JANUARY 3, 2005
The Planning and Zoning Commission met Monday, January 3,2005,5:30,
Lamar County Fairgrounds, Westside Building, 570 E. Center Street,
Paris, Texas with the following members present:

Lisa Wright, the Director of Community Development, was also present.
1. The meeting was called to order by Reeves Hayter at 5:30 p.m.
2. The minutes from the December 6, 2004 and December 13, 2004,
meeting were approved with a motion by Bobby Myers, seconded by
Carl Lucas. Motion carried by a vote of 8 ayes and 0 nays.
3. Public Hearing to consider the petition of Brad Drake for a change in
zoning from a Commercial District (C) to a Light Industrial District
(LI) on Lot 27 -A, City Block 251, being located at 205 Loop 286 NW.
The public hearing was declared open.
There was no one present to speak in favor of the petition.
Irvin Simpson, 825 30th Street NE, stated that the only concern is
drainage. Triple A's parking lot drains onto his property, but it was
determined that Mr. Simpson's property is on the opposite side of the
Loop from this, so this is not an issue. Mr. Simpson stated he did not
have an opposition, then.
There was no opposition, the public hearing was declared closed.

4. Consideration of and action on the petition of Brad Drake for a
change in zoning from a Commercial District (C) to a Light Industrial
District (LI) on Lot 27 -A, City Block 251, being located at 205 Loop
286 NW.
Motion was made to table the petition by Bobby Myers, seconded by
Cleveland Thomas. Motion carried by a vote of 8 ayes and 0 nays.
5. Public Hearing to consider the petition of Mitizi Rader for a change
in zoning from an Agriculture District (A) to a One - Family Dwelling
District No. 2 (SF -2) on Part of the Wesley Askins Survey and
Mathias Click Survey, being located south of FM 195 and west of
36th Street NE.
The public hearing was declared open.
There was no one present to speak in favor of the petition.
Richard Grossnickle,1815 34th Street NE, spoke in opposition to the
petition stating his concern of privacy and intensity of traffic. Also,
the litter on the street is bad. The property to the south was zoned
Commercial but the owner bulldozed all the trees. With the trees
down, the storage buildings could be clearly seen. He would like to
see the trees north of him not taken down. He is also concerned about
water drainage. He is not against progress.
Shannon Pastenak stated that traffic is bad through there and there
are small children in the area —where are the entrances and exits?
There was no further opposition, the public hearing was declared
closed.

6. Consideration of and action on the petition of Mitizi Rader for a
change in zoning from an Agriculture District (A) to a One - Family
Dwelling District No. 2 (SF -2) on Part of the Wesley Askins Survey
and Mathias Click Survey, being located south of FM 195 and west
of 36th Street NE.
Motion was made to table the petition by Carl Lucas, seconded by
Marshall Kent. Motion carried by a vote of 8 ayes and 0 nays.
7. Public Hearing to consider the petition of Lee Woodard for a change
in zoning from a Neighborhood Service District (NS) to a Commercial
District (C) on Lot 35 -B, City Block 249, being located at 3025
Clarksville Street.
The public hearing was declared open.
Lee Woodard, 710 Hogans Bluff, spoke in favor of the petition stating
that he did not realize that the property is zoned Neighborhood
Service —he would like Commercial zoning on the property for future
salability.
There was no opposition, the public hearing was declared closed.
8. Consideration of and action on the petition of Lee Woodard for a
change in zoning from a Neighborhood Service District (NS) to a
Commercial District (C) on Lot 35 -B, City Block 249, being located
at 3025 Clarksville Street.
Motion was made to approve by Benny Plata, seconded by Brad
Archer. Motion carried by a vote of 8 ayes and 0 nays.
9. Discussion of and possible action on recommending an amendment to
the Comprehensive Plan as it relates to that particular area located

south and east of Lake Crook Park, south and west of Campbell
Soup's spray field, and north of Highway 79, to include portions of
18th Street NW, 19th Street NW, and Butler Street.
This item was tabled at the December 6, 2004, meeting. Motion was
made by Bobby Myers to remove item from the table, seconded by
Cleveland Thomas. Motion failed with a vote of 4 ayes and 4 nays
(Benny Plata, Brad Archer, Reeves Hayter, Carl Lucas voting
against).
10. Consideration of and action on establishing a schedule for
amendments to the comprehensive plan.
Reeves Hayter stated that scheduling would take at least 3 months.
Plans were submitted by consultants several years ago. The
consultants indicated long -term future growth and the long term has
arrived. Mobile homes should be considered as well. Land use
should be planning, not zoning. On the right hand of the map, several
categories are listed. It should be studied and determined if that level
of land use planning is wanted. Zoning has more levels than shown
on the map. Reeves stated that this was thrown at the Commission
last month without the ability to plan for it.
Benny Plata asked if there should be a special meeting for this.
Reeves Hayter stated that it would be a regular meeting but open.
Carl Lucas stated that 3 meetings sounded reasonable. Reeves
Hayter stated that it might take 3 meetings to get into a position to
hear public input.
Carl Lucas stated that he would like categories defined. Reeves
Hayter stated that next month categories can be looked at on the side.
Also, areas needing changing can be looked at as well as mobile home
information from Lisa.

The following schedule was discussed: month 1 - recommend
revisions to the land use categories; month 2 - recommend revisions
to the map itself; month 3 - review manufactured home information
and make necessary recommendations.
Motion was made to adopt this schedule by Carl Lucas, seconded by
Benny Plata. Motion carried by a vote of 8 ayes and 0 nays.
11. Consideration of and action on the Preliminary Plat, Pecan Place,
Phase I.
Motion was made to deny by Carl Lucas, seconded by Benny Plata.
Motion carried by a vote of 8 ayes and 0 nays.
12. Consideration of and action on the Master Plat Pecan Place.
Reeves Hayter opposed the preliminary plat in addition to other
items. The 2 right angle curves represent a traffic hazard at 34th
Street NE and 36th Street NE.
Motion was made to deny by Benny Plata, seconded by Brad Archer.
Motion carried by a vote of 8 ayes and A. nays.
13. Consideration of and action on the Preliminary Plat on Lots 5 and 6,
Block A, of the Southwest Industrial Park #1, being located at 1810
Loop 286 SW.
Motion made to approve by Benny Plata, seconded by Bobby Myers,
subject to the City Engineer's Memo dated, January 3, 2005. Notion
carried by a vote of 8 ayes and 0 nays.
14. Consideration of and action on the Preliminary Plat on Lot 1, Block
A, of the Ting Addition, being located at 3920 Lamar Avenue.

Motion made to approve by Benny Plata, seconded by Bobby Myers,
subject to the City Engineer's Memo dated, January 3, 2005, and with
the owner's name corrected. Motion carried by a vote of 8 ayes and
0 nays.
15. Consideration of and action on the Final Plat of Lots 10, 11, and 12-
A, City Block 176, being located at 451 3rd Street SW.
The current zoning is Central Area (CA) and the plat should reflect
that. It is okay to build residential in Central Area. Reeves Hayter
stated that if zoning was changed to Single Family 2 then the plat
would have to be denied because zoning has not been requested.
Motion was made to approve by Carl Lucas, seconded by Bobby
Myers, subject to the City Engineer's Memo dated, January 3, 2005,
and subject to revising the plat to reflect the current zoning. Motion
carried by a vote of 8 ayes and 0 nays.
