Don Wilson called the Building and Standards Commission Meeting to order at 3:00 P.M. Roll was called. A. Approval of minutes from previous meetings. (June 17, 2013) Motion was made by Johnny Norris and seconded by Chris Brown to approve the minutes for the June 17, 2013 meeting. Motion carried unanimously. 5 -0 3. Public Hearing to consider presentations by City of Paris Code Inspectors and owner(s) and /or lien holder(s) of the below properties who have been given notice of a violation of Article III of Chapter 7 of the Code of Ordinances of the City of Paris, Paris, Texas, entitled "Substandard and Dangerous Buildings and Structures ": Request was made by Robert Talley to move to item 3. F., 741 SE 23rd, Stellrose Addition, Block 2, Lot 28 & Pt. 27 F. 741 SE 23rd, Stellrose Addition, Block 2, Lot 28 & PT. 27 Owner: Thomas Russell Stewart, 212 SE 16th Paris, TX 75460 Present: Karen Stewart, 212 SE 16th Paris, TX 75460 and Michael Robertson Taxes owed $861.56 Mr. Talley stated that this property has been damaged due to fire on the South side. Robert Talley's recommendation: 30 days to demolish if not the City has the right to demolish and apply a $1000 per day civil penalty. Mrs. Stewart is the daughter of Thomas Stewart. She stated that there is an arson case on this property and that Mr. Maberry hasn't released the property yet. The property is a total loss and she wants to get a loan and have the structure demolished. Mr. Michael Robertson has been hired to be in charge of the demo. Mr. Robertson said that once Mr. Maberry releases the property they will start recovering what they can from the fire. Mr. Wilson explained to Mrs. Stewart that a demo permit needs to be applied for. Mr. Robertson said he's sure he can have the paperwork completed in 30 days and then have the demo done. Motion was made by Johnny Norris, seconded by Wendell Moore to give Mrs. Stuart 60 days to demolish the property. Motion carried unanimously. 5 -0 Request was made by Robert Talley to move to item 3. J., 490 NW 24th / 2375 Plum, City of Paris, Block 242, Lot 24 J. 490 24th NW/ 2375 Plum, City of Paris, Block 242, Lot 24 Owner: Willie Dalton Jr., 490 24th NW 2375 Plum Paris, TX 75460 Present: Sally Becerra 923 Meandering Way Mesquite, TX 75150 No back taxes are owed. Robert Talley explained that this property has deterioration to the front roof on the porch, bowing, missing wood, rot, shingles are worn, grounds building up on the edge and causing roting, there are two holes in the roof and a limb on the roof. Robert Talley's recommendation: 30 days to demolish if not the City has the right to demolish and apply a $1000 per day civil penalty. Mrs. Becerra stated that her father passed away one year ago. The building is used for storage. She is cleaning it out so they can demo it but she lives in Mesquite and can only do it on the weekends. She asked for 60 -90 days to finish the work and have it demolished. There has been no vandalism. Motion was made by Johnny Norris, seconded by Chris Brown to give Mrs. Becerra 90 days to demolish. Motion carried unanimously. 5 -0 Request was made by Robert Talley to move to item 3. C., 533 E Price, City of Paris, Block 36, Lot 8 C. 533 E Price, City of Paris, Block 36, Lot 8 Owner: Mary and Harold Pruitte 1036 E Washington Paris, TX 75460 Present: Mary and Harold Pruitte $422.00 in back taxes owed Robert Talley showed pictures of deterioration on the roof line and wood, broken windows, the roof is buckling in -ward, the front porch is missing wood and is deteriorated. Robert Talley stated that the house is dangerous and that Mary Pruitte agreed that the property needed to be demolished. Robert Talley's recommendation: 30 days to demolish if not the City has the right to demolish and apply a $1000 per day civil penalty. Harold and Mary Pruitte addressed the commission. Harold said the roof was good but when he replaced the roof three years ago he left loose shingles on top of the roof. He said he patched one hole in the roof. Mr. Pruitte stated that he has been in construction all of his life. He also stated that this is their home and they want to make improvements and have two helpers Randy Dean and Steve Whitaker to help them. Mary spoke to the commission and stated that the City has removed a big part of the rubbish with help from them. Harold asked for six months to repair the house and said nothing's wrong with the roof. The commission had a discussion on the property. Don Wilson stated that daylight can be seen through the holes, the scaffling is old and deteriorating, and the house shows extreme deterioration. He stated if Mr. Pruitte started repairing the structure that when time was up and it was not completed and up to code it would then go onto the demo list. Robert Talley stated that he didn't feel the need to inspect the inside of the property due to the statements from Mr. and Mrs. Pruitte. Johnny Norris asked how old the part of the roof is that's sagging that Mr. Pruitte repaired. Mrs. Pruitte explained that Mr. Pruitte didn't finish the roofing job. Mrs. Pruitte also explained that she moved out because the back room was leaking and she's allergic to mold. Mr. Pruitte explained that the walls are sturdy but the rafters need to be replaced. He also said the reason the windows are broken is because of vandals. Mr. Wilson explained that the Pruitte's need to get permits to do any work. Dale Maberry (Fire Marshall) explained the situation of the abatement of the unsafe structure. He stated during his talk with Mrs. Pruitte she stated the structure was unsafe and the property was tagged for demo. Mr. Maberry said there is no water but the electricity was left on for the lights so that the Pruitte's can remove items from the house. Mr. Maberry said that he tried to work with Mr. and Mrs. Pruitte. Wendell Moore stated that it's ambitious to state that Mr. Pruitte can do this work in 90 days. Mr. Maberry said during his talks with Mrs. Pruitte she stated that they are not financially able to do the repairs. Chris Brown stated that looking at the pictures this structure has been this way for years. Mr. Pruitte objected and said he would get an attorney. Don Wilson stated that it is physically impossible to have this repair done in 90 days and that he hates for someone to spend that kind of money on a structure for it to be demolished. Robert Talley explained that a $1500 lien has already been applied to the property for the abatement and that Mrs. Pruitte is paying it out. Motion was made by Chris Brown, seconded by Johnny Norris to accept Robert Talley recommendation. Motion carried unanimously. 5 -0 Don Wilson explained to Mr. and Mrs. Pruitte if they didn't agree with the Commission's motion that they can appeal. They were directed to talk to Stephanie Harris (Assistant City Attorney) for direction on how to appeal. Request was made by Robert Talley to move to item 3. G., 35 Drive -In Ave, City of Paris, Block 251, Lot 17 G. 35 Drive -In Ave, City of Paris, Block 251, Lot 17 Owner: Daisy Grays, 2535 701h Ave. SW Trlr 35, Tumwater, WA 98512 No back taxes owed Present: Daisy Grays Robert Talley explained the reason he brought this case back to the commission is that Ms. Grays explained that the mailbox on the post office side was jammed and she was unable to receive her mail for a while. Mr. Talley confirmed this with the post office. The original Building and Standard order was demo in 90 days. Robert Talley said the structure is unsecure, holes in the roof, deterioration and rotted, has overgrown vegetation, tin is peeling, large holes in roof, and was related to a fire in the past. Daisy Grays handed out a proposal to the Building and Standards Commission. She explained that her boyfriend does demo's for a living. She bought the property after the fire and has lots of medical problems and is now getting better. Ms. Grays asked for 90 days to repair. Don Wilson asked Ms. Grays what her plans for the building are and Ms. Grays responded that they would like to have a storage building facility for when they retire. Robert Talley's recommendation: 30 days to demolish if not the City has the right to demolish and apply a $1000 per day civil penalty. Motion was made by Chris Brown, seconded by Wendell Moore to allow Ms. Grays 90 days for repair of the structure. Motion carried unanimously. 5 -0 Chris Brown left the meeting at 4:04pm. Request was made by Robert Talley to move to item 5. 5. Discussion of selling the property at 1035 W Houston. Owner: Jackie Jones Buyer: Steve Helms 640 S Hwy 24S Paris, TX 75462 Robert Talley stated that the original order for this property was 90 days to repair and this was not done so on 5/10/13 the property was re- submitted to the commission and an order of demolition for 30 days was ordered. Since this order Steve Helm has asked to buy this property. Mr. Helm is a carpenter and wants to fix the house to rent. Don Wilson asked if the Commission lifts the demo order if Mr. Helm can get the repairs done within 90 days. Steve Helm stated that he could do the repairs once the sale is final. Motion was made by Johnny Norris, seconded by Jon McFadden to rescind the 30 day demo order on 1035 W Houston. Motion carried unanimously. 4 -0 3. A. 252 NW 25th, Wortham & Carlton Addition, Block 4, Lot 4 Owner: Edward Weaver, 5123" SW Apt. 2, Paris, TX 75460 -4086 $3258.16 owed in back taxes No contact has been made with the property owner. Robert Talley stated that the structure has deteriorating and missing wood, it's unsecure, has holes in the roof, holes in the back of the house, and the doors are open. Robert Talley's recommendation: 30 days to demolish if not the City has the right to demolish and apply a $1000 per day civil penalty. Motion was made by Johnny Norris, seconded by Wendell Moore to accept Robert Talley's recommendation. Motion carried unanimously. 4 -0 B. 440 NW 13th, Gorham Addition, Block 1, Lot 4 Owner: Charles Ruff II, PO Box 1461, Paris, TX 75461 Robert Talley stated that Charles Rudd bought this property. The original order on the property was to demo in 30 days. Mr. Rudd said he would attend the meeting and didn't show. He asked for more time. There are holes in the roof, deterioration on the porch, unsecure, dangerous, and rear portion has sunk and separated from the house. Robert Talley's recommendation: 30 days to demolish if not the City has the right to demolish and apply a $1000 per day civil penalty. Motion was made by Wendell Moore, seconded by Johnny Norris to accept Robert Talley's recommendation. Motion carried unanimously. 4 -0 D. 221 W Kaufman, City of Paris, Block 176, Lot 25 & 25 -A Owner: Robert B & Louise Moseley, 2306 Lamar, Paris, TX 75460 No back taxes owed. Robert Talley stated that Mr. Moseley has started pulling permits for the repairs on this property. His first priority is securing the property. There are broken windows, the property is unsecure, and the bricks are falling. Don Wilson stated that this is the oldest structure in downtown Paris. Robert Talley's recommendation: 90 days to repair. Motion was made by Wendell Moore, seconded by Johnny Norris to accept Robert Talley's recommendation. Motion carried unanimously. 4 -0 E. 830 NW 4th, City of Paris, Block 96, Lot 4 Owner: Roberta Chappel, 1011 Valdzed Dr. Dallas, TX 75253 No back taxes owed. No contact has been made with the owner. Robert Talley stated there are two sheds in the back yard that are dilapidated, overgrown vegetation, unsecure, holes in the floor, ceiling and wall, sinking, and is full of junk and rubbish. Robert Talley's recommendation: 30 days to demolish if not the City has the right to demolish and apply a $1000 per day civil penalty. Motion was made by Johnny Norris, seconded by Wendell Moore accept Robert Talley's recommendation. Motion carried unanimously. 4 -0 H. 1356 W Kaufman, City of Paris, Block 128, Lot 15 -A Owner: Nellie Morgan, 577 CR 33530, Sumner, TX 75486 $345.06 in back taxes owed. Robert Talley has spoken to the owner and they agree the structure needs to be demolished. Mr. Talley stated that the structure is unsecure, deteriorating, broken windows, gutted inside, pulled pipes, holes in the roof, and the structure is sinking. Robert Talley's recommendation: 30 days to demolish if not the City has the right to demolish and apply a $1000 per day civil penalty. Motion was made by Wendell Moore, seconded by Jon McFadden to accept Robert Talley's recommendation. Motion carried unanimously. 4 -0 I. 1317 Bonham, City of Paris Block 128, Lot 1 Owner: Perry & Sonja D Grant, 141 CR 453 -2, Dayton, TX 77535 $1483.03 in back taxes owed. Robert Talley spoke with Sonja and she told Mr. Talley that her husband Perry has passed away. Sonja has talked to a group about buying the property. Robert Talley stated that the property owners around the property are complaining. The structure is deteriorating, daylight is showing through holds, porch is deteriorated, shingles are falling and deteriorated on the roof, missing wood, open sheet rock outside, lots of vegetation, and the foundation is rotting. There is also a shed full of junk and rubbish in the back. Robert Talley's recommendation: 30 days to demolish if not the City has the right to demolish and apply a $1000 per day civil penalty. Motion was made by Wendell Moore, seconded by Jon McFadden to accept Robert Talley's recommendation. Motion carried unanimously. 4 -0 K. 2175 W Shiloh, Westside Addition, Block 6, Lot 5 This item was pulled off the Building and Standards agenda because it was sold. L. 1730 W Walker, Colonial Addition, Block 1, Lot 4 Owner: Rachael Drew Gibson C/S Charles Rudd Il, 1970 S Church St. , Paris, TX 75460 -7663 $830.77 in back taxes owed. Robert Talley stated that he has worked with Mr. Rudd for three years now. The structure is deteriorating, it has missing siding, broken windows, and holes in the ceiling, the back bedroom has wood stacked in it, the blocks are sinking and leaning, and the structures unsecure. Motion was made by Johnny Norris, seconded by Wendell Moore to accept Robert Talley's recommendation. Motion carried unanimously. 4 -0 4. Code Enforcement update. (1.) Discussion of total houses demolished. Total 109, left to demo 40ish, and some properties have been pulled off the demo due to the property selling. (2.) 260 S. Main — still in district court. (3) Main Tire — still unoccupied but they have made some repairs. (4) Don Wilson asked if Robert Talley could get with Steve Helm to look at some of the houses on the demo list before demo orders are issued. Robert Talley said he would talk to the Fire Chief and Fire Marshall about this. 6. Future agenda items. (1) Next meeting August 18, 2013. (2) Robert Talley asked to condense the list on demos and instead go over Building and Standards procedures for new members. The Commission agreed this would be good. 7.
