07/30/2012 MINUTESMINUTES OF THE SPECIAL MEETING OF THE BUILDING AND STANDARDS COMMISSION MONDAY, JULY 309 2012 4 :00 P.M. 1. Don Wilson called the Building and Standards Commission Meeting to order at 4:03 P.M. Roll was called. A. The following members were present: Zack Saffle Johnny Norris Wendell Moore Don Wilson Ryan Lassiter Chris Brown Vicki Ballard entered meeting at 4:09pm B. Staff present: Robert Talley Nicki Brown John Lestock John Godwin 2. Election of Officers: A. Chairman Motion was made by Johnny Norris, seconded by Ryan Lassiter for Don Wilson to remain the Chairman for the Building and Standards Commission. Motion carried unanimously. 5 -0 B. Vice Chairman Motion was made by Johnny Norris, seconded by Zack Saffle for Ryan Lassiter to remain the Vice Chairman for the Building and Standards Commission. Motion carried unanimously. 5 -0 C. Secretary Motion was made by Johnny Norris, seconded by Ryan Lassiter for Wendell Moore to remain the Secretary for the Building and Standards Commission. Motion carried unanimously. 5 -0 3. Approval of minutes from previous meetings. (June 18, 2012) Motion was made by Zack Saffle and seconded by Ryan Lassiter to approve the minutes for the June 18, 2012 meeting. Motion carried unanimously. 6 -0 4. Public Hearing to consider presentations by City of Paris Code Inspectors and owner(s) and /or lien holder(s) of the below properties who have been given notice of a violation of Article III of Chapter 7 of the Code of Ordinances of the City of Paris, Paris, Texas, entitled "Substandard and Dangerous Buildings and Structures ": A. Main Tire; Lot 1, City Block 57 Owner: Ben Faber, Jeffrey L and Sarah M Faber 11548 US Hwy 271 N. Arthur City, TX 75411 Robert Talley stated that he has spoken with Jeff Faber and knows that Sarah Faber is aware of the problems with the property. Robert stated that repair work has started and a dumpster has been put at the property. A demolition permit has been applied for with the City of Paris. Robert pointed out the deterioration of the building; the wood is sagging and pulling away from the structure. The demolition is on the building behind the tire store. Robert Talley's recommendation: Table the property for 60 days and bring it back to the October meeting and look at the progress. Vicky Ballard arrived at the meeting — 4:09pm Don Wilson stated that the front porch is collapsing; painting and straightening up will not help the building. Don doesn't want Robert Talley telling the property owner one thing and the Commission not backing him up. Zack Saffle stated that we can only work what we can see at this time. Johnny Norris asked if the boards are a public hazard. Robert Talley answered yes; the public could be in danger. Zack asked why we would table this property. Johnny Norris stated that 60 days was too long. Don Wilson asked if the Fire Marshall could inspect this property. Robert Talley stated he would get with the Fire Marshall to check on the Certificate of Occupancy and see if they will inspect the property. Don Wilson stated that this property is and eyesore. Motion was made by Johnny Norris, seconded by Wendell Moore to fix the awning where the loose board are and get the Fire Marshall to inspect the property within the next 30 days then bring this property back to the next meeting. Motion carried unanimously. 7 -0 B. 201 Bonham St., Lot 3, City Block 22 Owner: Utility Masters LLC, 2448 Lamar Ave. #904 Paris, TX 75460 Robert Talley said he has been in contact with Richard Lee owner of Utility Masters. Mr. Lee stated that he is fixing the broken windows but there are windows he has opened that are not broken. Johnny Norris asked what the stuff under the windows was and Robert Talley stated plaster. Robert Talley asked Mr. Lee if the roof leaked and Mr. Lee stated no. The bottom floor of this building is occupied. This will be a future building for the Fire Marshall to look at. Don Wilson stated that the plaster falling on the sidewalk needs to be taken care of immediately. Robert Talley's recommendation: Property owner has 60 days to repair broken windows, plaster, and wood panels. Motion was made by Johnny Norris, seconded by Chris Brown to follow Robert Talley's recommendation for the property owner to repair the broken windows, plaster, and wood panels within 60 days. Motion carried unanimously. 7 -0 C. 357 W Kaufman Paris, Lot 1, City Block 118 Owner: Iglesia Bautista El Calvrio Primera, 339 W Kaufman, Paris, TX 75460 Robert Talley stated that he has had no contact with the property owner. Some of the stain glass was stolen and is in police custody. Mrs. Sue Lancaster 1020 Bonham Street, Paris, TX 75460 with HPC has been looking into this property. This is a Historical property. The owners have not been found since 2008. The City of Paris is currently mowing the property. Robert Talley's recommendation: 30 days to board up windows and doors of the property, put a temporary fence around the property (if the permit department will issue one) and place a plaque in the front yard of the property showing the violations so the property owners might contact us so we can get them to sign the building over to us. Motion was made by Wendell Moore, seconded by Vicky Ballard to follow Robert Talley's recommendation to board up the property, put temporary fencing up within 30 days and for the City of Paris to continue mowing the property. Motion carried unanimously. 7 -0 D. 661 NW 13th, Lot 10, Block 9, Colonial Addition Owner: Raymond & Ella Mae Lester, PO Box 1245 Paris, TX 75461 Robert Talley stated that he had talked to Ella Mae Lester and that Raymond Lester has passed away and at that time they were not married. She doesn't want anything to do with the property. Robert stated that the property has fire damage and the floor is burnt so you can see the ground. There is a hole in the roof and missing windows also. Robert Talley's recommendation: 30 days to demolish if not the City has the right to demolish and apply a $1000 per day civil penalty. Motion was made by Zack Saffle, seconded by Chris Brown to follow Robert Talley's recommendation for the property owner to demolish the property in 30 days, if not the City has the right to demolish and apply a $1000 per day civil penalty to the property. Motion carried unanimously. 7 -0 E. 226 NE 11th, Lot 17, City Block 32 -A Owner: Roger W & Dayna L Ballard, 1500 FM 1510, Brookston, TX 75421 Robert Talley has spoken with Roger Ballard and Mr. Ballard stated he would do what needs to be done. Robert Talley's recommendation: 30 days to demolish, if not the City has the right to demolish and apply a $1000 per day civil penalty. Motion was made by Vicky Ballard, seconded by Chris Brown to follow Robert Talley's recommendation for the property owner to demolish the property in 30 days, if not the City has the right to demolish and apply a $1000 per day civil penalty to the property. Motion carried unanimously. 7 -0 5. Update from Code Enforcement (1) There were 10 properties on the list to demo and Robert Talley said that 8 properties have been done and one is in the process of being done. Don Wilson asked why only 9 and Robert Talley stated that the property owner of 737 NW 14th took care of the demolition of the carport. (2) Robert Talley stated that we are almost out of money for demolitions. He said that we had to pay upfront for the six houses that the Resource Management grant will pay us back once the project is complete. Don Wilson stated that if we are going to be reimbursed for the six demolitions we should go ahead and do more demolitions. Robert Talley stated once we see where were at on demo's we can see where we can go with doing more. He did state that the Sanitation Solutions contract allows 15 houses to be partially free or 7 houses to be completely demolished. Don Wilson stated that Robert needs to figure out where we stand before the end of the budget year. (2) The Commission asked about 260 S. Main, property owned by Kenny Kammer. Robert stated that the inspector has been hired for $1500 to inspect the property. Shawn Napier is handling this now. (3) Johnny Norris asked about Cherry Street Manor. Robert Talley stated that there is talk of a Tax Sale of this property. He stated if we had the money we could tear this property down today. 6. Future Agenda Items Don Wilson asked if the Fire Department has turn in any properties to us for demolition or if we have other properties to demo. Robert Talley stated we do have properties to work. Robert Talley talked about working with David Whitaker at the Paris Police Department on several items and how we have had several property owners sign off on the consents to let the City of Paris demolish the properties. Example was 753 E. Polk. 7. Adjournment Motion was made by Chris Brown, seconded by Johnny Norris to adjourn the meeting at 4:58pm.
