2004-057-ORD PROVIDING EXTENSION OF CERTAIN BOUNDARY LIMITS IN COP AND ANNEXATION OF 5.187 ACRES ORDINANCE NO. 2004~057 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS, PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF PARIS, PARIS, TEXAS, AND THE ANNEXATION OF CERTAIN TERRITORY CONSISTING OF 5.187 ACRES, MORE OR LESS, AS REQUESTED BY PETITION OF THE OWNERS THEREOF; GRANTING TO SAID TERRITORY AND TO ALL FUTURE INHABITANTS OF SAID PROPERTY ALL OF THE RIGHTS AND PRIVILEGES OF OTHER CITIZENS AND BINDING SAID FUTURE INHABIT ANTS BY ALL OF THE ACTS AND ORDINANCES OF THE CITY OF PARIS; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, a petition of annexation has been duly signed and acknowledged by each and every person or corporation having an interest in the following described territory, to-wit: Being all that certain tract ofland situated in Lamar County, Texas, a partofthe Wesley Askins Survey, Abstract No.7, apart of the 100.00 acre tract ofland conveyed to D. Wayne Brown, et aI., by deed recorded in Volume 939, Page 31 of the Lamar County Real Property Records, and a part of the 121.76 acre tract of land conveyed to D. Wayne Brown, et aI., by deed recorded in Volume 949, Page 296 of the Lamar County Real Property Records, and being further described as follows: Beginning at a point, said point being North 64008'23" West a distance of 298.63 feet from an iron pin found for comer at the most Northeasterly comer of Lot 17, Block B, of The Hills Phase III as recorded in Envelope No. 371-C of the Lamar County Plat Records; . Thence around a curve to the right having a radius of 452.47 feet, long chord bears South 44000' 10" West a distance ofl11.70 feet, an arc distance of 111.99 feet to a point for comer; Thence South 51005'37" West a distance of 1267.07 feet to a point for comer; Thence North 44012'46" West a distance of 134.46 feet to a point for comer; Thence around a curve to the right having a radius of 691.20 feet, long chord . b0ars North 43018' 13" West a distance of36.22 feet, an arc distance of36.22 feet to a point for comer; Thence South 89002'43" East a distance of150.82 feet to a point for comer; Thence South 64008'23" East a distance of 65.83 feet to the point of beginning and containing 5.187 acres of land; and, WHEREAS, said tract ofland is contiguous and adjacent to the current city limits of the city of Paris, Texas, and is not more than one-half (1/2) mile in width; and, WHEREAS, said petition fully cOnfonned with the requirements of Section 6 of the Charter of the City of Paris and Section 43.028 of the Local Government Code; and, WHEREAS, said petition was preSented to the City Council on the II th day of October, 2004; and, WHEREAS, after hearing such petition and the arguments for and against the same, the City Council adopted Resolution No. 2004-191 granting such petition to annex said territoI}' into the city of Paris, Texas; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS: Section 1. That the findings set out in the Preamble to this ordinance are hereby in all things approved. Section 2. That the fOllOwing described property, to-wit: Being all that certain tract ofland situated in Lamar County, Texas, a part of the Wesley Askins Survey, Abstract No.7, a part of the 100.00 acre tract of land conveyed to D . Wayne Brown, et aI., by deed recorded in Volwne 939, Page 31 of the Lamar County Real Property Records, and a part of the 121. 76 acre tract ofland Conveyed to D. Wayne Brown, et al., by deed recorded in Vo1wne 949, Page 296 of the Lamar County Real Property Records, and being further described as follows: Beginning at a point, said point being North 64008'23" West a distance of 298.63 feet from an iron pin found for comer at the most Northeasterly comer of Lot 17, Block B, of The Hills Phase ill as recorded in Envelope No. 371-C of the Lamar County Plat Records; Thence around a curve to the right having a radius of 4 52.47 feet, long chord bears South 44 000 '10" West a distance ofll I . 70 fee~ an arc distance ofl I 1.99 feet to a point for comer; Thence South 51005'37" West a distance of 1267.07 feet to a point for comer; Thence North 44012' 46" West a distance of 134.46 feet to a point for comer; Thence around a curve to the right having a radius of 691.20 feet, long chord bears North 43018 '13 " West a distance of36.22 fee~ an arc distance of36.22 feet to a point for comer; Thence North 51 005 '3 7" East a distance ofl249.30 feet to a point for comer; Thence South 89002'43" East a distance of 150.82 feet to a point for comer; Thence South 64008'23" East a distance of 65.83 feet to the point of beginning and containing 5.187 acres of land be, and the same is hereby, annexed to the city of Paris, Texas, and that boundary limits of the city of Paris, Texas, be, and the same are hereby, extended to include the above-described territory, and the same shall hereafter be included within the territorial limits of the city of Paris, and that said land and the inhabitants thereof shall hereafter be entitled to all of the rights and privileges and subject to all of the obligations and responsibilities of other citizens of the city of Paris, Texas, and shall be bound by the acts and ordinances of the City of Paris. Section 3. That the City Clerk be, and she is hereby, directed to file with the County Clerk of Lamar County, Texas, a certified copy of this Ordinance accompanied by a copy of the Petition for Annexation. Section 4. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. Section 5. That this ordinance shall become effective on December 1,2004.
