01/04/2010 MINUTESMINUTES REGULAR MEETING PLANNING AND ZONING COMMISSION CITY OF PARIS - CITY HALL COUNCIL CHAMBERS 107 E. KAUFMAN STREET PARIS, TEXAS MONDAY, JANUARY 4, 2010 5:30 O'CLOCK P.M. 1. The regular meeting of the Planning and Zoning Commission on Monday, January 4, 2010, was called to order at 5:30 p.m. by Curtis Fendley, Chairman. A. The following members were present: Curtis Fendley, Chairman Bee Gannon Richard Hunt Bill Harris Keith Barnett B. The following members were absent: Darin Manning Benny Plata C. Shawn Napier, Director of Engineering, Planning and Development; Jeanna Scott, City Staff; and Council Member Rhonda Rogers were also present. 3. Discussion of and possible action on amending the City's Zoning Ordinance to require a specific use permit (SUP) for the loading, unloading or transloading of crude oil in the city limits. Shawn Napier, Director of Engineering, Planning and Development, presented the item to commissioners. Bill Harris asked why we need this SUP designating this use. Mr. Napier stated the current zoning ordinance does not address this use. Mr. Harris asked if we amended the zoning ordinance to allow this use, you will not have to have an SUP in the future. Mr. Napier stated that they will have to have an SUP to be able to transload crude oil in this district. Bee Gannon stated she does agree that the City needs some protection regarding the transloading of crude oil. Bill Harris further asked how will this benefit the City to allow the use and who requested the change? Mr. Napier stated the request came from the City Council. Bee Gannon and Curtis Fendley expressed concerns that we are changing the rules of the game after the company is already in the process of moving their business. Commissioners further expressed concerns about the impact to the roads and neighborhoods in the area. Mr. Napier stated that the request for the SUP would come back to them as a zoning change which would trigger a public hearing; therefore, citizens would be notified and given an opportunity to express their concerns before the SUP was granted. Motion was made to approve and refer to the City Council the request for amending the City's Zoning Ordinance to require a specific use permit (SUP) for the loading, unloading or transloading of crude oil in the city limits by Bee Garmon, seconded by Keith Barnett. Motion carried 3 -2. 2. Approval of minutes from previous meeting. (December 7, 2009) Motion was made by Bill Harris, seconded by Keith Barnett to approve the minutes for the December 7, 2009 meeting. Motion carried 5 -0. 4.
