1. The Board of Adjustment meeting was called to order by Chairman Terry Christian at
12:00 p.m.
A. The following members were present:
Terry Christian, Chairman
Chester Martindale
Kyle McCarley
Rick Hundley
Allen Moore
B. The following members were absent:
David Glass
C. Also present was Shawn Napier, Director of Engineering, Planning and
Development; Robert Talley, Code Enforcement Officer; and Jeanna Scott, Administrative
Assistant.
2. Approval of minutes from previous meetings. (August 17, 2009)
Motion was made by Kyle McCarley, seconded by Chester Martindale to approve the
minutes for the August 17, 2009 meeting. Motion carried 5 -0.
3. Public hearing and consideration of and action on the petition of Jose Herrera to grant a
variance of Zoning Ordinance No. 1710, Section 9- 602(5), to modify the required side yard
setback on a corner lot from 25' to 4', which would be a 21 'variance, on Lots 9, 10 and w
15' of 11, Block 5, S.J. Wright Addition, being number 1864 West Austin.
Public hearing was declared open.
A. The following individuals spoke in favor of the petition.
Jose Herrera, 1864 West Austin, spoke in favor of the petition. Mr. Herrera stated
he wants to protect his property. He has had several problems with vandalism
where windows were broken out and trash was thrown in his yard. Robert Talley,
Code Enforcement Officer, represented petitioner. Mr. Talley stated he had
helped Mr. Herrera with the variance request. Mr. Talley further stated that this
home was on the demolish list and Mr. Herrera has repaired and restored the home.
B. There was no opposition.
Public hearing was declared closed.
Motion was made by Rick Hundley, seconded by Chester Martindale to approve
the variance. Motion carried 5 -0.
4. Meeting adjourned at 12:18 pm.
