05/04/2009 MINUTESMINUTES SPECIAL MEETING PLANNING AND ZONING COMMISSION CITY OF PARIS - CITY HALL OLD COUNCIL CHAMBERS 135 S.E. 1ST STREET PARIS, TEXAS MONDAY, MAY 4, 2009 5:30 O'CLOCK P.M. 1. The regular meeting of the Planning and Zoning Commission on Monday, May 4, 2009, was called to order at 5:30 p.m. by Curtis Fendley, Vice - Chairman. A. The following members were present: Curtis Fendley, Bill Harris Richard Hunt Benny Plata Bee Garmon Keith Barnett B. The following members were absent: Darin Manning C. Shawn Napier, City Engineer and Jeanna Scott, Administrative Assistant was also present. 2. Election of officers for the upcoming year: A. Chairman — Motion was made by Richard Hunt, seconded by Bill Harris to appoint Curtis Fendley as Chairman. Motion carried 5 -0 with 1 abstain. B. Vice - Chairman — Motion was made by Benny Plata, seconded by Richard Hunt to appoint Bill Harris as Vice - Chairman. Motion carried 5 -0 with 1 abstain. C. Secretary — Motion was made by Bill Harris, seconded by Benny Plata to appoint Richard Hunt as Secretary. Motion carried 5 -0 with 1 abstain. 3. Approval of minutes. from. previous meeting. (April 6, 2009 and April 13, 2009) Motion was made by Bill Harris, seconded by Benny Plata to approve the minutes for the April 6, 2009 and April 13, 2009 meetings. Motion carried 6 -0. 4. Public hearing and consideration of and action on the Site Plan of Lot 9, City Block 258, being number 625 25`h Street N.E. Public hearing was declared open. The following individuals spoke in favor of the petition. Roger Yosten, 1225 Mockingbird, owner, Mr. Yosten stated he is proposing four duplex apartments with two in each building. There was opposition. The following concerned citizens had questions regarding the petition: Tony Rhoads, 2450 Highland Rd., Mr. Rhoads stated he was concerned about drainage and will there be a fence. Alex Kozel, adjacent property owner, Mr. Kozel asked are they meeting the required setbacks? Shawn Napier stated the site plan will verify set back lines. Charles Worston, property owner, Mr. Worston asked about the gravel road that goes to the water tower and will the City close this road? Shawn Napier advised Mr. Worston that he would need a permit to access the private road. Mr. Worston further stated he was concerned about the drainage on the property. Public hearing was declared closed. Bill Harris asked are the drainage issues going to be addressed. Shawn Napier stated they will quote state law regarding the drainage. Motion was made by Bill Harris, seconded by Bee Garman to approve the site plan, subject to the City Engineers recommendations. Motion carried 6 -0. 5. Consideration of and action on the Master Plat of Lot I and 2, Block A, Enns Addition, being number 2975 FM 79. Motion was made by Benny Plata, seconded by Bill Harris to approve the Master Plat, subject to the City Engineer's recommendations. Motion carried 6 -0. 6. Consideration of and action on the Preliminary Plat of Lot I and 2, Block A, Elms Addition, being number 2975 FM 79. Motion was made by Bill Harris, seconded by Benny Plata to approve the Preliminary Plat, subject to the City Engineer's recommendations. Motion carried 6 -0. 7. Consideration of and action on the Preliminary Plat of Lot 1, Block A, Martin Addition 331, being number 3720 Bonham. Motion was made by Bill Harris, seconded by Richard Hunt to approve the Preliminary Plat, subject to the City Engineer's recommendations. Motion carried 6 -0. 8. Consideration of and action on the Preliminary Plat of Lot 1, Block A, Paris Towne Center 287 Addition, being number 3552 Lamar Avenue. Shawn Napier stated that Oncor is requesting additional easements along the side and back of the property. Motion was made by Richard Hunt, seconded by Bill Harris to approve the Preliminary Plat, subject to the City Engineer's recommendations and with the additional easements requested by Oncor. Motion carried 6 -0. 9. Consideration of and action on the Final Plat of Lot 1, Block A, Paris Towne Center 287 Addition, being number 3552 Lamar Avenue. Motion was made by Richard Hunt, seconded by Bee Gannon to approve the Final Plat, subject to the City Engineer's recommendations and with the additional easements requested by Oncor. Motion carried 6 -0. 10. Deliberate on an ordinance prohibiting the installation of mobile homes within the city and requiring a permit for the construction of, addition to or extension of a HUD -code manufactured home park (formerly called a mobile home park) and requiring a license to operate a HUD code manufactured home park and setting forth the site requirements, HUD code manufactured home park standards and other prerequisites to the issuance of a permit or license, providing definitions, and prescribing regulations for management of HUD -code manufactured home parks and providing fees, and containing penalties for the violation of this ordinance and containing a severability clause. Commissioners reviewed and discussed draft ordinance. Commissioners schedule a meeting for the sub - committee to review the ordinance. Bee Gannon was added to the sub - committee. The commissioners directed the sub - committee to review the ordinance and bring back the draft at the June 1, 2009 meeting. 11. Meeting adjourned at 6:26 p.m. APPROVED THIS 1 ST DAY OF JUNE, 20�
