03/01/2004 MINUTESMINUTES OF THE REGULAR MEETING OF THE PLANNING AND ZONING COMMISSION MARCH 1, 2004 The Planning and Zoning Commission met Monday, March 1, 2004, 5:30 P.M., Paris Junior College, Bobby R. Walters Applied Technology Building, Room 1206, 2400 Clarksville Street, Paris, Texas with the following members present: 1. Reeves Hayter 2. Barbara Forrest 3. Bobby Myers 4. Louis Yates 5. Marshall Kent 6. Russell McCain Steve Metheven, the Building Official was also present. The meeting was called to order by Reeves Hayter. 1. There was no February 2, 2004, meeting due to lack of quorum. The minutes from the January 5, 2004, regular planning and zoning meeting were approved by Russell McCain, seconded by Marshall Kent. The minutes from the February 10, 2004, special meeting were approved with a motion by Louis Yates seconded by Bobby Myers. Motion carried by a vote of 6 ayes and 0 nays. 2. Public Hearing to consider the petition of Cindy Gates for a change in zoning from an Agricultural District (A) to a Commercial District (C), With Specific Use Permit (49) Auto Fuel Sales, Lot 3, City Block 328, being the 3800 Block of SW Loop 286. The public hearing was declared open. Cindy Gates, CR 33500, House 30, Sumner, Texas, spoke in favor of the petition stating that the truck stop would be a family business to make a living for her family. Joe Early, 4035 Old Bonham, have lived there for 36 years - -spoke in opposition to the petition stating that he has tolerated the noise from Kimberly Clark since they opened. Mr. Early lived next to a truck stop Planning and Zoning Meeting March 1, 2004 Page 2 in Baytown and states that he knows how a truck stop sounds with the idling trucks. Stanford Rogers Thurman, a 30 year retired truck driver, spoke in opposition to the petition stating that he knows that a truck stop will bring drugs to the area. Michael Roberts, 3825 Sage Trail Drive, spoke in opposition of the petition stating that the area is a quiet residential district and he does not want increased loop noise. Mr. Roberts also stated that he has completely remodeled his home and does not want to see his property value lowered because of a truck stop in the area. If the truck stop is built, it would be visible from his back door. Mr. Roberts spent several years as a truck driver —and he has seen prostitution and drugs in about 90% of the truck stops. Mr. Robert stated that his opinions are biased from his background as a truck driver and he opposes the petition. Rick Hawthorne, 121 Rue Calle, moved here about a year ago from Ft. Lauderdale, Florida, spoke in opposition to the petition stating that he has a 41/2 year old son and he has a nice quiet safe place for him to grow up. Mr. Hawthorne stated that the truck stop would be too close to residential. Debbie Burks, 3935 Sage Trail, spoke in opposition to the petition stating that she feels safe in her neighborhood and with a truck stop there, she will not feel safe. Ms. Burks stated that there are elements that go along with truck stops and they are not compatible with neighborhoods. Archie Hood,765 S. 5t' Street, Honey Grove, owns 40 of the residential lots in Parc Ouest spoke in opposition to the petition stating that it would be detrimental to the area. Mr. Hood drove around the loop and saw more properties that would not have a devaluing effect on residential areas. Planning and Zoning Meeting March 1, 2004 Page 3 Delora Redus, has lived at 34" Street SW for about 50 years and they have been trying to get desirable things in the area. West Paris is low on crime and it is a quiet neighborhood. There are a lot more businesses that are desirable could go in the area. Ms. Redus said she just sold an acre lot Bonham Street last year and she would not have dared to sell it for a truck stop. Melissa Huey, 107 Pare Ouest, spoke in opposition to the petition stating that they have worked a long time to make sure that their neighborhood is safe. Ms. Huey expressed concern about pollution— environment and lights. Ms. Huey has a 5 year old son that she is raising as a single parent— concerned about his safety. Chris Whitaker, 2415 Wildwood Lane, home builder in Paris and the Par Ouest Subdivision spoke in opposition to the petition stating that he and Archie Hood have been in a partnership position with the bank in Honey Grove trying to stimulate home buying in the Pare Ouest Subdivision. There were certain stigmas attached to the subdivision to start with because of the restrictive nature at the outset and purpose that was trying to be achieved in Pare Ouest. Mr. Whitaker stated that in his opinion — property values in Pare Ouest would decline. 3. Consideration of and action on the petition of Cindy Gates for a change in zoning from an Agricultural District (A) to a Commercial District (C), With Specific Use Permit (49) Auto Fuel Sales, Lot 3, City Block 328, being the 3800 Block of SW Loop 286. Motion was made to deny the petition by Russell McCain and seconded by Bobby Myers. Motion carried by a vote of 6 ayes and 0 nays. Motion was made by Russell McCain seconded by Bobby Myers to excuse Louis Yates. Motion carried by a vote of 5 ayes and 0 nays. Planning and Zoning Meeting March 1, 2004 Page 4 4. Consideration of and action on the Replat, Lots 5, 6, and 8, Stone Ridge, Phase 1. Motion was made to approve the replat by Marshall Kent seconded by Bobby Myers, subject to the City Engineer's Memo dated February 27, 2004. Motion carried by a vote of 5 ayes and 0 nays. 5. Consideration of and action on the Final Plat, Cadillac Place Subdivision. Motion was made to approve the final plat by Bobby Myers seconded by Marshall Kent, subj ect to the City Engineer's Memo dated February 27, 2004. Motion carried by a vote of 5 ayes and 0 nays. 6. Consideration of and action on the Final Plat, House Addition (CB 218- A), being the 1300 Block of West Austin. Motion was made by Russell McCain seconded by Marshall Kent to approve the final plat but deny the variance on curb and gutter, subject to the City Engineer's Memo dated February 27, 2004. Motion carried by a vote of 5 ayes and 0 nays. Meeting adjourned at 6:30 p.m.
