08/17/2009 MINUTESMINUTES SPECIAL.MEETING CITY OF PARIS BOARD OF ADJUSTMENT CITY OF PARIS - CITY HALL COUNCIL CHAMBERS 107 E. KAUFMAN STREET PARIS, TEXAS MONDAY, AUGUST 17, 2009 12:00 O'CLOCK P.M. 1. The Board of Adjustment meeting was called to order by Chairman Terry Christian at 12:00 p.m. A. The following members were present: Terry Christian, Chairman Chester Martindale Kyle McCarley Rick Hundley Allen Moore B. The following members were absent: David Glass C. Also present was Shawn Napier, Director of Engineering, Planning and Development; and Jeanna Scott, Administrative Assistant. 2. Approval of minutes from previous meetings. (June 9, 2009) Motion was made by Chester Martindale, seconded by Rick Hundley to approve the minutes for the June 9, 2009 meeting. Motion carried 5 -0. 3. Public hearing and consideration of and action on the petition of CEI Engineering Associates, Inc. (Kroger) to grant a variance of Zoning Ordinance No. 1710, Section 10 -1020 to reduce the required number of parking spaces from "one (1) space for each two hundred (200) square feet of floor area, " to one (1) space . for each two hundred eighty -five (2$5) square feet of floor area, on Lot 1, Block A, Kroger Addition, being number 1310 Clarksville Street. Public hearing was declared open. A. The following individuals spoke in favor of the petition. Jeremy Yee, CEI Engineering, spoke in favor of the petition. Mr. Yee stated Kroger is proposing adding a gas station to the current parking area. The gas station will consist of 3 aisles and a 117 square foot kiosk. They are doing this as an added service for their customers. Gerald representative with Kroger, 1331 Airport Freeway, Dallas, Texas, spoke in favor of the petition. Kroger is initiating customer first program, in doing this Kroger is adding gas station pumps to a lot of their locations. This will not be their sole business, but an added benefit for the customer. B. The following individuals spoke in opposition of the petition. Richard Eubanks, 345 12th Street S.E., spoke in opposition to the petition. Mr. Eubanks stated his property lines up with the front of the Kroger store. Mr. Eubanks is concerned about the additional traffic, noise and drainage that may occur. Public hearing was declared closed. Shawn Napier, Director of Engineering, Planning and Development stated Kroger had just turned in a variance request on the R.O.W. requirement. This will alter how many spaces they may need. The Council will hear the request on the second Monday of September. Motion was made by Chester Martindale, seconded by Rick Hundley to table this item until after the City Council renders a decision on the variance. Motion carried 5 -0. 4.
