01/07/2013 MINUTESMINUTES REGULAR MEETING PLANNING AND ZONING COMMISSION CITY OF PARIS - CITY HALL COUNCIL CHAMBERS 107 E. KAUFMAN STREET PARIS, TEXAS MONDAY, JANUARY 7, 2013 5:30 O'CLOCK P.M. 1. The regular meeting of the Planning and Zoning Commission on Monday, January 7, 2013, was called to order at 5:30 p.m. by Dennis Chalaire, Chairman. A. The following members were present: Dennis Chalaire James Price Mike Folmar Keith Flowers Jerry Akers Holland Harper B. The following members were absent: Richard Hunt C. Also present were Shawn Napier, Director of Engineering, Planning and Development; Alan Efrussy, Planning Manager; John Godwin, City Manager; Sue Lancaster, Council Liaison; and Ashley Fendley, Secretary for the Planning and Zoning Commission. 2. Approval of minutes fNom previous meetings. (November 5, 2012) Motion was made by James Price, seconded by Mike Folmar to approve the meeting minutes for November 5, 2012. Motion carried 6 -0. 3. Discussion of Ord. 2012 -040. Shawn Napier, Director of Engineering, Planning and Development discussed the proposed changes to Ordinance 2012 -040. The ordinance needs to be amended so it conforms to state law. One of the bigger changes occurs in Section 3, under B(1) which will allow a minor plat approval of four (4) lots or less as long as it's not dedicating right of ways or easements; this ordinance will allow more freedom.. The current ordinance allows a minor plat approval of two (2) lots or less as long as it's not dedicating rights of way or easements. Mr. Napier further stated another change in Section 4, F. Minimum Improvements under 1(a), Standard curb and gutter, except as permitted in an area zoned One - family Dwelling District No. 1 (SF -1) (and not otherwise required) or by variance. A subdivided lot may request a curb and gutter variance from the City by submitting the request in writing to the City Engineer prior to Final Plat Approval. The City Engineer may grant a curb and gutter variance administratively upon finding of special circumstances or unnecessary hardship. The Planning and Zoning Commission had some concerns about the changes that a citizen is not going to get shortened and not apply for curb and gutter. Shawn Napier stated the changes are considering if the lot is a middle lot with a 2ft or 3ft road side ditch instead of making them go to the top of the hill to start; the City Engineer can waive this if he finds a hardship. 4. Consideration of and action on the Preliminary Plat of Lot 20, Block C, Windsor Estates Addition, being number 705 40th Street N.E. Shawn Napier reviewed the preliminary plat with commissioners. Motion was made by Holland Harper, seconded by Mike Folmar to approve the preliminary plat, subject to the City Engineer's recommendations. Motion carried 6 -0. 5. Consideration of and action on the Final Plat of Lot 20, Block C, Winsor Estates Addition, being number 705 40th Street N. E. Motion was made by Holland Harper, seconded by Jerry Akers and Mike Folmar to approve the final plat, subject to the City Engineer's recommendations. Motion carried 6 -0. 6 Consideration of and action on the Preliminary Plat of Lot 1, Block A, John House Addition, the 1400 Block of Sherman Street. Shawn Napier reviewed the preliminary plat with commissioners. Motion was made by Keith Flowers, seconded by Holland Harper to approve the preliminary plat, subject to the City Engineer's recommendations. Motion carried 6 -0. 7. Consideration of and action on the Final Plat of Lot 1, Block A, John House Addition, in the 1400 Block of Sherman Street. Dennis Charlaire discussed the City Engineer's recommendation. Mr. House is requesting a variance for the curb and gutter requirements. Shawn Napier, City Engineer, stated that there is existing curb and gutter to the east of the property but not to the west. Mr. House informed the commission that he was not aware of the curb and gutter issues. Mr. House further stated he is planning on building a 1,800sq.ft. metal building to store his cars and R.V. The Planning and Zoning Commission recommend that the property have a driveway approach with curb and gutter in the city right of way. Motion was made by Holland Harper, seconded by Mike Folmar to approve the final plat, subject to the City Engineer's recommendations. Motion carried 6 -0. 8. Consideration of and action on the Preliminary Plat ofLot 1, Block A, TNA Paris Complex Addition 306A, being number 635 Stone Avenue. Shawn Napier reviewed the preliminary plat with commissioners. Motion was made by James Price, seconded by Holland Harper to approve the preliminary plat, subject to the City Engineer's recommendations. Motion carried 6 -0. 9. Consideration of and action on the Final Plat of Lot 1, Block A, TNA Paris Complex Addition 306A, being number 635 Stone Avenue. Motion was made by James Price, seconded by Holland Harper to approve the final plat, subject to the City Engineer's recommendations. Motion carried 6 -0. 10.
