11/02/2009 MINUTESMINUTES REGULAR MEETING PLANNING AND ZONING COMMISSION CITY OF PARIS - CITY HALL COUNCIL CHAMBERS 107 E. KAUFMAN STREET PARIS, TEXAS MONDAY, NOVEMBER 2, 2009 5:30 O'CLOCK P.M. The regular meeting of the Planning and Zoning Commission on Monday, November 2, 2009, was called to order at 5:30 p.m. by Curtis Fendley, Chairman. A. The following members were present: Curtis Fendley, Chairman Bee Gannon Darin Manning Richard Hunt Benny Plata B. The following members were absent: Bill Harris Keith Barnett C. Jeanna Scott, Administrative Assistant was also present. 2. Approval of minutes from previous meeting. (October 5, 2009) Motion was made by Bill Harris, seconded by Darin Manning to approve the minutes for the October 5, 2009 meeting. Motion carried 5 -0. Public hearing and consideration of and action on the petition of Southwest LTC, Ltd for a change in zoning from an Agricultural District (A) to a One - Family Dwelling District No. 2 (SF -2) with a Specific Use Permit (20) Hospital, Convalescent Home, Residence Home for the aged on a 48.07 tract of land being a part of the Joshua Moore Headright Survey, Abstract No. 571, being located in the 100 Block of 47th Street S.E. Public hearing was declared open. The following individual spoke in favor of the petition. Mark Hesse, Southwest LLC, spoke favor of the petition. Mr. Hesse stated he was there to answer any questions the commissioners may have. No opposition present. Curtis Fendley asked the audience if anyone had comments. The following individuals spoke. Paul Wells, 365 42nd Street S.E., Mr. Wells stated he had concerns about drainage in Morningside. Do to the amount of new development in the area the drainage problems have gotten worse with the water coming down off the hill and in to the yards of the neighborhood. Mr. Wells further stated he has had to correct a lot of erosion that is occurring in his yard. The City needs to address the drainage plan for the new construction to make sure it will not make this problem worse. James Finney, 415 42nd Street S.E., Mr. Finney stated he is concerned over the drainage problems. Mr. Finney presented pictures to the Commissioners showing his flooded back yard. Tom Gray, 345 42nd Street S.E., Mr. Gray stated he was also concerned over the drainage problems. Water has gotten within eight to ten feet of his garage. Mr. Gray further stated that with the new development in the area it could cause the drainage problems to get worse. Mr. Gray also asked what the developers planned to do with the remaining acreage. Mr. Hesse, Southwest LLC, Mr. Hesse stated at this time they will only be developing the seven acres along 47th Street. They have no plans to develop the rest of the area. Julia Dodson, 115 481h Street S.E., Ms. Dodson stated she is concerned about the traffic on 47th Street. There is barely enough room for two cars to pass each other and several mail boxes have been ran over. Ms. Dodson further stated she is concerned about the increased traffic at the intersection of Highway 82 East and 47th Street. This is a dangerous road and the City should put up blinking lights to warn cars about turning traffic. Public hearing was declared closed. Motion was made by Benny Plata, seconded by Darin Manning to approve the zoning change. Motion carried 5 -0. 4. Consideration of and action on the Preliminary Plat of Lot 1, Block A, Ray's Place Addition CB 78, being number 601 North Main Street. Motion was made by Bee Garmon, seconded by Darin Manning to approve the Plat, subject to the City Engineer's recommendations. Motion carried 5 -0. 5. Consideration of and action on the Final Plat of Lot 1, Block A, Ray's Place Addition CB 78, being number 601 North Main Street. Motion was made by Richard Hunt, seconded by Benny Plata, to approve the Plat, subject to the City Engineer's recommendations. Motion carried 5 -0. 6. Meeting adjourned at 5:50 p.m. APPROVED THIS 7TH DAY OF DECEMBER, 2009.
