Don Wilson called the Building and Standards Commission Meeting to order at 3:02 P.M. Roll was called. A. The following members were present: Don Wilson Johnny Norris Wendell Moore Vicky Ballard Zac Saffle B. Approval of minutes from previous meetings. (March 18, 2013) Johnny Norris noted that Section 4 (5) needed to be corrected from Mike Malone's property to Stevie Jackson's property Motion was made by Johnny Norris and seconded by Wendell Moore to approve the corrected minutes for the March 18, 2013 meeting. Motion carried unanimously. 5 -0 3. Public Hearing to consider presentations by City of Paris Code Inspectors and owner(s) and /or lien holder(s) of the below properties who have been given notice of a violation of Article III of Chapter 7 of the Code of Ordinances of the City of Paris, Paris, Texas, entitled "Substandard and Dangerous Buildings and Structures ": Request was made by Robert Talley to move to item 3. B., 725 NW 9th, City Block 88, Lot 17 B. 725 NW 9th, City Block 88, Lot 17 Owner: Tavares J Williams, 510 6th NE, Paris, TX 75460 Present: Tavares J Williams and Robert Walker who is purchasing the property — no back taxes owed. Mr. Talley stated that this property came before BSC a couple of months ago. The house has deterioration along the bottom part of the house near the foundation and is unsecure. The north side of the house is in pretty good shape. One side of the porch has a brace that is collapsing. The original order was for the house to be demolished within 30 days. Mr. Williams stated that he is selling the house to Robert Walker through owner financing. Mr. Walker explained how he has secured the windows and doors. The part of the porch that was falling has been replaced with 4x4's to brace it and the house has been painted. Mr. Wilson informed Mr. Walker that any plumbing and /or electrical work that was done on the house needed a permit. Mr. Walker stated that Mr. Talley told him to wait on permits until the results of the BSC meeting and that if they would give him a 90 grace period he would get the permits required and continue to work on the house. Robert Talley's recommendation: 90 days to repair, if not the property will be brought back to the Buildings and Standards Commission. Motion was made by Johnny Norris, seconded by Vicky Ballard to give Mr. Robert Walker 90 days to repair the property until the July 2013 meeting. Motion carried unanimously. 5 -0 Request was made by Robert Talley to move to item 3. H., 227 NW 13th , City Block 191, Lot 28 -A H. 227 NW 13th , City Block 191, Lot 28 -A Owner: Michael Lecornec, 410 SE 39th , Paris, TX 75460 Present: Michael Lecornec — No back taxes are owed. Robert Talley showed pictures of deterioration of the front and sides of the house. Inside the house some of the subflooring has been removed and there is some rot. Some of the underpinning is coming off and the garage is unsecure Mr. Lecornec stated that he bought this property as an investment. He paid a contractor to repair the house. The contractor is the one who removed the flooring. Mr. Lecornec stated that after paying the contractor he walked off the job without completing the work. He has contracted other carpenters to get bids on repairing the property. If it doesn't make economic sense to repair the house the will contact Mr. Talley and he will have the house demolished. He asked for 90 days to repair the house. Mr. Wilson questioned the stability of the roof and Mr. Lecornec stated that it was in pretty good shape for a house that old. Robert Talley's recommendation: 90 days to repair, if not the property will be brought back to the Buildings and Standards Commission. Motion carried unanimously. 5 -0 Motion was made by Wendell Moore, seconded by Johnny Norris to allow Michael Lecornec 90 days to decide if repairs are economically possible and to start the repair process. This property will come before BSC in July 2013 for review. Motion carried unanimously. 5 -0 Request was made by Robert Talley to move to item 3. O., 945 W. Cherry, City Block 51, Lot 1 O. 945 W. Cherry, City Block 51, Lot 1 Owner: Kenneth Frierson PO Box 411, Paris, TX 75461 Present: Kenneth Frierson - $1019.43 owed in back taxes Robert Talley showed pictures of large holes in the roof at the front porch and at the back of the house. The carport is collapsing and the house is unsecure. There is also junk and rubbish throughout the property as well as high grass and weeds. Mr. Frierson stated that this was his mother's house and he would like to fix it up but he needs some time. It needs a new roof and he has spoken to some contractors and is getting a carpenter's estimate. Mr. Wilson stated that the property looked like it needs a substantial amount of work and asked Mr. Frierson if he was committed to the time and money it was going to take. Mrs. Ballard asked what sort of time frame was Mr. Frierson looking at. Mr. Frierson stated that he and Mr. Talley discussed 90 days. Motion was made by Johnny Norris, seconded by Vicky Ballard to give Mr. Frierson 90 days to repair the property. Mr. Talley stated that he would like the give Mr. Frierson 2 weeks to secure the property. Mr. Wilson also stated that the property needed to be cleaned up of all junk and rubbish and it needed to be mowed. Motion was made by Johnny Norris to rescind his previous motion, seconded by Vicky Ballard. Motion to rescind was carried unanimously 5 -0 New motion was made by Johnny Norris, seconded by Vicky Ballard to give Kenneth Frierson 2 weeks to secure the property and clean it of all junk and rubbish and mow all grass and weeds. Also, to give Mr. Frierson 90 to repair property if not the property will be brought back to the Buildings and Standards Commission. Motion carried unanimously. 5 -0 Request was made by Robert Talley to move to item 3. M., 625 W Washington, City Block 154, Lot 1 and then 3. N., 880 SW 6th, City Block 154, Lot 1 -A M. 625 W Washington, City Block 154, Lot 1 Owner: Family Haven Crisis Present: Gary Waite 104 Lamar Ave, Paris, TX 75460— former board member of Family Haven Crisis acting as representative of the organization. There are no back taxes. Robert Talley showed pictures where a large tree fell on the corner of the house. This property went before HPC and they ask that the property be repaired not demolished. Mr. Waite stated that Family Haven is a defunct organization. He is a former board member. There are immediate plans to dissolve the 501(3) (C) status and try to turn the property over to another non - profit organization. Mr. Waite stated there was some money left in a Family Haven account and that it was probably enough to have the tree removed and make minimum repairs. Mr. Wilson asked if there was any insurance on this property and Mr. Waite indicated there was not. Mrs. Ballard asked if they knew what non -profit they wanted to give the property too and Mr. Waite said that he has spoken with Sybil Colson, another former board member and they were going to try and figure it out. Mr. Talley stated that HPC does not want to put a hold on this structure just wants to give 90 days to repair it. Robert Talley's recommendation: 90 days to repair if not the City has the right to demolish and apply a $1000 per day civil penalty. Motion carried unanimously. 5 -0 N. 880 SW 6th, City Block 154, Lot 1 -A Owner: Family Haven Crisis Present: Present: Gary Waite 104 Lamar Ave, Paris, TX 75460— former board member of Family Haven Crisis acting as representative of the organization. $12,943.44 back taxes owed. The committee questioned why there were back taxes owed on a property that a non - profit owned. Mr. Talley was not sure that is what the Appraisal District had on file. Taxes did not start to accumulate until after 2010, that maybe that is around the time Family Haven dissolved. Mr. Talley showed pictures of extensive fire damage to the home. It is believed that the tree that fell on 625 W Washington hit a power line that caused an electrical fire at this address sometime during the 3 week of March. Mr. Waite stated that there is an odd deed restriction on this property. It states that if Family Haven Crisis was to dissolve the property would revert back to a Mr. McIntosh in Denton. Mrs. Ballard asked if Mr. McIntosh was aware of the fire. Mr. Waite stated that he didn't think Mr. McIntosh knew about the fire. Mr. Waite only found out about the deed restriction recently. Mr. Talley was asked about how much it would cost to have this house demolished. Mr. Talley stated it could be anywhere from $1200 to $3000, that the city was charged by the ton and it would be hard for him to give an accurate dollar figure not knowing how many tons it would be. Robert Talley's recommendation: 30 days to demolish if not the City has the right to demolish and apply a $1000 per day civil penalty. Motion carried unanimously. 5 -0 A. 788 E Hickory, City Block 282, Lot 3 -A Owner: Murkes Fulbright 814 92nd W St, Los Angeles, CA 90044 Robert Talley has spoken to the owner on 2 occasions and he agrees that it needs to be demolished. There are no back taxes due. Robert Talley showed pictures where the house is unsecure, there is a hole in the roof and the shingles are peeling up. There is an old shed that has collapsed, and the carport is starting to fall. Robert Talley's recommendation: 60 days to demolish if not the City has the right to demolish and apply a $1000 per day civil penalty. Motion was made by Zac Saffle, seconded by Vicky Ballard to follow Robert Talley's recommendation for the property owner to demolish the property in 60 days, if not the City has the right to demolish and apply a $1000 per day civil penalty to the property. Motion carried unanimously. 5 -0 C. 355 NE 29th, Springlake Addition, Block 4, Lot 5 Owner: Par Trust, C/O JL Moore Trustee, 813 Simmons, Euless, TX 76040 No contact has been made with owner. $5203.57 back taxes owed. Robert Talley showed pictures of the property where it's unsecure, deteriorating, holes in roof, rafters are pushing through the roof and there is junk and rubbish in the yard. Inside the ceiling is buckling and ceiling tiles have fallen. Robert Talley's recommendation: 30 days to demolish if not the City has the right to demolish and apply a $1000 per day civil penalty. Motion was made by Johnny Norris, seconded by Wendell Moore to follow Robert Talley's recommendation for the property owner to demolish the property in 30 days, if not the City has the right to demolish and apply a $1000 per day civil penalty to the property. Motion carried unanimously. 5 -0 D. 322 SE 19th, Anita Park, Block 3, Lot 12 Owner: Elizabeth Nell Swint Obrien, PO Box 55 Powderly, TX 75473 No contact has been made with owner. No back taxes owed. Mr. Talley showed pictures of the property where it's unsecure, large hole at the front of the house, water damage, missing ceiling sheet rock and rot. Robert Talley's recommendation: 30 days to demolish if not the City has the right to demolish and apply a $1000 per day civil penalty. Motion was made by Johnny Norris, seconded by Zac Saffle to follow Robert Talley's recommendation for the property owner to demolish the property in 30 days, if not the City has the right to demolish and apply a $1000 per day civil penalty to the property. Motion carried unanimously. 5 -0 E. 1705 E Booth, City Block 227 -B, Lot IA Owner: Amanda L McBride, 1758 W Austin, Paris, TX 75460 No contact with the owner. Was purchased 1/6/12 from Steve Coker, that is when the taxes stopped being paid. $406.49 back taxes owed. Mr. Talley showed pictures where there is fire damage along the peak of the roof, there are broken windows and extensive fire damage to the inside of the house. Siding is falling off on the east side of the house. Robert Talley's recommendation: 30 days to demolish if not the City has the right to demolish and apply a $1000 per day civil penalty. Motion was made by Wendell Moore, seconded by Johnny Norris to follow Robert Talley's recommendation for the property owner to demolish the property in 30 days, if not the City has the right to demolish and apply a $1000 per day civil penalty to the property. Motion carried unanimously. 5 -0 F. 1336 Fitzhugh, East Park Addition, Block Q, Lot 27 Owner: JKJ Real Properties LTD 495 CR 43330, Paris, TX 75462 Mr. Talley stated that this property was purchased by Jamie Jetton at the February tax sale. Mr. Talley spoke with Skylar Burchinal who is doing property maintenance and asked for an extension. He agrees that it needs to be demolished but because of all of the work they are doing at the old Cherry Street Manor they are extremely busy. Mr. Talley showed pictures where the house is unsecure. There are holes in the roof that were put there by the Paris Fire Department for training purposes when it was a city property. Robert Talley's recommendation: 60 days to demolish if not the City has the right to demolish and apply a $1000 per day civil penalty. Motion was made by Vicky Ballard, seconded by Wendell Moore to follow Robert Talley's recommendation for the property owner to demolish the property in 60 days, if not the City has the right to demolish and apply a $1000 per day civil penalty to the property. Motion carried unanimously. 5 -0 G. 808 Pine Bluff, City Block 34, Lot 1 Owner: Catherine L Lancaster 1719 Shad Glen Dr Apt 1205, Arlington, TX 76015 No contact has been made with the owner. $5559.89 back taxes owed. Mr. Talley showed pictures of the property where it is unsecure, has missing ceiling tiles, lots of junk and rubbish throughout the house and yard. Mr. Talley stated that there is no water or electric at the house. The neighbors have complained about children going in the house and are worried about their safety. Sue Lancaster asked to speak and stated that this house was built from the remains of the old courthouse. The commission asked Mr. Talley if HPC knew of this and Mr. Talley stated that they did but had no plans to get involved. Due to the safety issue Mr. Talley did not feel it should be tabled. Robert Talley's recommendation: 30 days to demolish if not the City has the right to demolish and apply a $1000 per day civil penalty. Motion was made by Johnny Norris, seconded by Vicky Ballard to follow Robert Talley's recommendation for the property owner to demolish the property in 30 days, if not the City has the right to demolish and apply a $1000 per day civil penalty to the property. Mr. Talley was asked if there were any holes in the roof to which he replied that he didn't see any. Mr. Wilson would like to go after the property owner for back taxes and if they don't pay put this property up for auction at the tax sale. He also stated that if the city could secure it there would be the possibility of saving the rock from the old courthouse. No one on the commission wanted to see this end up in the landfill. Motion was made by Johnny Norris to rescind his previous motion, seconded by Vicky Ballard. Motion to rescind was carried unanimously 5 -0 Mr. Talley asked that this not be tabled due to the safety issue. The city will secure the structure in 14 days to discover the condition of the roof. Motion was made by Zac Saffle, seconded by Johnny Norris to follow Robert Talley's recommendation to secure the structure within 14 days. Motion carried unanimously. 5 -0 I. 1332 -1344 Maple Ave, City Block 190, Lot 11 & 12 Owner: Larry & Cherry Grinstead 305 32nd NE, Paris, TX 75460 No back taxes owed. Mr. Talley stated that 1344 Maple was the structure brought before BSC today. Mr. Grinstead has spoken to Mr. Talley and asked for 90 days to assess how bad the structure is. Mr. Talley gave him the names of two people to contact for estimates. Mr. Talley showed pictures where there is missing siding, roof damage, deteriorated siding and a hole in the roof. The garage is full of junk and rubbish and the house is being used for storage at this time. Motion was made by Johnny Norris, seconded by Wendell Moore to table for 30 days while property owner decides what course of action to take. Motion carried unanimously. 5 -0 J. 1407 Maple, City Block 199, Lot 10 Owner: Jimmie R Briggs 564 CR 33620, Paris, TX 75460 No back taxes owed. Owner is in a nursing home. Her sister contacted Mr. Talley and stated that there was no money to repair the house and she does not have legal guardianship over her sister to make any decisions. She stated that Christians in Action had permission to go in and take anything worth having. Mr. Talley showed pictures where the add -on at the side of the house has collapsed, the house is unsecure and there is deterioration along the eaves of the house. Robert Talley's recommendation: 30 days to demolish if not the City has the right to demolish and apply a $1000 per day civil penalty. Motion carried unanimously. 5 -0 K. 346 NW 9th, City Block 52, Lot 19 Owner: Richard & Iryna Kemple 119 Southampton Dr, Rockwall, TX 75032 No back taxes owed. Mr. Talley stated that he spoke with the owner and that the house was purchased Nov. 2012. They asked for 90 days to repair. Mr. Talley showed pictures where the doors and windows have been boarded up. There is one window still open. Inside, there looks to be new plaster work done. Robert Talley's recommendation: 90 days to repair if not the City has the right to demolish and apply a $1000 per day civil penalty. Motion carried unanimously. 5 -0 L. 339 W Kaufman, City Block 118, Lot 2 Owner: Primera Iglesia Bautista El Calvrio 339 W Kaufman, Paris, No back taxes as this is church property. Mr. Talley stated that this is the parsonage of the church next door who purchased the church tried to purchase this building as well was asking too much for it. Mr. Talley showed pictures of thf TX 75460 . The people but the owner house being unsecure, there is water damage as well as deterioration of the siding and foundation. There have been numerous complaints of people going in and out of this structure and the Police Department has received numerous complaints as well. Mr. Talley also stated that the owners of the church are worried that people will start trying to come into the church as well. Robert Talley's recommendation: 30 days to demolish if not the City has the right to demolish and apply a $1000 per day civil penalty. Mr. Wilson asked Sue Lancaster if this house was worth saving. Mrs. Lancaster stated that it was not. She has been underneath and could see rotten wood as well as termite damage. Motion was made by Johnny Norris, seconded by Wendell Moore to follow Robert Talley's recommendation for the property owner to demolish the property in 30 days, if not the City has the right to demolish and apply a $1000 per day civil penalty to the property. Motion carried unanimously. 5 -0 4. Code Enforcement update. (A) 350 NW 4th came before BSC a couple of months ago. Tree fell, causing the entire front porch to collapse, there are holes in the roof. It had orders to be demolished within 30 days. Since that time Mrs. Verdie Williams who is listed as one of the owners of the home contacted Mr. Talley. She now lives in Texarkana, Arkansas. She stated that a neighbor called her to tell her the house had been tagged for demolition. She was upset that she wasn't informed of this. She states she received the house in her divorce. Mr. Talley asked if she ever contacted the Appraisal District to change her mailing address and she said she had not. She states she is the sole owner and had plans to repair the house and move back in it. There is $10,069.44 in back taxes owed. Mr. Norris wanted to know if she was aware of the back taxes. Mr. Talley was not sure if she did. Mr. Wilson asked that this be put on hold and Mrs. Williams be contacted and told she has 30 days to prove that she is the sole owner of the house. Mr. Talley stated that he wants it brought back before BSC next month. Motion was made by Johnny Norris, seconded by Zac Saffle to table this and re -hear it at the May 2013 meeting. Motion carried unanimously. 5 -0 (B) Mr. Talley handed out receivership definition. Ask for any questions. There were none. (1) Questions about the property on 3rd belonging to Connie Justice. Mr. Talley stated that she is deconstructing it herself and has boarded up the side structure (2) 350 NE 30th has pulled a demolition permit (3) Questions about the structure on Simpson. Did the City demolish it? No they did not. (4) Structure on Fitzhugh — Mr. Talley stated he turned the order in February. As soon as Sanitation Solutions get back over to the east side of Paris they will get it cleaned up 5. Future agenda items. (1) Next meeting May 20, 2013. 6.
