1. Don Wilson called the Building and Standards Commission Meeting to order at 4:00
P.M.
Roll was called.

2. Approval of minutes from previous meetings. (July 30, 2012)
Motion was made by Johnny Norris and seconded by Chris Brown to approve the
minutes for the July 30, 2012 meeting.
Motion carried unanimously. 5 -0
3. Public Hearing to consider presentations by City of Paris Code Inspectors and
owner(s) and /or lien holder(s) of the below properties who have been given notice of
a violation of Article III of Chapter 7 of the Code of Ordinances of the City of Paris,
Paris, Texas, entitled "Substandard and Dangerous Buildings and Structures ":
Request was made by Robert Talley to move to item 3 (G), 327 E. Washington; Lot 15, City
Block 146

Present: Jan O'Brien Dyke and Michael Johnson (renter)
Mr. Talley stated that the property at 327 E. Washington has holes in the roof,
deterioration of shingles, rotting wood, several dogs are being housed in the
property, the roof is buckling, the window seals are pushing out and several
windows are broken. The property owner tried to tarp the roof but the tarp is
ripping.
Jan O'Brien Dyke and Michael Johnson spoke to the council and explained that
the neighbors have broken the windows and the police have been notified.
Michael stated that a tree fell on the roof and caused damage and that they are
willing to do the repairs that need to be done to repair the property.
Don Wilson stated that the property has had no repairs for the last year and a half.
He asked if Mrs. Dyke and Mr. Johnson knew how much it would cost to repair
the property. Mr. Johnson stated that he talked to City Hall about a permit to start
repairs. Johnny Norris asked if the only occupants of the house were the dogs
and Mr. Johnson stated they have two dogs and they are the only occupants at this
time. Mr. Wilson and Mr. Moore explained that the property owners are looking
at 5 -6 thousand dollars in repairs. Johnny Norris asked Mrs. Dyke and Mr.
Johnson what they could accomplish in the next 60 -90 days. Mr. Johnson stated
that they could have the roof and windows fixed. Mr. Wilson explained what
happens if no progress is made in the next 60 days.
Robert Talley's recommendation: Repair property within 60 days if not the City
has the right to bring the property back to the Building and Standards Meeting.
Motion was made by Johnny Norris, seconded by Wendell Moore to allow
Mrs. Dyke 60 days to repair the property, if not the property will be brought
back to the Building and Standard Commission. Motion carried
unanimously. 5 -0
Request was made by Robert Talley to move to item 3 (E), 1710 Bonham; Lot All 2 16 % 3
17, City Block 1

Robert Talley showed the Commission that the property is unsecure, windows
broken, doors open, ceiling gone and you can see the rafter, house is sinking,
inside wall is cracked, and the foundation is buckled. Mr. Merritt agrees the
structure on the Maple side of the property needs to be torn down. He has started
the search of prices to have it torn down verses him tearing the structure down. He
is in a financial bind and asked for 90 days.
Robert Talley's recommendation: 90 days to demolish if not the City has the right
to demolish and apply a $1000 per day civil penalty.
Motion was made by Ryan Lassiter, seconded by Chris Brown to follow
Robert Talley's recommendation for the property owner to demolish the
property in 90 days, if not the City has the right to demolish and apply a
$1000 per day civil penalty to the property. Motion carried unanimously. 5 -0
A. 109 NW 23rd; Lot 1, City Block 195
Owner: Elizabeth Leija 510 NE 17th Paris, TX 75460
The Leija's visited with Robert Talley today.
Robert Talley showed the Commission that the property at 109 NW 23rd has
broken windows, it's unsecure, has no sheet rock on the ceiling, chimney has been
busted out, has a tree growing inside the house, and has a well under the house.
The Leija's agree that the property needs to be demolished and want the City of
Paris to tear down the house and they will make arrangement to pay the
demolition fees. Mr. Wilson stated that this house is unsafe due to the open well
under the house. He instructed Robert Talley to put yellow security tape up until
the structure is demolished.
Robert Talley's recommendation: 30 days to demolish if not the City has the right
to demolish and apply a $1000 per day civil penalty.
Motion was made by Chris Brown, seconded by Wendell Moore to follow
Robert Talley's recommendation for the property owner to demolish the
property in 30 days, if not the City has the right to demolish and apply a
$1000 per day civil penalty to the property. Motion carried unanimously. 5 -0
B. 1221 NW 17th; Lot 10 -1), Block 1, Few Addition
Owner: Rochelle Pratt PO Box 572 Paris, TX 75461
Robert Talley stated that he has had no contact with the property owner.
Robert Talley stated that this is one of the better properties we have looked at but
due to no improvements in the past three years he doesn't see the property getting
the repairs. The property is unsecure, has no door knob, broken windows, and the
roof is deterioration on the edges. Mr. Wilson stated that this is a good example of
a house that doesn't need to be torn down. He asked John Lestock to research how
we can sell this property and what we can do since the property owner cannot be
found. Johnny Norris suggests that the City secure the property at the owner's
expense while the research is being done. Mrs. Lancaster asked if the property
taxes are paid up to date. If not the property might be eligible for a tax sale.
Robert Talley will research this.
Robert Talley's recommendation: This property will be tabled until the September
Meeting while John Lestock (City Attorney) and Robert Talley do research on the
property.
Motion was made by Ryan Lassiter, seconded by Chris Brown to table this
property until the September meeting. Motion carried unanimously. 5 -0
C. 101 NW 24th; Lot 8, City Block 3
Owner: Michael McHughes 101 24th NW Paris, TX 75460
Robert Talley stated that no contact has been made with the property owner.
Robert Talley gave a little history on this property. The property was brought to
the BSC about three years ago and the previous owner was going to fix and repair
the property. After that the property sold and no repairs were done. The property
has deterioration, the foundation is damaged, rotten wood, and junk is being
stored inside.
Robert Talley's recommendation: 30 days to demolish if not the City has the right
to demolish and apply a $1000 per day civil penalty.

Robert Talley stated no contact has been made with the owners.
Robert Talley said the structure has a hole in the roof, the roof is buckling, it's
unsecure, has broken windows, the back part is collapsing, and the shed behind
the main house is also dilapidated.
Robert Talley's recommendation: 30 days to demolish if not the City has the right
to demolish and apply a $1000 per day civil penalty.

Robert Talley's recommendation for the property owner to demolish the
property in 30 days, if not the City has the right to demolish and apply a

Robert Talley has had no contact with the owner but that Audra Lane, West side
code enforcement officer has in the past had contact with the owner.
Robert said the property is unsecure, has broken windows, deteriorating shingles,
boards missing, door is sinking, hole in roof, and missing wood.
Robert Talley's recommendation: 30 days to demolish if not the City has the right
to demolish and apply a $1000 per day civil penalty.

Robert Tally stated that he has had no contact with the owner.
Robert Talley stated that the front door is missing and the property owner hung a
black tarp up to secure the building. The property has missing wood, the roof is
buckled and sinking and the back of the house is collapsing.
Robert Talley's recommendation: 30 days to demolish if not the City has the right
to demolish and apply a $1000 per day civil penalty.

property in 30 days, if not the City has the right to demolish and apply a

Robert Talley stated that no contact has been made with the property owner.
Robert Talley said the property is unsecure, there are no floors, no support beams,
and only 80% of the walls are left.
Robert Talley's recommendation: 30 days to demolish if not the City has the right
to demolish and apply a $1000 per day civil penalty.
Motion was made by Wendell Moore, seconded by Johnny Norris to follow
Robert Talley's recommendation for the property owner to demolish the
property in 30 days, if not the City has the right to demolish and apply a

J. 1358 W Booth, Lot 3, City Block 231 -A
Owner: Wayne Kerby PO Box 334 Paris, TX 75461-0334
Robert Talley stated that he spoke with Mr. Kerby.
Robert Talley said that Mr. Kerby agrees that the structure needs to come down.
The property is unsecure, the roof is gone, and Mr. Kerby has contacted
Sanitation Solutions about demolishing the structure. Sanitation Solutions stated
that they are behind about 30 days and this was confirmed by Robert Talley.
Robert Talley's recommendation: 90 days to demolish if not the City has the right
to demolish and apply a $1000 per day civil penalty.
Motion was made by Chris Brown, seconded by Johnny Norris to follow
Robert Talley's recommendation for the property owner to demolish the
property in 90 days, if not the City has the right to demolish and apply a
$1000 per day civil penalty to the property. Motion carried unanimously. 5 -0
4. Update from Code Enforcement
(1) Robert Talley gave the Commission several charts showing that all funds
have been used for demolitions. Mr. Talley stated that permission has been
granted to continue demolitions at this time.
(2) Don Wilson asked why Old Council chamber Abatement was on the
charts Robert Talley gave the Commission. Mr. Wilson said that they City
should have a maintence budget and this should not come out of the BSC
budget.
(3) Don Wilson asked what Utility Billing Internal Payment is and Robert
Talley answered that he would have to look into this.
(4) Robert Talley stated even though the budget is out of money we still have
15 structures that will be done by Sanitation Solution under the Landfill
Contract. Mr. Talley stated that Sanitation Solutions does the demolition
for free on these structures and the City of Paris pays the landfill costs.
(5) Mr. Wilson informed the Commission that a Special Meeting has been set
for August 30, 2012 at 4:OOpm to discuss 260 S. Main and 107 Grand
Ave. Robert stated that a structural engineer report for 260 S. Main St.
stated the building is unsafe.
(6) Robert Talley talked about 304 N. Main and that the Fire Marshall has
taken over this and is shutting the business down.
5. Future agenda items
(1) Don Wilson asked that in the future that Robert Talley provide the
Commission with the amount due in taxes on properties.
6. Adjournment
Motion was made by Johnny Norris, seconded by Ryan Lassiter to adjourn
the meeting at 5:03pm. Motion carried unanimously. 5 -0
Next BSC Special Meeting is scheduled for August 30th at 4:OOpm.
