The Planning and Zoning Commission met Monday, July 3, 2000 at 5:30 in the City Hall - Council
Room, Paris, Texas with the following members present:

Earl Smith, the city engineer was also present.
The meeting was called to order by Reeves Hayter.
1. The minutes from the June 5, 2000 regular planning and zoning meeting were approved
with a motion by Curtis Fendley seconded by Bobby Myers. Motion carried by a vote of 6
ayes and 0 nays.
2. The next item was tabled at the June 5, 2000, meeting. Motion was made by Bobby
Myers and seconded by Eddie Vincent to bring item from table. Motion carried by a
vote of 6 ayes and 0 nays.
3. Public Hearing to consider the petition of Owen Bigler, Jr. for a change in zoning from
an Agricultural District (A) to a One - Family Dwelling District No. 3 (SF -3), With
Specific Use Permit (39) Mobile Homes, Lot 5A, City Block 329, being number 3803
SW Loop 286.
The public hearing was declared open.
Owen Bigler, 3803 SW Loop 286, spoke in favor of the petition for a mobile home for
church food bank for possibly up to 6 months.
Ms. Charlene Mulligan, 226 W. Washington, opposed the petition stating that she wants
assurance that the mobile home would be removed within a certain period of time. She
would like the time for the mobile home to be removed put in writing. Ms. Mulligan is
opposed to all mobile home zoning.
Ms. Vickie Hime, 308 W. Washington, opposed the petition for mobile home fearing that
one mobile home would be the start for more homes.
Vincent Battles joins the meeting.
Mr. Bloyce Enloe, 235 SW 41', showed pictures of what he said was wastewater flowing
from the subject church. The picture, also, showed a small travel trailer that illegally
discharges waste onto his property.
Planning and Zoning members review the Memo from the City Attorney.
There was no further opposition, the public hearing was declared closed.
4. Consideration of and action on the petition of Owen Bigler, Jr. for a change in zoning
from an Agricultural District (A) to a One - Family Dwelling District No. 3 (SF -3), With
Specific Use Permit (39) Mobile Homes, Lot 5A, City Block 329, being number 3803
SW Loop 286.
Motion was made to approve for up to 6 months with no extension allowed by Bobby Myers
and seconded by Curtis Fendley. Motion carried by a vote of 7 ayes and 0 nays.
5. The next item was tabled at the June 5, 2000, meeting. Item brought from table by a
vote of 7 ayes and 0 nays.
6. Public Hearing to consider the petition of Gary Nash for a change in zoning from a
General Retail District (GR) and One - Family Dwelling District No. 2 (SF -2) to a
Commercial District (C), Part of Lots 13,14, 27 and 28, being the 1800 Block Bonham
Street.
The public hearing was declared open.
Gary Nash, spoke in favor of the petition stating that he wants to rezone the entire property.
He has no plans for the property at this time.
Mr. Ed Henry, who owns land at 2220 Maple, wants to know what Mr. Nash plans for the
property.
Ms. Wayne Tomblin, 4215 Lake Shore, representing the church, wants to know what the
plans are for the rezoning.
There was no opposition, the public hearing was declared closed.
7. Consideration of and action on the petition of Gary Nash for a change in zoning from
a General Retail District (GR) and One - Family Dwelling District No. 2 (SF -2) to a
Commercial District (C), Part of Lots 13, 14, 27 and 28, being the 1800 Block Bonham
Street.
Motion was made to approve by Curtis Fendley and seconded by Marshall Kent. Motion
carried by a vote of 7 ayes and 0 nays.
8. The next item was tabled at the June 5, 2000, meeting. Motion was made by Marshall
Kent and seconded by Eddie Vincent to bring item from table. Motion carried by a
vote of 7 ayes and 0 nays.
9. Public Hearing to consider the petition of Gary Nash for a change in zoning from a
Commercial District (C) to a Commercial District (C) With Specific Use Permit (52)
Signs and Billboards, Lot 11 -A, City Block 321, being number 1805 FM 195.
The public hearing was declared open.
Gary Nash spoke in favor of the petition stating that he wants to erect a billboard on the lot.
Due to heavy traffic on highway, this is a good location for billboard advertising.
There was no opposition, the public hearing was declared closed.
Bobby Myers was excused from the meeting. Motion made by Curtis Fendley and seconded
by Marshall Kent. Motion carried by a vote of 6 ayes and 0 nays.
10. Consideration of and action on the petition of Gary Nash for a change in zoning from
a Commercial District (C) to a Commercial District (C) With Specific Use Permit (52)
Signs and Billboards, Lot 11 -A, City Block 321, being number 1805 FM 195.
Motion was made to approve by Eddie Vincent and seconded by Curtis Fendley. Motion
carried by a vote of 5 ayes and 1 nay.
Motion was made for Bobby Myers to return to the meeting by Eddie Vincent and seconded
by Marshall Kent. Motion carried by a vote of 6 ayes and 0 nays.
11. Public Hearing to consider the petition of Donald Lewis for a change in zoning from
a One - Family Dwelling District No. 3 (SF -3) to a Planned Development District
(PD -b), Lot 18, City Block 501.
The public hearing was declared open.
This item remained table from the June 5, meeting.

12. Consideration of and action on the petition of Donald Lewis for a change in zoning
from a One - Family Dwelling District No. 3 (SF -3) to a Planned Development District
(PD -b), Lot 18, City Block 501.
Item remained tabled.
13. Public Hearing to consider the petition of Mario Munguia for a change in zoning from
a One - Family Dwelling District No. 2 (SF -2), to a One - Family Dwelling District No. 3
(SF -3) With Specific Use Permit (39) Mobile Homes, Lot 32, City Block 197, being
number 1858 Maple.
There was no one present to speak in favor of the petition.
Ms. Sarah Lee, 1848 Maple, opposed the petition stating that the property already has a
house on it that's being used for storage. She thinks that there is no room for the placement
of a mobile home. There is a mobile home park across 19`h NW. A petition was presented
also.
Mr. Wayne Tomblin, 4215 Lakeshore Drive, representing the Church, opposed the petition
for mobile home zoning.
14. Consideration of and action on the petition of Mario Munguia for a change in zoning
from a One - Family Dwelling District No. 2 (SF -2), to a One - Family Dwelling District
No. 3 (SF -3) With Specific Use Permit (39) Mobile Homes, Lot 32, City Block 197, being
number 1858 Maple.
Motion was made to deny by Curtis Fendley and seconded by Marshall Kent. Motion
carried by a vote of 7 ayes and 0 nays.
Motion is made by Curtis Fendley and seconded by Bobby Myers to excuse Reeves Hayter.
Motion carried by a vote of 6 ayes and 0 nays. Marshall Kent is now presiding.
15. Public Hearing to consider the petition of Jim Bell for a change in zoning from a One -
Family Dwelling District No. 2 (SF -2) to a Commercial District (C), Part of Lots 3 & 4
and Lot 28A, City Block 222 -A, being number 2140 E. Price.
The public hearing was declared open.
Mr. Danny Chance, representing Jim Bell Realtors, spoke in favor of the petition stating that
he would like for the entire property to be zoned Commercial.
Ms. Margie Bell has interest in the property and wants all property to be zoned the same for
Auto Parts Store. She would like for the drive to go back to Price Street and drainage would
also be conveyed to the back. There is an old house on Price Street that would be torn down.
Mr. John Nabors, 2140 E. Price, opposed the petition. He would like to know if there would
be a privacy fence.
There was no further opposition, the public hearing was declared closed.
16. Consideration of and action on the petition of Jim Bell for a change in zoning from a
One - Family Dwelling District No. 2 (SF -2) to a Commercial District (C), Part of Lots
3 & 4 and Lot 28A, City Block 222 -A, being number 2140 E. Price.
Motion was made to approve by Curtis Fendley and seconded by Bobby Myers. Motion
carried by a vote of 6 ayes and 0 nays.
17. Motion was made for Item #26 to be considered next. Motion was made by Curtis
Fendley and seconded by Eddie Vincent. Motion carried by a vote of 6 ayes and 0 nays.
Motion was made for Reeves Hayter to return to the meeting by Bobby Myers and seconded
by Vincent Battles. Motion carried by a vote of 6 ayes and 0 nays.
18. Public Hearing to consider the petition of Benton Rainey for a change in zoning from
an Agricultural District (A) to a One - Family Dwelling District No. 2 (SF -2), Lot 8, City
Block 351, being the 3400 Block Jefferson Road. Consideration of and action on
recommendation of the Preliminary Plat of Lot 8, City Block 351, Rosewood Addition,
being the 3400 Block of Jefferson Road.
The public hearing was declared open.
Mr. Benton Rainey, 835 39`h SE, spoke in favor of the petition, he wants to sell 8 lots along
Jefferson Road.
There was no opposition, the public hearing was declared closed.
19. Consideration of and action on the petition of Benton Rainey for a change in zoning
from an Agricultural District (A) to a One - Family Dwelling District No. 2 (SF -2), Lot
8, City Block 351, being the 3400 Block Jefferson Road. Consideration of and action on
recommendation of the Preliminary Plat of Lot 8, City Block 351, Rosewood Addition,
being the 3400 Block of Jefferson Road.
Motion was made to approve by Curtis Fendley and seconded by Bobby Myers. Motion
carried by a vote of 6 ayes and 0 nays.
20. Public Hearing to consider the petition of Mark Pratt for a change in zoning from a
One - Family Dwelling District No. 2 (SF -2) to a Neighborhood Service District (NS), Lot
26, Block P, East Park Addition, being number 1351 NE 11`h.
The public hearing was declared open.
Mr. Mark Pratt, 1351 NE 11`h, spoke in favor of the petition stating that he wants to put in
a snow cone stand on the lot next door.
There was no opposition, the public hearing was declared closed.
21. Consideration of and action on the petition of Mark Pratt for a change in zoning from
a One - Family Dwelling District No. 2 (SF -2) to a Neighborhood Service District (NS),
Lot 26, Block P, East Park Addition, being number 1351 NE 11 ".
Motion was made to approved by Bobby Myers and seconded by Vincent Battles. Motion
carried by a vote of 5 ayes and 2 nays.
22. Public Hearing to consider the petition of Sheila Wise for a change in zoning from a
One - Family Dwelling District No. 2 (SF -2) to a One - Family Dwelling District No. 3 (SF-
3) With Specific Use Permit (39) Mobile Homes, Lot 2, City Block 327, being 3440 W.
Campbell Street.
The public hearing was declared open.
Ms. Sheila Wise, 3740 Pine Mill Road, spoke in favor of the petition stating that she wants
to leave the mobile home park where she presently resides.
There was no opposition, the public hearing was declared closed.
23. Consideration of and action on the petition of Sheila Wise for a change in zoning from
a One - Family Dwelling District No. 2 (SF -2) to a One - Family Dwelling District No. 3
(SF -3) With Specific Use Permit (39) Mobile Homes, Lot 2, City Block 327, being 3440
W. Campbell Street.
Motion was made to approve by Marshall Kent and seconded by Bobby Myers. Motion
carried by a vote of 4 ayes and 2 nays.
24. Public Hearing to consider the petition of Rosa Garcia for a change in zoning from a
One - Family Dwelling District No. 2 (SF -2) to a One - Family Dwelling District No. 3
(SF -3) With Specific Use Permit (39) Mobile Homes, Lot 18, City Block 198, being
number 1411 W. Houston.
The public hearing was declared open.
Ms. Rosa Garcia, who currently leaves in Odessa, present a letter from neighbors in favor
of the petition.
Mr. Bobby Masters, representing the Church of God, wants to know if it is a nice mobile
home but is not opposed if it is old or junk.
Larry Grinstead, 1332 W. Maple, feels mobile home will cause further decline of
neighborhood.
Ms. Mary Davenport, 1350 W. Houston, opposed the petition, she feels it may depreciate
value of homes. She presented a petition of opposed neighbors.
Mr. John Curry, Jr. presented a letter opposing the petition.
There was no fiirther opposition, the public hearing was declared closed.
25. Consideration of and action on the petition of Rosa Garcia for a change in zoning from
a One - Family Dwelling District No. 2 (SF -2) to a One - Family Dwelling District No. 3
(SF -3) With Specific Use Permit (39) Mobile Homes, Lot 18, City Block 198, being
number 1411 W. Houston.
Motion was made to deny Curtis Fendley and seconded by Bobby Myers. Motion carried
by a vote of 7 ayes and 0 nays.
26. Public Hearing to consider the petition of Gary Nash for a change in zoning from a
Planned Development -al (Commercial Center) District (PD -al) to a Commercial
District (C), Part of Lot 12, City Block 259, being the 500 Block of N. Collegiate.
The public hearing was declared open.
Gary Nash spoke in favor of the petition. He wants to change to Commercial zoning so that
he does not have to bring site plan to Planning and Zoning for approval.
There was no opposition, the public hearing was declared closed.
27. Consideration of and action on the petition of Gary Nash for a change in zoning from
a Planned Development -al (Commercial Center) District (PD -al) to a Commercial
District (C), Part of Lot 12, City Block 259, being the 500 Block of N. Collegiate.
Motion was made to approve by Eddie Vincent and seconded by Curtis Fendley but motion
failed by a vote of 3 ayes and 4 nays.
28. Public Hearing to consider the petition of Jake Street for a change in zoning from a
Planned Development -b District (PD -b) to a One - Family Dwelling District No. 3 (SF -3)
Mobile Home Subdivision, ParcOuest Addition, Phase II, being the 3600 Block of
Bonham Street.
The public hearing was declared open.
Mr. Jake Street, 113 ParcOuest, spoke in favor of the petition, presenting to Planning and
Zoning Commission excerpts from upcoming Master Plan. Also, presented was a copy of
a letter from Todd Worthey, Lot 248, supporting the change. Mr. Street wants to allow high
quality manufactured housing —only new ones with concrete foundations and 2 car garage
or carport.
Ms. William Huey, 107 ParcOuest, opposed the zoning stating that when they bought their
home they paid attention to restrictions. Now if changing zoning/restrictions, this will
greatly affect the value of their home. Ms. Huey presented a copy of restrictions to Planning
and Zoning Commission.
Ms. Deloris Redus, 34`' SW, who lives behind the property, opposed the zoning stating she
feels mobile home will devalue property and not help to beautify Paris. She pointed out that
the Master Plan has not been adopted yet.
Mr. Mike Robert, 3825 Sage Trail, thinks mobile home park may lend to "West Paris"
stigma.
Mr. Clifford Stripland, 275 34`'' SW, opposed the zoning, stating he loves west Paris and does
not want mobile homes there.
Ms. Debbie Burks, 3925 Sage Trail, opposed the zoning, she thinks mobile homes will
devalue property. She stated that Thousand Oaks Mobile Home Park has police troubles and
fears this one may too.
Ms. M. Butler, 3445 W. Kaufman, presented photos of "nice homes" within 3 blocks of
proposed zoning.
There was no further opposition, the public hearing was declared closed.
29. Consideration of and action on the petition of Jake Street for a change in zoning from
a Planned Development -b District (PD -b) to a One - Family Dwelling District No. 3 (SF-
3) Mobile Home Subdivision, ParcOuest Addition, Phase II, being the 3600 Block of
Bonham Street.
Motion was made to deny by Curtis Fendley and seconded by Eddie Vincent. Motion
carried by a vote of 7 ayes and 0 nays.
30. Public Hearing to consider the site plan approval requested by Gary Gage, Lot 13 -B,
City Block 259, being the 500 Block of N. Collegiate.
Mr. Gary Gage spoke in favor of the site plan approval, he wants to build a metal building
with front wood grain texture —white trimmed in black. The building will be used as a
Donut Shop with a 4 I/z pitch roof. Will look similar to Sabrina's building. A privacy fence
will be built around the dumpster. There will be a lighted sign 10' -12' high in front of the
building.
Gary Nash spoke in favor of the site plan.
There was no opposition, the public hearing was declared closed.
31. Consideration of and action on the site plan approval requested by Gary Gage, Lot 13-
B, City Block 259, being the 500 Block of N. Collegiate.
Motion was made to approve by Curtis Fendley and seconded by Bobby Myers. Motion
carried by a vote of 6 ayes and 1 nays.
32. Consideration of and action on recommendation of the Replat of Lot 13, Block 1,
Warren Addition.
Motion was made to approve by Bobby Myers and seconded by Marshall Kent. Motion
carried by a vote of 7 ayes and 0 nays.
33. Consideration of and action on recommendation of the Final Plat, Lot 5, City Block
318, Phase I, Paris Business Park.
Motion was made to deny by Curtis Fendley and seconded by Marshall Kent, subject to the
City Engineer's memo, dated June 5, 2000. Motion carried by a vote of 7 ayes and 0 nays.
34. Consideration of and action on recommendation of the Final Plat, Lot 13, City Block
259, being the 500 Block of N. Collegiate.
Motion was made to a deny by Barbara Forrest and seconded by Vincent Battles. Motion
carried by a vote of 6 ayes and 1 nay.
