The Board of Adjustment meeting was called to order by Rick Hundley, Chairman, at
12:05 p.m.
A. The following members were present:
Rick Hundley
Jerry Haning
Nathan J. Bell V.
Charles Richards
Allen Moore
B. The following members were absent:
Bryan Glass
Marilyn Smith
C. Also present was Shawn Napier, Director of Engineering, Planning and
Development; Sue Lancaster, Council Member; and Ashley Fendley, City Staff.
2. Approval of minutes from previous meetings. (November 6, 2012)
Motion was made by Charles Richards, seconded by Nathan J. Bell V. to approve minutes
for the November 8, 2012 meeting. Motion carried 5 -0.
3. Public hearing and consideration of and action on the petition of Elizabeth Swint O'Brien
to grant a variance of Zoning Ordinance 1710, Section 9- 201(1) which provides that the
"minimum lot width in a Two Family Dwelling District (2F) be no less than 60 feet 'to
allow a minimum lot width of 50 feet, which is a 10 foot variance, on Lot 12, Block 3, Anita
Park Addition, being number 322 19`h Street S. E.
Public hearing was declared open.
A. One individual spoke in favor of the petition.
Harold O'Brien, of Powderly Texas, spoke in favor of the petition. Mr. O'Brien
stated 322 19th Street S.E. was left in a will to his wife Elizabeth O'Brien when her
father passed away. The structure on the property is beyond repair and needs to be
demolished. Mr. O'Brien further stated he is appearing to get a variance of 10 feet
to build a duplex; the lot is 50 feet in width but over 100 feet in depth and the
duplex will go sideways on the lot.
B. No one spoke in opposition.
Public hearing was declared closed.
Motion was made by Jerry Haning, seconded by Allen Moore to approve the variance
request. Motion carried 5 -0.
4. Public hearing and consideration of and action on the petition of Whitehouse Properties to
grant a variance of Zoning Ordinance 1710, (a) Section 9 -500 which provides that the
,,minimum front yard in a Two - Family Dwelling District (2F) be no less than 25 feet" and
(b) Section 9- 602(5) which provides that "a corner lot used for one family or two-family
dwellings both street exposures shall be treated as front yards on all lots platted after the
effective date of this ordinance " to allow a minimum side yard of 15.8 feet, which is a 9.2
foot variance, on Lot 15, City Block 255 -A, being number 262 25`y' Street N.E.
Public hearing was declared open.
A. No one spoke in favor of the petition.
B. No one spoke in opposition.
Public hearing was declared closed.
Motion was made by Allen Moore, seconded by Charles Richards to approve the variance
request. Motion carried 5 -0.
5. Meeting adjourned at 12:16 p.m.
