03/06/2000 MINUTESPLANNING AND ZONING COMMISSION MEETING MARCH 6, 2000 The Planning and Zoning Commission met Monday, March 6, 2000 at 5:30 in the City Hall - Council Room, Paris, Texas with the following members present: 1. Reeves Hayter 4. Curtis Fendley 2. Bobby L. Myers 5. Michael Dangerfield 3. Cesar Horta 6. Marshall Kent Earl Smith, the City Engineer was also present. The meeting was called to order by Reeves Hayter. 1. The minutes from the February 7, 2000 regular planning and zoning meeting were approved with a motion by Curtis Fendley seconded by Bobby L. Myers. Motion carried by a vote of 6 ayes and 0 nays. 2. Public Hearing to consider the petition of Larry Dee Hoskins for a change in zoning from an Agricultural District (A) to a Multiple- Family Dwelling District No. 1(MF -1) Part of Lot 10, City Block 188 -E, being the 1800 Block of SE 6" Street. The public hearing was declared open. Mr. Larry Dee Hoskins, Rt. 4, Box 429, Clarksville, TX, spoke in favor of the petition, he wants Multiple Family zoning. A fire hydrant is already in place. There was no opposition, the public hearing was declared closed. 3. Consideration of and action on the petition of Larry Dee Hoskins for a change in zoning from an Agricultural District (A) to a Multiple - Family Dwelling District No. 1 (1VIF -1) Part of Lot 10, City Block 188 -E, being the 1800 Block of SE 6" Street. Motion was made to approve by Michael Dangerfield and seconded by Bobby Myers. Motion carried by a vote of 6 ayes and 0 nays. 4. Public Hearing to consider the petition of Carmon King for a change in zoning from a One - Family Dwelling District No. 2 (SF -2) to a One - Family Dwelling District No. 3 (SF -3) With Specific Use Permit (39) Mobile Homes, Pt. of Lot 1, Block 301, being the 600 Block of NW 27" Street. The public hearing was declared open. Mr. Carmon King, 10737 FM 14, Tyler, TX, spoke in favor of the petition for a mobile home. The property would be restricted to 1200 SF and the home would be 5 years old or newer and tied down and skirted. Mr. King feels this will prevent degrading of properties. He plans to live there himself. Mr. Robert White, 705 NW 27`'', opposed the petition, he presented a petition with several signatures of neighbors in opposition. He feels it will degrade property values. Mr. Gary Lay, 605 NW 27th, agrees with Mr. White that properties will degrade. Mr. John Paul Brown, 725 NW 27th, also opposed and agreed with the others that properties would degrade. Ms. Ellen Grayson, 635 NW 27', agrees with the others. Ms. Shanna Garrison is fearful that the change would lower property values. Mr. Clyde Coleman, is opposed to the zoning change stating that he currently owns a mobile home there but plans to build a house. There was no further opposition, the public hearing was declared closed. 5. Consideration of and action on the petition of Carmon King for a change in zoning from a One - Family Dwelling District No. 2 (SF -2) to a One - Family Dwelling District No. 3 (SF -3) With Specific Use Permit (39) Mobile Homes, Pt. of Lot 1, City Block 301, being the 600 Block of NW 27`h Street. Motion made to deny the petition by Curtis Fendley and seconded by Michael Dangerfield. Motion carried by a vote of 6 ayes and 0 nays. 6. Public Hearing to consider the petition of Doris Thorsen for a change in zoning froma One - Family Dwelling District No. 2 (SF -2) to a One - Family Dwelling District No. 3 (SF- 3) With Specific Use Permit (39) Mobile Homes, Lot 11, City Block 241, being number 545 NW 14`h Street. The public hearing was declared open. Ms. Doris Thorsen, 123 E. Price, representing her son who owns the property, spoke in favor of the petition. Her son is young and not well established yet but in the long term plans to build a home. The lot is presently vacant. Mr. Tom Adams, Jr., Rt. 2, Box 20A, Sumner, who owns adjoining property is opposed to the petition. He feels the neighborhood is improving and he plans to tear down his old houses and maybe build duplexes in the future. He fears this zoning would degrade properties. There was no fiu-ther opposition, the public hearing was declared closed. 7. Consideration of and action on the petition of Doris Thorsen for a change in zoning from a One - Family Dwelling District No. 2 (SF -2) to a One - Family Dwelling District No. 3 (SF -3) With Specific Use Permit (39) Mobile Homes, Lot 11, City Block 241, being number 545 NW 14`h Street. Motion was made to deny by Curtis Fendley and seconded by Michael Dangerfield. Motion carried by a vote of 6 ayes and 0 nays. 8. Public Hearing to consider the petition of Jerry Pitcock for a classification of New and Unlisted Uses to a Light Industrial District (LI), Pt. of Lot 18, City Block 324, being number 2820 NW Loop 286. The public hearing was declared open. City Attorney, Larry Schenk and Steve Methven addressed the Planning and Zoning Commission in an attempt to inform them of the item to be considered. Mr. Jerry Pitcock, 1310 N. Collegiate, spoke in favor of the petition. The petition is for an "Auto Storage Yard," he does not take cars apart unless police or court directs searches. He impounds cars /vehicles for Law Enforcement Agencies. Mr. Pitcock normally keeps cars for a 90 day screening. The site will be lighted at night. There will be wrecked vehicles on the property but usually will be removed quickly. There was no opposition, the public hearing was declared closed. 9. Consideration of and action on the petition of Jerry Pitcock for a classification of New and Unlisted Uses to a Light Industrial District (LI), Pt. of Lot 18, City Block 324, being number 2820 NW Loop 286. Motion was made to recommend that the Council create a new listing, Schedule of Use: "Auto Storage Facility" Requiring Specific Use Permit in Light Industrial or Heavy Industrial by Curtis Fendley and seconded by Bobby Myers. Motion carried by a vote of 6 ayes and 0 nays. 10. Public Hearing to consider the petition of Cindy G. Bowlin for a change in zoning from a Two - Family Dwelling District (2F) to a Two - Family Dwelling District (2F) With Specific Use Permit (24) Institutions of Religious Nature, Lot 1, City Block 32, being number 1202 Pine Bluff. The public hearing was declared open. Ms. Cindy Bowlin, 1325 SE 18`'', spoke in favor of the petition stating that she wants to place a women's home for women to stay up to 6 months for education and religious teachings. The goal of the home is to break the cycle of homelessness and welfare. She does not know how many women will live there, the women may have children. Most of them will not have cars, however, owner has arrangements to use next door for parking. Also, parking is available across the street. The staff will also need parking. Ms. Bowlin has done this in California, therefore, she has experience in this type of home. She thinks they can park 8 cars on the property. The house would be maintained by the owner. Ms. Susan Walker, on Board of Directors, shared personal experience that she had here in Paris. She provided assistance with the type of person that this organization will assist. Ms. Betty Kildahl, Rt. 1, Box 228, Sumner, speaking for the church across the street, opposed the petition. She understands the need and the house is big enough but she thinks a verbal agreement for the drive is not good enough. She wonders how the organization is funded and if it fails, what happen to the house? Mr. Jerry Harting, 1213 Pine Bluff, lives across the street and is very familiar with traffic problems in the area. He feels the home is a good idea but questions if this is a good location due to parking. He thinks only 3 cars can park there. The Planning and Zoning Commission questions the limit on number of residents and parking problem. There was no further opposition, the public hearing was declared closed. 11. Consideration of and action on the recommendation of Cindy G. Bowlin for a change in zoning from a Two - Family Dwelling District (2F) to a Two - Family Dwelling District (2F) With Specific Use Permit (24) Institutions of Religious Nature, Lot 1, City Block 32, being number 1202 Pine Bluff. Motion to table was made by Curtis Fendley and seconded by Marshall Kent. Motion carried by a vote of 6 ayes and 0 nays. 12. Public Hearing to consider the petition of Donald Lewis for a change in zoning from an Agricultural District (A) to a One - Family Dwelling District No. 3 (SF -3), Lot 18, City Block 501. The public hearing was declared open. Mr. Donald Lewis, Rt.10, Box 7410, Paris, spoke in favor of the petition stating the property was recently annexed and he wants to rezone to six One - Family Dwelling District lots for patio homes. There was no opposition, the public hearing was declared closed. 13. Consideration of and action on the recommendation of Donald Lewis for a change in zoning from an Agricultural District (A) to a One - Family Dwelling District No. 3 (SF- 3), Lot 18, City Block 501. Motion was made to approve by Curtis Fendley and seconded by Michael Dangerfield. Motion carried by a vote of 6 ayes and 0 nays. 14. Public Hearing to consider the petition of Linda Stephens for a change in zoning from an Agricultural District (A) to a Commercial District (C) With Specific Use Permit (54) Signs and Billboards, Lot 14, City Block 306 -C, being the 5600 Block of 271 North. The public hearing was declared open. Ms. Linda Stephens, Rt. 2, Box 182, spoke in favor of the petition stating that she wants to build a billboard. There was no opposition, the public hearing was declared closed. 15. Consideration of and action on the recommendation of Linda Stephens for a change in zoning from an Agricultural District (A) to a Commercial District (C) With Specific Use Permit (54) Signs and Billboards, Lot 14, City Block 306 -C, being the 5600 Block of 271 North. Motion was made to approve by Curtis Fendley and seconded by Bobby Myers. Motion carried by a vote of 6 ayes and 0 nays. 16. Consideration of and action on the recommendation of the Preliminary Plat, Lot 18, City Block 501, Amherst Court. Motion was made to approve by Curtis Fendley and seconded by Bobby Myers, subject to the City Engineer's Memo dated, March 6, 2000. Motion carried by a vote of 6 ayes and 0 nays. 17. Consideration of and action on the recommendation of the Preliminary Plat, The Hills. Motion was made to approve by Bobby Myers and seconded by Michael Dangerfield, subject to the City Engineer's Memo, dated March 6, 2000. Motion carried by a vote of 6 ayes and 0 nays. 18. Consideration of and action on the recommendation of the Preliminary Plat, Eastgate Subdivision. Motion was made to reject by Curtis Fendley and seconded by Marshall Kent.
