10/15/2012 MINUTESMINUTES OF THE REGULAR MEETING OF THE BUILDING AND STANDARDS COMMISSION MONDAY, OCTOBER 15, 2012 3:00 P.M. 1. Ryan Lassiter called the Building and Standards Commission Meeting to order at 3:05 P.M. Roll was called. A. The following members were present: Johnny Norris (arrived at 3:50pm) Wendell Moore Ryan Lassiter Chris Brown Zach Saffle Don Wilson (arrived at 3:15pm) B. Staff present: Robert Talley Nicki Brown John Lestock 2. Approval of minutes from previous meetings. (September 17, 2012) Motion was made by Chris Brown and seconded by Wendell Moore to approve the minutes for the September 17, 2012 meeting. Motion carried unanimously. 4 -0 3. Public Hearing to consider presentations by City of Paris Code Inspectors and owner(s) and /or lien holder(s) of the below properties who have been given notice of a violation of Article III of Chapter 7 of the Code of Ordinances of the City of Paris, Paris, Texas, entitled "Substandard and Dangerous Buildings and Structures ": . Request was made by Robert Talley to move to item 3. O., 1203 SE 16th; Lot 13, City Block 14 O. 1203 SE 16th; Lot 13, Block 14, Gibbon - Braden Addition Owner: Joyce Blair Freeman, 6926 FM 195 Paris, TX 75460 Present: Joyce Freeman Mr. Talley stated that the property at 1203 SE 16th has deterioration of the foundation, insulation is hanging out, has some rotting of the foundation, and deterioration of the wood. Joyce Freeman spoke, she stated that the house doesn't leak and its wiring was good. She asked for 90 days to repair the property and at this time the property is not occupied. Robert Talley's recommendation: Repair within 60 days City has the right to apply a $1000 per day civil penalty. Motion was made by Wendell Moore, seconded by Chris Brown to allow Mrs. Freeman 90 days to have the property repaired if not the property will be brought back to the Building and Standard Commission. Motion carried unanimously. 4 -0 Don Wilson entered the meeting. Ryan Lassiter recused himself from items R. and S. Don Wilson made a motion to recuse Ryan Lassiter from the discussion and Zach Saffle seconded the motion. Motion carried 4 -0. R. 1503 Margaret; Lot 20, City Block 102 Owner: John S. House, 1446 Clarksville St. Paris, TX 75460 Present: John S. House Robert Talley showed pictures of the holes in the roof, warping boards, rotting boards, boards coming loose from the structure, and shingles buckling. John House spoke to the commission and plans on tearing down the structure and asked for 120 days. Don Wilson explained to Mr. House that the commission can only give 90 days. Robert Talley's recommendation: 30 days to demolish if not the City has the right to demolish and apply a $1000 per day civil penalty. Motion was made by Zach Saffle, seconded by Chris Brown to allow Mr. House to demolish the property in 90 days, if not the City has the right to demolish and apply a $1000 per day civil penalty to the property. Motion carried unanimously. 4 -0 S. 1608 E Hearon; Lot 6 -A & 6 -B, City Block 112 -F Owner: John S. House, 1446 Clarksville St. Paris, TX 75460 Present: John S. House Robert Talley showed pictures of the deteriorating wood, windows broken, unsecure, interior destroyed, front of the house has dropped, and there is deterioration of the roof. John House told the commission that he had planned on tearing the house down and asked for 90 days to demolish the house. Robert Talley's recommendation: 30 days to demolish if not the City has the right to demolish and apply a $1000 per day civil penalty. Motion was made by Chris Brown, seconded by Zach Saffle to allow Mr. House 10 days to secure the property and 90 days to demolish the property, if not the City has the right to demolish and apply a $1000 per day civil penalty to the property. Motion carried unanimously. 4 -0 A motion was made by Chris Brown and seconded by Wendell Moore to allow Ryan Lassiter to enter back into the meeting. V. 1808 Margaret; Lot 7 & W25' of 8, Block 2, Anita Park Addition Owner: Sheryl Larkin Wood, 1890 CR 22500 Paris, TX 75460 Present: Sheryl Larking Wood and Bill Wood Robert Talley stated that the Woods have replaced the wood, some areas are in bad shape but they are addressing the areas. They have torn down the old porch and are working on the property. The Woods have also finished the roof. Robert and the Fire Marshall have inspected the property. Bill Wood addressed the commission and asked if they would take the front structure off the condemned list so they could focus on the back structure. Discussion on the removal of the front structure off the condemned list took place. Mr. Wilson stated that the structure couldn't be taken off the list until all the work is completed. Mr. Saffle stated that the Woods have completed all the work. Robert Talley agreed that the Woods have completed the work they were asked to do. The Wood's showed pictures taken today on all the work that's been done. Randy Roam of 1750 Margaret St. spoke to the commission. He explained that the owners have done an outstanding job in a short amount of time on the property. Mr. Moore asked if the privacy fence that was put up helped with the security of the back structure. Everyone agreed it did. Mr. Brown stated that he agreed that the commission should release the front structure and focus on the back structure now. Mr. Moore and Mr. Lassiter commended the property owns for a job well done. Robert Talley's recommendation: The front structure: 90 days to have the property repaired if not the property will be brought back to the Building and Standard Commission. The back structure: 30 days to demolish if not the City has the right to demolish and apply a $1000 per day civil penalty. Motion was made by Ryan Lassiter, seconded by Zach Saffle to allow 90 days to demolish or repair the back structure on the property, if not the property will be brought back to the Building and Standard Commission. Motion carried unanimously. 5 -0 C. 326 SE 3rd; Lot 4, City Block 181 Owner: Marin & Connie Justice PO Box 737 Paris, TX 75461 -0737 Present: Connie Justice was present but she did not speak. Robert Talley showed pictures of the overgrowth around the house, there is a hole in the roof, the porch is falling in, missing wood, foundation sinking, water damage, unsecure, missing sheetrock, and rotting wood. The side structure has missing wood. Don Wilson asked if the structure is sound. Robert Talley stated that when Mrs. Justice applies for permits that the inspection department will have to determine if the structure can be repaired. He stated that it's up to the owner to determine if they want to repair or not and if they fail to do so or if the building inspectors do not pass the structure it will be brought back to the commission. Robert Talley's recommendation: 90 days to have the property repaired if not the property will be brought back to the Building and Standard Commission. Motion was made by Wendell Moore, seconded by Ryan Lassiter to follow Robert Talley's recommendation for the property owner to repair the property in 90 days, if not the property will be brought back to the Building and Standard Commission. A. 47 NW 9th, Lot 7 -A, Block 1, Connor Place Addition Owner: Amira Sadik, 1465 Clarksville Paris, TX 75460 Robert Talley has had no contact with the owner. Robert Talley stated that the property is unsecure, has broken windows, shingles are bowing, has damage on the roof, there are breaks in the wood, water damage, and has missing wood. Robert Talley's recommendation: 30 days to demolish if not the City has the right to demolish and apply a $1000 per day civil penalty. Motion was made by Johnny Norris, seconded by Chris Brown to follow Robert Talley's recommendation for the property owner to demolish the property in 30 days, if not the City has the right to demolish and apply a $1000 per day civil penalty to the property. Motion carried unanimously. 6 -0 B. 216 SE 20th, Lot 16, City Block 223 Owner: Martin & Carmen Loera, 1722 Church St. Sulphur Springs, TX 75482 Robert Talley spoke with both Martin and Carmen today at the property. The property owner agreed that the back structure needs to be demolished. The front structure has no moisture, a new roof, and has new wood on it. The property owners are working on it. The commission had a discussion about what repair means and if it matters if the property is habitable or not. Robert Talley's recommendation: 90 days to have the front structure on the property repaired if not the property will be brought back to the Building and Standard Commission and 30 days to demolish the back structure and if not the City has the right to demolish and apply a $1000 per day civil penalty. Motion was made by Johnny Norris, seconded by Wendell Moore to follow Robert Talley's recommendation for the property owner to repair the front structure on the property within 90 days, if not the property will be brought back to the Building and Standard Commission. The back structure on the property should be demolished within 30 days, if not the City has the right to demolish and apply a $1000 per day civil penalty to the property. Motion carried unanimously. 6 -0 D. 335 E Sherman, Lot 13, City Block 141 Owner: Verdell Tunson, 12900 SE 268 th St. Unit # E -2 Kent, WA 98030 Robert Tally stated that he has talked to the property owner. Robert Talley stated that the property owner needs more time to demolish the structure. There is water damage, the plumbing has been stripped, and the roof is leaking. Robert Talley's recommendation: 60 days to demolish if not the City has the right to demolish and apply a $1000 per day civil penalty. Motion was made by Chris Brown, seconded by Zach Saffle to follow Robert Talley's recommendation for the property owner to demolish the property in 30 days, if not the City has the right to demolish and apply a $1000 per day civil penalty to the property. Robert Talley showed pictures of deterioration, holes in floor, daylight showing through walls, and the properties unsecure. Robert Talley's recommendation: 30 days to demolish if not the City has the right to demolish and apply a $1000 per day civil penalty. Robert Talley stated this property is unsecured, the front porch is sagging, there's a hole in the roof, water damage, foundation is sinking, holes in the interior, and the wiring has been stripped. Robert Talley's recommendation: 60 days to demolish if not the City has the right to demolish and apply a $1000 per day civil penalty. Motion was made by Johnny Norris, seconded by Zach Saffle to follow Robert Talley's recommendation for the property owner to demolish the property in 60 days, if not the City has the right to demolish and apply a $1000 per day civil penalty to the property. Motion carried unanimously. 6 -0 G. 626 E Heron, Lot 3, Block 5, Gibbons 1St Addition Owner: Jimmy Lee Furtch Jr., 325 13th NW Paris, TX 75460 Robert Talley and Nicki Brown (East side code enforcement officer) have both talked to Mr. Furtch in the past. Robert Talley stated that the structure is unsecure, the front porch has collapsed, wood has rotted, has deteriorated plywood, the structure is leaning, and there is a hole in the roof. Robert Talley's recommendation: 30 days to demolish if not the City has the right to demolish and apply a $1000 per day civil penalty. Motion was made by Chris Brown, seconded by Wendell Moore to follow Robert Talley's recommendation for the property owner to demolish the property in 30 days, if not the City has the right to demolish and apply a $1000 per day civil penalty to the property. Motion carried unanimously. 6 -0 H. 733 & 737 SE 8th, Lot 1, Block 6, Gibbon 1St Addition Owners: Jose Albarran, 9012 Curry Village Dr. #6 Yosemite Natl. Park, CA 95389 Robert Talley has talked to Mr. Albarran twice on the phone. Mr. Albarran has contacted someone to look at the property. Robert Talley stated there is a hole in the roof, shingles are coming off, the property is unsecure, the roof is deteriorated, and facial boards are rotting and the foundation and under penning are sinking. Robert Talley's recommendation: 90 days to demolish if not the City has the right to demolish and apply a $1000 per day civil penalty. Motion was made by Wendell Moore, seconded by Johnny Norris for the property owner to secure the property in 30 days, and make a decision to demolish or repair the property in 90 days, if not the property will be brought back to the Building and Standard Commission. Motion carried unanimously. 6 -0 I. 910 SE 5th, Lot 10, City Block 160 Owner: Renford Holmes, 1090 34th SE Paris, TX 75460 Robert Talley met the owner at the property. Mr. Holmes wants to repair the front structure and claims the back structure is not his. Robert Talley stated that the structure in the back shows to be on Mr. Holmes property but Mr. Holmes claims it's not. Robert will have to investigate this property and bring it back to the commission. Mr. Talley showed the commission pictures of the front structure and the structure is unsecure, has water damage, and support beams are missing. Robert Talley stated after talking to the property owner he went back by the property later and the property is secure and repairs have been started. Robert Talley's recommendation: 90 days to repair the property and if not the property will be brought back to the Building and Standard Commission. Motion carried unanimously. 6 -0 J. 913 E Polk, Lot 26, Block 1, Gibbon Park Addition Owner: Mary Mitchell, 913 E Polk Paris, TX 75460 Robert Talley has had no contact with the owner. Robert Talley has talked to the neighbors and the house is vacant. Robert Talley stated that the property is unsecure, has deterioration, is buckling, has gaps in the structure, and has lots of storage that is being pulled out into the yard by vandals. Robert Talley's recommendation: 30 days to demolish if not the City has the right to demolish and apply a $1000 per day civil penalty. Robert Talley said there is no ridge cap on the top of the house but that a metal roof was put on the house after the damage. The carport has fallen in and is unsecure. Robert said there is no damage to the inside of the house but it is abandoned. Mr. Holmes wants to repair the structure. Robert Talley stated that the property has water damage, holes in the roof, deterioration, it's unsecure, holes in the floor, and the structure is leaning. Robert Talley's recommendation: 30 days to demolish if not the City has the right to demolish and apply a $1000 per day civil penalty. Robert Talley's recommendation: 30 days to demolish if not the City has the right to demolish and apply a $1000 per day civil penalty. Robert Talley's recommendation: 30 days to demolish if not the City has the right to demolish and apply a $1000 per day civil penalty. The certified letter came back undelivered. Robert Talley stated that the property has deterioration, holes in the roof; it's rotting, and has missing wood. Robert Talley's recommendation: 30 days to demolish if not the City has the right to demolish and apply a $1000 per day civil penalty. Robert Talley stated that the house has fire damage and a hole in the roof. Don Wilson asked the question since the house burned what if the property owner received an insurance check. Robert Talley said there was no way to know. Robert Talley's recommendation: 30 days to demolish if not the City has the right to demolish and apply a $1000 per day civil penalty. Motion carried unanimously. 6 -0 U. 1720 Cleveland, Lot E60' 1 -2 & E60' of N25' of 3, Block 4, Anita Park Addition Owner: James & Johnna McNeal, 4175 Linn Dr. Paris, TX 75460 Robert Talley spoke with Johnna McNeal and she said the bank would not let them demolish the structure. Since she received the letter from the City the bank is trying to work with her. The property is unsecure, broken windows, holes in the walls, and missing floor. Robert Talley's recommendation: 90 days to demolish if not the City has the right to demolish and apply a $1000 per day civil penalty. He stated that Mike Malone's extension was out and that he didn't start working on the property until one week prior to his deadline. 5.
