05/09/2012 MINUTESMINUTES REGULAR MEETING CITY OF PARIS HISTORIC PRESERVATION COMMISSION WEDNESDAY, MAY 9, 2012 12:00 O'CLOCK P.M. 1. The Historic Preservation Commission meeting was called to order by Arvin Starrett, Chairman at 12:01 p.m. A. The following members were present: Arvin Starrett, Chairman Paul Denney, Vice - Chairman Douglas Cox Ben Vaughan Britin Bostick David Stewart B. The following members were absent: Nancy Anderson C. Also present Jeanna Scott, Historic Preservation Officer; Robert Talley, Code Enforcement Supervisor; and Janice Ellis, City Clerk. 2. Approval of minutes from previous meetings. (April 23, 2012) Motion was made by Ben Vaughan, seconded by Douglas Cox to approve the meeting minutes for April 23, 2012. Motion carried 5 -0. Britin Bostick arrived at 12:03 p.m. 3. Consideration of and action on the following Certificate of Appropriateness: A. 135 & 139 Bonham Street — Benevolence Memorial Funeral Home — Cornell Pipkin presented the petition. Mr. Pipkin stated they are proposing signage for their location. Motion was made by Paul Denney, seconded by Britin Bostick to approve the COA. Motion carried 6 -0. B. 135 1St Street S.E. — City Hall — Jeanna Scott, City Staff presented the petition. Ms. Scott stated the City is proposing to replace 9 windows on the second floor of the City Hall Building, two on the north side, 6 on the west side, and 2 on the south side. Ms. Scott further stated there is a sample here for your review, the color will be the stone white, and it is a 9 pane wood, aluminum clad double hung window. Arvin Starrett asked staff if the window met the design standards. Ms. Scott stated that it does meet standards. Motion was made by Douglas Cox, seconded by Ben Vaughan to approve the COA. Motion carried 5 -0. Paul Denney abstained. 5. Deliberate and act on a Resolution of Appreciation for Lyle Vermillion. Ms. Scott presented a sample of the finished resolution. Commissioners requested the Resolution of Appreciation be awarded at the re- dedication ceremony on May 20, 2012. Motion was made by Paul Denney, seconded by Ben Vaughan to approve the Resolution. Motion carried 6 -0. 6. Future agenda items. Discussion and report from city staff and city attorney on demolition by neglect ordinance. -- CONSENT AGENDA— [Items appearing on this consent agenda may be approved by a single vote of the Commission, with such approval applicable to all items appearing on said agenda. If any Commission member desires to discuss and consider separately any item appearing on the consent agenda, that Commission member may do so by requesting that the item be removed from the consent agenda and considered as a separate item.] 4. Discussion of and possible action regarding the following structures considered by code inspectors to be in violation of Article III of Chapter 7 of the Code of Ordinances of the City of Paris, Paris, Texas, entitled "Substandard and Dangerous Buildings and Structures, " to determine whether such buildings or structures currently located within the city's historic district has special historic significance and should be protected from demolition and recommended for rehabilitation and repair being located at: A. 24 & 26 Clarksville Street – Arvin Starrett stated that in the not too distant past I have refused to act on a property that is already designated, the commission is not empowered by ordinance to act on this structure as it is already designated as a historic property. We need to listen to Robert's report, and I have no problem giving a word back to BSC or code recommending rehabilitation and repair, however noting that we do not have the power under the current ordinance to act. Robert Talley gave report to the commissioners regarding the property. Mr. Talley stated wanted to bring to commission because it is getting worse, the first photos that do not have dates were taking on my cell phone. Dale Mayberry and I met Mr. David Hagey at the property today who gave access to the building and the following photos are from that meeting. A major concern is the down spout from the upper level building which is discharging water directly on to the roof and is against building code. This has caused a lot of damage to this roof and the neighboring roof. Mr. Talley went thru each photo explaining to commissioners the issues found as they inspected the building. Ben Vaughan stated he has examined this building on three different occasions, the damage to the roof at the parapet wall has gotten a lot worse since the last time he inspected the roof. Water that is on the east side of the building is coming off the high roof and the water is flowing as if someone turned on a faucet to the lower level roof. Robert Talley stated that Mr. Hagey contracted a roofer to reroof that section. Ben Vaughan stated that the south wall lower floor has broken and missing brick, and the door located on the south wall is also unsecure and is open most of the time. Robert Talley further stated that a portion of the roof has dropped a good 10 -15 inches, reviewing pictures with commissioners regarding that portion of the building. Arvin Starrett asked will this have to go to BSC or will code order repairs. Mr. Talley stated yes this will have to go to BSC as an order to repair. Mr. Starrett further stated so this is affirmation that we do not have a current ordinance on the books that would allow code enforcement to order repairs to this building without it coming under BSC. Robert Talley stated that he is not sure and would need to look at state law; however, Dale Mayberry is involved which escalates the process. The Fire Marshall has more power to get things done. David Stewart stated so is this going to be another Kenny Kammer approach, if so what then. Robert Talley stated this will go to BSC to give owners 30 days to repair, if they do not repair within the 30 days we will move forward to file a court case. Mr. Talley stated that Mr. Hagey is actively trying to sell the building; however, there are two heirs involved who are holding up the sell. Mr. Hagey is glad code enforcement is involved because this may motivate the heirs to sell the building. Ben Vaughan asked what will be required regarding the roof repair, this is not a short term project so do they have 30 days to start or 30 days to complete. Mr. Talley stated he will give the property owners 30 days to start; we will work with the owners as long as they move forward with the repairs. David Stewart asked is there a set of guidelines or approved set of methods to help move the project forward. Mr. Talley stated no there is no quick fix, the roof needs major repair, and they are dumping a lot of water on the neighbor which is also damaging that building. Mr. Starrett stated thank you Robert for your report, but this body is not empowered to take action. No action taken. Further discussion ensued regarding the BSC ordinance, and the fact that it does not empower the Historic Preservation Commission authority to act on structures already designated. 7.
