1. Don Wilson called the Building and Standards Commission Meeting to order at 4:02
P.M.
Roll was called.

2. Approval of minutes from previous meetings. (May 21, 2012)
Motion was made by Johnny Norris and seconded by Wendell Moore to approve the
minutes for the April 16, 2012 meeting.
Motion carried unanimously. 7 -0
3. Public Hearing to consider presentations by City of Paris Code Inspectors and
owner(s) and /or lien holder(s) of the below properties who have been given notice of
a violation of Article III of Chapter 7 of the Code of Ordinances of the City of Paris,
Paris, Texas, entitled "Substandard and Dangerous Buildings and Structures ":
Request was made by Robert Talley to move to item 3 (E), 410 Fitzhugh; Lot 5, City Block

Mr. Talley stated that the bottom floor is secure. The top floor has one window
that was unsecure. The lot has been cleared, the two rooms in the back were
removed and the roof in the back was repaired as instructed the last time the
property was brought before the Buildings and Standards Commission. Mr.
Malone had the house inspected by John Bell who stated that the house was
structurally sound and the roof is not leaking at the time. Mr. Malone asked that
the property be removed from the demolition list.
Mrs. Louise Hagood of 556 Fitzhugh, Paris, TX asked to speak at this time.
Mrs. Hagood stated that Mr. Malone has owned the house for 25 years and hasn't
done anything in all that time.
Mrs. Sheryl Larkin Wood of 501 SE Bch Apt. A, Paris, TX asked to speak. She
stated that she has personally seen Mr. Malone working on his house and believed
he deserved time to continue the repairs.
Motion was made by Vicki Ballard, seconded by Lee Ann Barbee to allow
Mr. Malone 90 days to paint the outside of the house and make it secure.
Motion carried unanimously. 7 -0
Request was made by Robert Talley to move to item 3 (F), 424 Fitzhugh; Lot 6, City Block

Robert Talley showed the Commission that the property at 424 Fitzhugh is
unsecure, missing windows and wood, has roof deterioration and the floor looks
to be missing.
Robert Talley's recommendation: 30 days to demolish if not the City has the right
to demolish and apply a $1000 per day civil penalty.
Motion was made by Johnny Norris, seconded by Wendell Moore to follow
Robert Talley's recommendation for the property owner to demolish the
property in 30 days, if not the City has the right to demolish and apply a
$1000 per day civil penalty to the property. Motion carried unanimously. 7 -0

Robert Talley showed the Commission that the property at 1808 Margaret has a
deteriorated roof, rotting boards, missing windows, and the back porch is rotted,
the structure at the back of the property has a roof that has fallen in and the sides
are bowed.
Mr. Larkin stated that he has a heart problem and has been working on getting
disability. Now that he is receiving disability he will have money to start
working on repairs. Mrs. Sheryl Larkin Wood asked that the Commission give
Mr. Larkin time to try and repair his house. Mr. Bill Wood stated that they had
put up a fence in the back yard and had covered the holes in the roof with tarps.
These measures were taken as a temporary fix until such time that Mr. Larkin
could return to Paris and begin making improvements himself. He did agree that
the back porch does need to be removed.
Randy Roam of 1734 Margaret Paris, TX spoke as to the condition of the house.
He owns two other properties on Margaret. He believes that the original house
is structurally sound but portions that have been added on are deteriorated. Mr.
Roam expressed concern in regards to the amount of money it is going to take
repair this property.
Mr. Larkin would like the opportunity to repair the rear structure and if he deems
it un- repairable then to use what is salvageable to use on the front structure.
Robert Talley's recommendation: 90 days to repair roof on both structures,
remove back porch and secure all windows and doors

Robert Talley stated that he has spoken and exchanged emails with the property
owner. Renter was to come and talk to Mr. Talley and never did. Owner has
stated that he will be coming to Paris this summer but have not heard from him as
to when.
Don Wilson asked John Lestock if the city ordinance did not allow the city to
repair the structure and place a lien on the property. Mr. Lestock stated that he
does not recall the city ever repairing property. Mr. Zack Saffle stated that the
violation letter says the Commission can order the property owner to repair but
that the city only can vacate, secure, remove or demolish the structure. Mr.
Wilson asked Mr. Talley to look into the wording of the ordinance and possibly
changing the wording of the violation letter
Robert Talley's recommendation: since this property has appeared before the
Commission previously and the owner still has not made the necessary repairs to
begin assessing a civil penalty of $10.00 per day starting immediately.
Motion was made by Johnny Norris, seconded by Zack Saffle to follow
Robert Talley's recommendation to assess a civil penalty of $10.00 effective
immediately. Motion carried unanimously. 7 -0
B. 323 & 329 NE 1st; Lot 3, City Block B
Owner: Geraldine Fuller, 1400 W Washington Apt 1103 Paris, TX 75460
Robert Talley stated that Mrs. Fuller came to his office and stated that she has
everything she wants out of the house and is afraid to go anywhere near the
property.
Robert Talley's recommendation: 30 days to demolish if not the City has the right
to demolish and apply a $1000 per day civil penalty.
Motion was made by Ryan Lassiter, seconded by Wendell Moore to follow
Robert Talley's recommendation for the property owner to demolish the
property in 30 days, if not the City has the right to demolish and apply a
$1000 per day civil penalty to the property. Motion carried unanimously. 6 -0
Johnny Norris was not present for this vote.
C. 331 NE 12th, Lot 19, City Block 70
Owner: Kristal Gallegos, 331 NE 12th Paris, TX 75460
Robert Talley stated that he has had no contact with the property owner. House
has extensive fire damage.
Robert Talley's recommendation: 30 days to demolish if not the City has the right
to demolish and apply a $1000 per day civil penalty.
Motion was made by Vicki Ballard, seconded by Zach Saffle to follow Robert
Talley's recommendation for the property owner to demolish the property in
30 days, if not the City has the right to demolish and apply a $1000 per day
civil penalty to the property. Motion carried unanimously. 6 -0 Johnny Norris
was not present for this vote.
D. 347 Bonham, Lot 3, City Block 120
Owner: Tommy Adams, 81 CR 34520 Sumner, TX 75486
Robert Talley stated Mr. Adams brought him a report that said the building was
structurally sound. Mr. Adams was to meet with Mr. Talley to discuss the next
steps and never did.
Robert Talley's recommendation: since this property has appeared before the
Commission previously and the owner still has not made the necessary repairs to
begin assessing a civil penalty of $10.00 per day starting immediately.
Motion was made by Ryan Lassiter, seconded by Zack Saffle to follow
Robert Talley's recommendation to assess a civil penalty of $10.00 effective

Robert Talley stated that the owner is deceased.
Robert said the property is unsecure and the roof has holes in it.
Robert Talley's recommendation: 30 days to demolish if not the City has the right
to demolish and apply a $1000 per day civil penalty.
Motion was made by Wendell Moore, seconded by Johnny Norris to follow
Robert Talley's recommendation for the property owner to demolish the
property in 30 days, if not the City has the right to demolish and apply a
$100 per day civil penalty to the property. Motion carried unanimously. 7 -0
H. 440 Pine Bluff, Lot 7, City Block 37

Robert Tally stated that he has had no contact with the owner.
Mr. Talley said there is fire damage to the roof of the house, it is unsecure, the
structure is bowed and the back of the house is falling.
Robert Talley's recommendation: 30 days to demolish if not the City has the right
to demolish and apply a $1000 per day civil penalty.

Robert Talley stated the owner did get a demolition permit from the City and tore
down the top floor of the house. That was 8 or 9 months ago and nothing has
been done since.
Robert Talley's recommendation: 30 days to demolish if not the City has the right
to demolish and apply a $1000 per day civil penalty.

Robert Talley stated that he spoke with the owners. They hired Ed Darnell to
demolish the house. He was paid but never did the work. The owners have shown
copies of the receipts. They do not have the money to pay someone again to tear it
down.
Don Wilson asked John Lestock if it was possible for them to sue Ed Darnell. Mr.
Lestock stated that they had to right to take it to either the County Judge or to
Municipal Court. Mr. Wilson would like Robert to follow up with the owners to
make the aware of this.

to demolish and apply a $1000 per day civil penalty.

Robert Talley stated that he has had no contact with the property owner. Has
extensive fire damage.
Robert Talley's recommendation: 30 days to demolish if not the City has the right
to demolish and apply a $1000 per day civil penalty.

L. 1141 SE 6th, Lot 5 -A & Pt 5 -B, City Block 163 -A
Owner: Mary Jo Kitchens
Robert Talley stated that he spoke with Mrs. Kitchens and she was giving the
property to her son. The son does not want it and has no plans to fix it. The roof
has a hole in it, boards are rotting and there are broken windows.
Robert Talley's recommendation: 30 days to demolish if not the City has the right
to demolish and apply a $1000 per day civil penalty.

property in 30 days, if not the City has the right to demolish and apply a

M. 1513 NE 10th, Lot 8, Block C, East Park Addition

Robert Talley stated that he has had no contact with the property owner. House
has missing windows, no door and the ceiling is cracking from possible water
damage.
Robert Talley's recommendation: 30 days to demolish if not the City has the right
to demolish and apply a $1000 per day civil penalty.

O. 1810 W Austin, Lot Pt 14, 15, & 16, Block 5, SJ Wright Addition
Owner: Lana Lynn Clay, 195 Laredo Dr Reno, TX 75462
Robert Talley stated that there has been no contact with the property owner. The
main structure on the property was torn down but rubbish was left. The other
building has been burnt and is falling in.
Robert Talley's recommendation: 30 days to demolish if not the City has the right
to demolish and apply a $1000 per day civil penalty.

Robert Talley's recommendation for the property owner to demolish the
property in 30 days, if not the City has the right to demolish and apply a
$1000 per day civil penalty to the property. Motion carried unanimously. 7 -0
4. Update from Code Enforcement
(1) Don Wilson asked if the City Council passed the ordinance to hire a
structural engineer. This is not going to be addressed by the council until
the new budget year.
(2) The Commission asked about 260 S. Main, property owned by Kenny
Kammer. Robert stated that a structural engineer will be in town
Wednesday, June 20, 2012 to inspect the building.
(3) Robert Talley stated that Sanitation Solutions has the first list of work
orders of houses to be demolished and is half way done.
5. Don Wilson asked if the next BSC Meeting could be scheduled for July 12,
2012. As long as the council chambers are available the meeting will take
place on this date at 4:00pm.
6. Adjournment
