The Planning and Zoning Commission met Tuesday, September 5, 2000 at 5:30 at Heritage Hall -
1009 West Kaufman Street, Paris, Texas with the following members present: t

Earl Smith, the city engineer was also present.
The meeting was called to order by Reeves Hayter.
1. The minutes from the August 7, 2000 regular planning and zoning meeting were approved
with a motion by Bobby Myers seconded by Eddie Vincent. A correction was made to Item
#14 of the August 7, meeting, motion carried by a vote of 7 ayes and 1 abstained, Eddie
Vincent.
Motion was made by Bobby Myers and seconded by Bill Coleman to consider Item #10
next.
2. Public Hearing to consider the petition of Nell Fleming for a change in zoning from a
One - Family Dwelling District No. 2 (SF -2) to a One - Family Dwelling District No. 2 (SF-
2) With Specific Use Permit (25) Nursery or Daycare, Lot 3, Block A, Eastfield
Addition, being number 525 NE 32" Street.
The public hearing was declared open.
Ms. Fleming, 525 32 "d NE, 0.2 miles from Aikin School, spoke in favor of the petition, she
wants to keep 8 -9 children in an environment with structured activities, outdoor activities
twice a day for 30 minutes. Ms. Fleming has experience with this type of business. Ms.
Fleming had an inspection and is already licensed for the business. Operating hours will be
from 7 a.m. to 5:30 p.m., Monday -Friday only. The children would arrive at staggered times
and there would be no signs of the business displayed.
Mr. Dan Edwards who lives across the street from Ms. Fleming states that the Flemings have
increased their home value with improvements and mentioned that the zoning goes away
with the Flemings if they move.
Ms. Lee Ann Sartor, states that she has known the Flemings for 4 years and Ms. Fleming
keeps her children, they also, take good care of their property and are Christian people with
a clean house.
Ms. Jeanette Bender, 615 32nd NE, opposed the zoning stating that her main concern is
property values. She feels that the change would lower values and is afraid that this would
prompt other changes for more businesses in the area thus creating traffic problems.
Ms. Ella Sugg, 625 32nd NE, states there are numerous children in the neighborhood and a
lot of traffic on Pine Mill Road. She thinks this would increase traffic, also the house has
a small yard. Ms. Sugg thinks this business would destroy peace in the neighborhood.
Mr. Tony Ballard, 710 32" NE, states the neighborhood does not want a change.
Ms. Ballard, 710 32 n NE, recently bought her home and is afraid of traffic problems. She
thinks this change will ruin the residential character.
Ms. Virginia Crawford, 630 32" NE, bought in this neighborhood looking forward to
retirement because it was quiet and close to everything that attracts older people.
Rev. R.L. Clark, minister of Tudor Street Church of Christ, spoke in favor of the petition
stating that his wife has taken care of children for 20 years and good child care is important
for the child to grow up good.
There was a petition presented of 33 in opposition to the zoning change.
3. Consideration of and action on the petition of Nell Fleming for a change in zoning from
a One - Family Dwelling District No. 2 (SF -2) to a One - Family Dwelling District No. 2
(SF -2) With Specific Use Permit (25) Nursery or Daycare, Lot 3, Block A, Eastfield
Addition, being number 525 NE 32" Street.
Motion was made to deny by Bill Coleman and seconded by Bobby Myers. Motion carried
by a vote of 7 ayes and 0 nays.
Motion was made by Bobby Myers and seconded by Vincent Battles to move on to Item #8
next. Motion carried by a vote of 7 ayes and 0 nays.
Motion was made by Vincent Battles and seconded by Louis Yates, Jr. to excuse Reeves
Hayter from the meeting. Motion carried by a vote of 6 ayes and 0 nays.
4. Public Hearing to consider the petition of American Homesites, LLC for a change in
zoning from an Agricultural District (A) to a Planned Development District -
Community Unit Development (PD -b), Lot 3, City Block 328, being the 3800 Block SW
Loop 286.
The public hearing was declared open.
Mr. Rod Wede, President of American Homesites, passed out information on the proposed
project to the Planning and Zoning Commission. The proposed project will cost $5 million.
The area would have a swimming pool, park area, clubhouse, and 24 hour manager on site.
There would be a restriction on the age of manufactured homes. The city needs this project.
There would be no sales at this location. Each home would average 1000 SF. Requirement
would be for the homes to be 5 years old or newer and no campers allowed. There were
1,600 manufactured homes sold in Lamar County last year. The lots will be at least 6000
SF.
Rod Wede's partner, Gene , has a facility in Sherman, Texas. There are 3 family
generations at his Sherman location. He does not think that this project would devalue any
properties. There is a subdivision with one hundred $125,000 homes next to this property.
They will do whatever is best for the City, i.e., street dedication. 4
Melissa Huie,107 ParcOuest, thinks the project will devalue properties and that a swimming
pool, park, clubhouse, etc., will not be built.
Ms. L. Butcher, 3810 Sage Trail, states that the homes in her neighborhood has to be 75%
brick and there is a lot of traffic on the Loop, especially at shift changes.
Ms. Pat 011ey, 4000 Block of Old Bonham Rd., states there is a lot of traffic on the Loop and
when she bought her home she did not expect to have to drive by a mobile home park.
Mr. Cliff, 275 34`'' SW, states spots lease for $250 per month and by the time you add a
house payment, lot rent cost $800 per month, they can buy a home at that cost.
Mr. John Wright, 3605 W. Houston, states that the City beautification efforts would not
include this project.
Rev. Randal Scott, states that a realtor will tell you that a project like this will lower property
values. The owners need to be specific about commercial development and if they want to
help Paris, why not go to the south Loop where there is no development.
Mr. Fred Plata, W. Washington, states that traffic is a problem and manufacturing homes will
decrease in value.
Mr. Wede, rebuts stating that a lease will not be $250 a month and any house will devalue
if not taken care of and the total cost of living in the project would be $600 a month which
would include everything.
A petition was presented in opposition to the zoning change.
5. Consideration of and action on the petition of American Homesites, LLC for a change

Loop 286.
Motion was made to approve by Eddie Vincent. Motion was made to deny by Louis Yates,
Jr. and seconded by Barbara Forrest. Motion carried by a vote of 5 ayes and 1 aye.
Motion was made by a vote of 6 ayes and 0 nays for Reeves Hayter to return to the meeting.
6 . Public Hearing to consider the petition of Mary Lester for a change in zoning from a
One - Family Dwelling District No. 3 (SF -3) to a One - Family Dwelling District No. 3 (SF-
3) With Specific Use Permit (39) Mobile Homes, Part of Lots 2 and 4, Block N,
Dohoney - Fuller Addition, being number 1212 West Campbell.
The public hearing was declared open.
Ms. Mary Lester, 837 18`x' NW, spoke in favor of the petition stating that she has lived there
for 30 years and wants a new mobile home at this location.
The house that was at this location burned and Misty Lester wants a mobile home moved in.
The lot has been cleaned up and she plans to buy a new manufactured home. Her brother
lives nearby in a manufactured home.
Mr. Marcus Graves, 1120 W. Long, opposed the petition stating that he does not see that this
will help home values in the area.
Ms. Charlene Mulligan, 226 W. Washington, states that with manufacturing housing hitting
and missing —it looks like there is no plan to follow.
There was no fi -ther opposition, the public hearing was declared closed.
7. Consideration of and action on the petition of Mary Lester for a change in zoning from
a One - Family Dwelling District No. 3 (SF -3) to a One - Family Dwelling District No. 3
(SF -3) With Specific Use Permit (39) Mobile Homes, Part of Lots 2 and 4, Block N,
Dohoney- Fuller Addition, being number 1212 West Campbell.
Motion was made to deny by Vincent Battles and seconded by Bill Coleman. Motion carried
by a vote of 6 ayes and 1 nays.
8. Public Hearing to consider the petition of Dr. Thomas Charbeneau for a change in
zoning from a Planned Development District - Housing Development (PD -b) to a
Planned Development District - Office Center (PD-1), Lot 10, City Block 311, being
number 3420 Clarksville.
The public hearing was declared open.
Dr. Thomas Charbeneau, 3065 Pride Circle, spoke in favor of the petition, he wants to move
his office to this location which would add to the beautification of the area and possibly have
office space for another professional.
Mr. DoyleWhitaker, 3000 Margaret, stated that changing the zoning would not conflict with
the area.
There was no opposition, the public hearing was declared closed.
9. Consideration of and action on the petition of Dr. Thomas Charbeneau for a change
in zoning from a Planned Development District - Housing Development (PD -b) to a
Planned Development District - Office Center (PD -f), Lot 10, City Block 311, being
number 3420 Clarksville.
Motion was made to approve by Louis Yates, Jr. seconded by Bobby Myers. Motion carried
by a vote of 7 ayes and 0 nays. 4
10. Public Hearing to consider the petition of Carla Jackson for a change in zoning from
a Two - Family Dwelling District (2F) to a Neighborhood Service District (NS), Lot 7,
City Block 63, being number 648 Tudor.
The public hearing was declared open.
Carla Jackson, 1211 Martin L. King Dr., spoke in favor of the petition. She has an existing
barber shop next door and would like the zoning to build a larger shop.
Aaron Jenkins who lives at 5`}' Street NE supports Carla's request.
There was no opposition, the public hearing was declared closed.
11. Consideration of and action on the petition of Carla Jackson for a change in zoning
from a Two - Family Dwelling District (2F) to a Neighborhood Service District (NS), Lot
7, City Block 63, being number 648 Tudor.
Motion was made to approve by Bobby Myers and seconded by Louis Yates, Jr. Motion
carried by a vote of 7 ayes and 0 nays.
Motion was made by Eddie Vincent and seconded by Bobby Myers to excuse Reeves Hayter
from consideration of the next item. Motion carried by a vote of 6 ayes and 0 nays.
12. Consideration of and action on recommendation of the Replat, Lots 3, 4, and 28A, City
Block 222 -A, being number 2153 Lamar Avenue.
Motion was made to approve by Eddie Vincent and seconded by Vincent Battles, subject to
the City Engineer's Memo, dated September 5, 2000. Motion carried by a vote of 6 ayes and
0 nays.
Motion was made by Bill Coleman and seconded by Louis Yates, Jr. for Reeves Hayter to
return to the meeting. Motion carried by a vote of 6 ayes and 0 nays.
13. Public Hearing on the Comprehensive Master Plan.
Scott Michie of Bucher, Willis & Ratliff summarized how the Master Plan was started and
how it got to this point.
1. Main use of Plan is "Future Land Use"
2. Contains recommended ordinance changes, especially for zoning — standards will
be provided upon which approvals or denials can be based
3. Goals /objectives came from Charrett process at beginning of project
4. Standards for beautification
5. Blend of "BIG PICTURE" and "details" like site plans content
Don Howell, 115 Airport Rd., has property on SE Loop 286.
Rev. Randal Scott doe not like the idea of manufactured homes recommendedin West Paris.
Billy Carr, who lives near Lake Crook, asked about Plan.
Ms. Redus agrees with Rev. Scott, wants sidewalks to be considered.
Ms. Vickie Hime, 308 W. Washington, states that the west side of town needs new sidewalks
and code enforcement —she thinks the town is prejudiced.
Steve Pierson and Mark from Archers for Christ, wants City to consider what they do
for Lake Crook.
Benny Plata, 850 191 SW, pages 7 & 8, thinks the public input is important and must be
considered.
