talley's recommendation. Motion carried unanimously. 5 -0 Request was made by Robert Talley to move to item 3. B., 334 NW 3rd, City of Paris, Block 56, Lot 9 B. 334 NW 3`d, City of Paris, Block 56, Lot 9 Owner: Mark Malloy, 1406 Church, Commerce, TX 75428 Present: Mark Malloy, 1406 Church, Commerce, TX 75428 $485.94 owed for 2012 back taxes Robert Talley stated that there was a fire at this structure. The rear of the structure received the worst damage and there are sections where it burnt through the roof. Robert Talley's recommendation: 30 days to demolish if not the City has the right to demolish and apply a $1000 per day civil penalty. Mr. Malloy stated that he bought the property and had spent about $18,000.00, did not have insurance and does not have the money to repair or demolish the house. Mr. Wilson told Mr. Malloy that as he heard from the previous property that he can set up a payment plan with the city. Mr. Malloy told the commission that even making payments was not an option for him at this time as he was unemployed and he spent his saving on the house, he had plans to fix it up and move into it. He stated that he had the deed and would be willing to sign it over to the city. He would rather sign the property over than set up a payment plan. Mr. Talley explained that it would be up to the City Manager or even the City Council to approve signing over the deed to the property. He told Mr. Malloy if he signed the right of entry there was a possibility that either the Fire Department or the Police Department could use the structure for training and he might get a discount when the house was finally demolished. Motion was made by Wendell Moore, seconded by Zac Saffle to accept Robert Talley recommendation. Motion carried unanimously. 5 -0 Request was made by Robert Talley to move to item 3. H., 1933 E Cherry, City of Paris, Block 227 -1), Lot 3 H. 1933 E Cherry, City of Paris, Block 227 -1), Lot 3 Owner: Jerry Ladell 1951 E Cherry, Paris, TX 75460 Present: Jerry Ladell and sister Ruby Dillard $1523.76 in back taxes owed Robert Talley showed pictures of a large hole in the roof at the chimney as well as deteriorated wood around the chimney and that the roof was starting to buckle a little bit higher up from the chimney. The east side has started to show some signs of roof damage as well. Robert Talley's recommendation: 30 days to demolish if not the City has the right to demolish and apply a $1000 per day civil penalty. Mr. Ladell would like to repair the house, he recently had a stroke so at this point his sister Ruby Dillard spoke on his behalf. She stated that all of his sibling were willing to help him get the roof fixed as well as get the back porch cleaned up. There was no water damage in the house. She asked for 120 days to make these repairs. Mr. Wilson informed her that legally the commission was only allowed 90 days but that if they came back in 90 days and could show improvement they could ask for extension at that point. Mrs. Dillard stated that they recently had a death in the family but as soon as the funeral arrangements had been taken care of they would start on the house. Motion was made by Johnny Norris, seconded by Zac Saffle to give Mr. Ladell 90 days to show significant repairs. Motion carried unanimously. 5 -0 Request was made by Robert Talley to move to item 3. I., 1001 E. Grove, City of Paris, Block 175, Lot 3A I. 1001 E. Grove, City of Paris, Block 175, Lot 3A Owner: Grove Trust, JL Moore Trustee, 813 Simmons Dr, Euless, TX 76040 Present: Jeff Moore, JL Moore's son 3620 FM 195, Paris, TX 75462 $3868.96 in back taxes owed Robert Talley explained that this property has been brought before the commission in the past. The last time was 5/20/13 and the owner was given 90 days to repair. JL Moore came to Robert Talley and signed the right of entry. Jeff Moore contacted Robert Talley and asked that this structure be brought back to save it. Robert Talley showed pictures where the structure was unsecure, had broken windows, deterioration on the front porch and on the west side of the house as well as holes in the roof on the east side of the house. Robert Talley's recommendation: 30 days to demolish if not the City has the right to demolish and apply a $1000 per day civil penalty. Jeff Moore stated that one of the reasons he wanted to repair this house is because it was one of the first homes he and his father purchased together and that he the only reason it is in the shape it's in is due to finances. He stated that his wife has a different job and so more money is coming in. Mr. Wilson stated that the house needed a new roof and Mr. Moore agreed with this stating that he would replace the soffet's and face board, re -do the decking where needed, tear off the old roof and put on a new one. Wendell Moore expressed concern in regards to the high amount of property tax due and asked if paying the back taxes was part of the plan. Jeff Moore stated that it was. Stephanie Harris was asked if it was ok for this property to be brought back before the commission, since the property owner sign the Right of Entry. She stated that just because they sign it doesn't mean the city has to act on it. Johnny Norris asked if 90 days would be enough time and Mr. Moore stated that it would be. Motion was made by Johnny Norris, seconded by Wendell Moore to allow Mr. Moore 90 days for repair of the structure. Motion carried unanimously. 5 -0 A. 10th at Park, Smith's 1St Addition, Block 8, Lot 1 -2 Owner: Edgar Earl & Floy Chester, C/O Sandra Bledsoe, 660 NE 16th Paris, TX 75460 $4846.91 owed in back taxes No contact has been made with the property owner. Robert Talley stated that the property is unsecure, the front door is wide open and there are broken windows. There is deterioration along the roof line as well as missing wood, the roof is leaking and scavengers have been in pulling wire and any copper out of the house. Robert Talley's recommendation: 90 days to demolish if not the City has the right to demolish and apply a $1000 per day civil penalty. Motion was made by Johnny Norris, seconded by Zac Saffle to accept Robert Talley's recommendation. Motion carried unanimously. 5 -0 C. 346 NW 3rd, City of Paris, Block 56, Lot 10 Owner: Cecil E & Bettye J Stansell Jr., 370 CR 34721 Paris, TX 75460 Robert Talley stated that the owners are deceased and that the will has not been probated yet. Lisa Diggs is the occupant and Mr. Talley has spoken to her and expected her to attend the meeting. The original request was going to be for 90 days to repair but since the occupant did not show up Mr. Talley is going to ask for 30 days to repair. Mr. Talley showed pictures of there being holes in the roof that were covered by blue tarps in places but that the tarps were even dilapidated, there was also a section of the roof covered with old barn tin, as well as missing and dilapidated wood around the roof. Dale Maberry, Fire Marshal for the City of Paris stated that this house was brought to his attention due to a house fire next door. An ember started a fire on this property which the fire department extinguished. Mr. Maberry removed the electrical service because he deemed it unsafe on the inside and the outside. Mr. Wilson expressed concern in regards to the fact that the house was occupied. Mr. Talley stated that the city was working on this issue and hoped to have procedures in place to handle occupied structures that were deemed unsafe. Mr. Talley has spoken to the Stansell's daughter and there is some confusion as to whether Ms. Diggs has finished paying for the house or not. Robert Talley's recommendation: 30 days to repair if not the property would be brought back to the commission for the order to demolish. Motion was made by Wendell Moore, seconded by Sally McEwin to accept Robert Talley's recommendation. Motion carried unanimously. 5 -0 D. 1121 NE 16th, Harlan Heights, Block 2, Lot 10 Owner: Michael Alexander, 226 NW 6tl' Paris, TX 75460 $5834.90 in back taxes owed Robert Talley has had no contact with the owner in regards to this property. Mr. Talley showed picture of an unsecure front door and broken windows. There is missing and deteriorated wood along the foundation and a hole in the roof. There is also a hole inside in the floor where it looks as if people where trying to scrap copper and wires. Robert Talley's recommendation: Robert Talley's recommendation: 30 days to demolish if not the City has the right to demolish and apply a $1000 per day civil penalty. Motion was made by Sally McEwin, seconded by Zac Saffle to accept Robert Talley's recommendation. Motion carried unanimously. 5 -0 E. 1275 NW 18th, Few Addition, Block 1, Lot 5 Owner: Donna Humphrey's, 1823 E Cherry Paris, TX 75460 $732.60 in back taxes owed No contact has been made with the owner. Robert Talley stated that the front window is broken and the front door is open. As the house has a metal roof there is no real roof damage. There is furniture in the yard and the siding has been stripped off in places. There is foundation damage and the front door won't shut as a result. There is insulation hanging from the ceiling where it looks like people are coming in and probably stripping the wire out. Robert Talley's recommendation: 30 days to demolish if not the City has the right to demolish and apply a $1000 per day civil penalty. Motion was made by Wendell Moore, seconded by Johnny Norris to accept Robert Talley's recommendation. Motion carried unanimously. 5 -0 G. 1536 NE 10th, East Park Addition, Block D, Lot 5 Owner: Berdie Pierce & Nicholle Pierce Granderson, 4135 Dolbain Dr Spring, TX 77373 $279.06 in back taxes owed. No contact has been made with the owners. Robert Talley showed pictures of the front door being open, windows removed, paint chipping and deterioration along the roof line. The furniture inside has been torn up and there is water damage as well as peeling paint, mold along the bottom of the walls, wires have been stripped. There is a shed in the back that is also dilapidated and unsecure. The back porch has been ripped off. Robert Talley's recommendation: 30 days to demolish if not the City has the right to demolish and apply a $1000 per day civil penalty. Motion was made by Johnny Norris, seconded by Wendell Moore to accept Robert Talley's recommendation. Motion carried unanimously. 5 -0 4. Code Enforcement update. (I.) Discussion on how many houses are back logged (2.) 1" and Kaufman — Richard Hunt stopped the leak on the roof. Main Street is working with the owner, there is someone trying to purchase it. (3) 24/26 Clarksville has been completely re- roofed and passed inspection (4) Kenny Kammer's building is still in the court system 5. Substandard Structure Flow chart Robert Talley explained the flow chart, which are the procedures that Code Enforcement and the Buildings and Standards Commission use to determine what is done with each property brought before the commission. He also included the ordinances that give the Commission their power 6. Adjournment Motion was made by Johnny Norris, seconded by Zac Saffle to adjourn the meeting at 4:31pm.
