MINUTES REGULAR MEETING PLANNING AND ZONING COMMISSION CITY OF PARIS - CITY HALL COUNCIL CHAMBERS 107 E. KAUFMAN STREET PARIS, TEXAS MONDAY, APRIL 6, 2009 5:30 O'CLOCK P.M. 1. The regular meeting of the Planning and Zoning Commission on Monday, April 6, 2009, was called to order at 5:30 p.m. by Reeves Hayter. A. The following members were present: Reeves Hayter, Chairman Curtis Fendley, Vice - Chairman Bill Harris Richard Hunt, Secretary Brad Archer Benny Plata B. The following members were absent: Darin Manning C. Shawn Napier, City Engineer, was also present. 2. Approval of minutes from previous meetings. Motion to approve the minutes of the March 2, 2009, meeting was made by Curtis Fendley, seconded by Bill Harris. Motion carried 6 -0. 5. Public hearing to consider the petition of Lois Johnny Exum for a change in zoning from a Single- Family Dwelling District No. 2 (SF -2) to a Commercial District © on Lots 31-A and 35, City Block 205, being number 2085 Fitzhugh. Public hearing was declared open. A. The following individuals spoke in favor of the petition. Johnny Exum, 4560 Pine Mill Road, spoke in favor of the petition. Mr. Exum stated he wants to get the zoning changed in order to build a shop. B. There was no opposition. Public hearing was declared closed. No action taken on this item. ITEMS 3A AND 4 WERE COMBINED. Motion was made by Richard Hunt, seconded by Bill Harris to recuse Reeves Hayter. Motion carried 5 -0. 3. Public hearing to provide an opportunity to present comments and written evidence and consideration of and action on recommending to the City Council the adoption ofproposed amendments to the Future Land Use Plan Map as follows: A. That the, future land use recommended for the property located on a 6.5 acre tract being apart of the Enoch Crow Survey, Abstract No. 208, being located in the 4500 Block of Lamar Avenue, be changed from Low Density Residential to High Density Residential. 4. Public hearing to consider the petition of Paul Holden for a change in zoning from an Agricultural District (A) to a Planned Development District (PD -b) Housing Development or Community Unit Development on a 65 acre tract being a part of the Enoch Crow Survey, Abstract No. 208, located in the 4500 block of Lamar Avenue. Public hearing was declared open. A. The following individuals spoke in favor of the petition: Paul Holden, Wilhoit Properties, Inc. spoke in favor of the petition. Mr. Holden presented an aerial photo of the property. Mr. Holden stated there will be a bamboo screening around the property, as well as, a privacy fence along the east side of the property. He further stated this is not a government housing project, they will accept Housing Tax Credits/ Charles Waldron, Attorney for Paul Holden, spoke in favor of the petition. A. W. Clem, Attorney for the Chambliss Family, spoke in favor of the petition. B. The following individuals spoke in opposition of the petition: Mary Wilson, 4245 Sunrise Dr., spoke in opposition to the petition. Leslie Collard, 4215 Sunrise Dr., spoke in opposition to the petition. People cutting through from apartments to Wal -Mart. James Chennault, 4220 Sunrise Dr., spoke in opposition to the petition. James Brown, 4530 Thomas Dr., spoke in opposition to the petition. Public hearing was declared closed. Motion made by Richard Hunt, seconded by Benny Plata to approve the changes to the Future Land Use Map. Motion carried 5 -0. No action taken on item 4. 6. Public hearing to consider the petition of Jeff Martin for a change in zoning from a Planned Development District (PDa:)g Retail Shopping Center or Once Center to a General Retail District (GR) on Lots part of 9 and 9A, City Block 331, being located in the 3700 block- of Bonham Street. Public hearing declared open. The following individuals spoke in favor of the petition: A. Jeff Martin, 3410 Darnell Dr., spoke in favor to the petition. Building a Subway restaurant with concrete parking with curb and gutter. Robert Howard, owner of property located on Hwy. 82, emailed letter in favor of the petition. B. No one spoke in opposition. Public hearing was declared closed. No action taken on this item. 7. Consideration ofand action on the Preliminary Plat of Lots 1 and 2, Block A, William deG Hayden 312 Addition, being number 930 Cardinal Lane. Motion was made by Richard Hunt, seconded by Bill Harris to approve the plat. Motion carried 5 -0. 8. Consideration of and action on the Final Plat of Lots I and 2, Block A, William deG Hayden 312 Addition, being number 930 Cardinal Lane. Motion was made by Richard Hunt, seconded by Bill Harris to approve the plat. Motion carried 5 -0. Motion was made by Bill Harris, seconded by Benny Plata to return Reeves Hayter to the meeting. Motion carried 5 -0. 9. Consideration of and action on the Preliminary Plat of Lot 1, Block A, the Temple of Deliverance Church Addition — CB53, being located in the 500 Block of Graham. Motion was made by Curtis Fendley, seconded by Benny Plata, to approve the plat subject to the City Engineer's recommendations. Motion carried 6 -0. 10. Consideration of and action on the Preliminary Plat of Lots 14 and 17, Stone Ridge Phase 6. Motion was made by Bill Harris, seconded by Richard Hunt, to approve the plat subject to the City Engineer's recommendations. Motion carried 6 -0. 11.
