09/07/2004 MINUTESMINUTES OF THE REGULAR MEETING OF THE PLANNING AND ZONING COMMISSION SEPTEMBER 7, 2004 The Planning and Zoning Commission met Tuesday, September 7,2004,5:30 P.M., Love Civic Center, 2025 S. Collegiate, Paris, Texas with the following members present: 1. Benny Plata 5. Marshall Kent 2. Brad Archer 6. Barbara Forrest 3. Russell McCain 7. Carl Lucas (arrived at 5:35 p.m.) 4. Reeves Hayter Lisa Wright, the Director of Community Development was also present. 1. The meeting was called to order by Reeves Hayter. 2. The minutes from the (August 2, 2004) meeting were approved with a motion by Brad Archer, seconded by Marshall Kent. Motion carried by a vote of 6 ayes and 0 nays. 3. Public Hearing to consider the petition of Richard Hardison for a change in zoning from a Two - Family Dwelling District (2F) to a Multiple - Family Dwelling District No. 1 (MF -1) on Lot 5, City Block 112 -B, being located at 521 12th Street SE. Carl Lucas arrived at 5:35 p.m. This item was tabled at the August 2, 2004, meeting. Motion made to bring from the table by Russell McCain, seconded by Carl Lucas. Motion carried by a vote of 7 ayes and 0 nays. The public hearing was declared open. There was no one present to speak in favor of the petition. Planning and Zoning Minutes September 8, 2004 Page 2 Lee Dillard, Sr., 505 12th Street SE, spoke in opposition to the petition stating that the house needs to be torn down but he thought the purchaser would put up another house. Mr. Dillard stated that he did not receive a letter regarding the proposed zoning change. There was no further opposition, the public hearing was declared closed. 4. Consideration of and action on the petition of Richard Hardison for a change in zoning from a Two - Family Dwelling District (2F) to a Multiple - Family Dwelling District No. 1 (MF -1) on Lot 5, City Block 112 -B, being located at 521 12th Street SE. Motion was made to deny the petition by Russell McCain, seconded by Carl Lucas. Motion carried by a vote of 7 ayes and 0 nays. 5. Public Hearing to consider the petition of the Historic Preservation Commission for a change in zoning to include a Historic Overlay District No. 9 (HD) on the North Part of Lot 1, City Block 154, being located at 625 Washington Street. The public hearing was declared open. Arvin Starrett, Chairman of the Historic Preservation Commission, stated that this is the Old County Hospital, owned by Agape House. Historic Preservation Commission met with the board of the Agape House and looked over their plans and approved a certificate of appropriateness. The Agape House Board agrees with the historic designation. 6. Consideration of and action on the petition of the Historic Preservation Commission for a change in zoning to include a Historic Overlay Planning and Zoning Minutes September 8, 2004 Page 3 District No. 9 (HD) on the North Part of Lot 1, City Block 154, being located at 625 Washington Street. Motion was made to approve as Historic Overlay District No. 9 by Benny Plata, seconded by Brad Archer. Motion carried by a vote of 7 ayes and 0 nays. 7. Public Hearing to consider the petition of the Historic Preservation Commission for a change in zoning to include a Historic Overlay District No. 10 (HD) on Part of Lot 1, City Block 127, being located at 1033 Bonham Street. The public hearing was declared open. Mr. Arvin Starrett, Chairman of the Historic Preservation Commission, stated that this is the only remaining building of the Old Sanitarium, Children's Hospital. Dr. Hayden has been in communication with Coca Cola Bottling Company. He wants to use the structure for a medical museum of Lamar County. There was no opposition, the public hearing was declared closed. 8. Consideration of and action on the petition of the Historic Preservation Commission for a change in zoning to include a Historic Overlay District No. 10 (HD) on Part of Lot 1, City Block 127, being located at 1033 Bonham Street. Motion was made to approve as Historic Overlay District No. 9 by Carl Lucas, seconded by Brad Archer. Motion carried by a vote of 6 ayes and 1 nay, Benny Plata. 9. Public Hearing to consider the petition of the Historic Preservation Commission for a change in zoning to include a Historic Overlay District No. 11 (HD) on Lot 2, City Block 79, being located at 744 3rd Street NW. Bill Buford, owner of the property, stated that this house was placed on the historical register in 1988 and they are in the process of restoring it and would like to be included in the historic overlay. Mr. Arvin Starrett, Chairman of the Historic Preservation Commission, stated that the Commission concurs with the Bufords. There was no opposition present, the public hearing was declared closed. 10. Consideration of and action on the petition of the Historic Preservation Commission for a change in zoning to include a Historic Overlay District No. 11 (HD) on Lot 2, City Block 79, being located at 744 3rd Street NW. Motion was made to approve as Historic Overlay District No. 9 by Brad Archer, seconded by Russell McCain. Motion carried by a vote of 7 ayes and 0 nays. 11. Public Hearing to consider the petition of the Historic Preservation Commission for a change in zoning to include a Historic Overlay District No. 12 (HD) on Lot 15A, City Block 204, being located at 2006 Bonham Street. The public hearing was declared open. Bill Buford, a friend of Butch Hunt, stated that this house is also on the Historic Register and he wants it included in the historic overlay. Arvin Starrett stated that this is a Prairie style home and he received a letter from Mr. Hunt requesting the overlay designation. Consideration of and action on the petition of the Historic Preservation Commission for a change in zoning to include a Historic Overlay District No. 12 (HD) on Lot 15A, City Block 204, being located at 2006 Bonham Street. Motion was made to approve as Historic Overlay District No. 9 by Benny Plata, seconded by Marshall Kent. Motion carried by a vote of 7 ayes and 0 nays. 13. Consideration of and action on the Preliminary Plat of Lots 1 and 2, Block A, of the Tractor Supply Addition, being located at 2035 Spur 139. Motion was made to approve the Preliminary Plat by Benny Plata, seconded by Marshall Kent, subject to the City Engineer's Memo dated, September 2, 2004. Motion carried by a vote of 7 ayes and 0 nays. 14. Consideration of and action on the Preliminary Plat of Meadow Park Addition, Phase 3. Motion was made to approve the Preliminary Plat by Carl Lucas, seconded by Benny Plata, subject to the City Engineer's Memo dated, September 3, 2004. Motion carried by a vote of 7 ayes and 0 nays.
