The Board of Adjustment meeting was called to order by Chairman Terry Christian at
12:00 p.m.
A. The following members were present:
Terry Christian, Chairman
Chester Martindale
Kyle McCarley
Rick Hundley
B. The following members were absent:
David Glass
Allen Moore
C. Also present was Jeanna Scott, City Staff.
2. Approval of minutes, from previous meetings. (September 1, 2009)
Motion was made by Chester Martindale, seconded by Kyle McCarley to approve the
minutes for the September 1, 2009 meeting. Motion carried 4 -0.
3. Public hearing and consideration of and action on the petition of Ronnie Seeliger to grant
a variance ofZoning Ordinance No. 1710, Section 9 -501, to modify the required front_yard
setback from 25' to 22 ; which would be a 3' variance, on Lot 3, Block P, Oak Creek
Addition, being number 1730 North Collegiate Drive.
Public hearing was declared open.
A. The following individuals spoke in favor of the petition.
Ronnie Seeliger, 1730 North Collegiate, spoke in favor of the petition.
B. There was no opposition.
Public hearing was declared closed.
Commissioners discussed petition. Motion was made by Kyle McCarley, seconded by
Chester Martindale to approve the variance. Motion carried 4 -0.
4. Public hearing and consideration of and action on the petition of Kroger to grant a
variance of CEI Engineering, Inc. (Kroger) to grant a variance of Zoning Ordinance No.
1710, Section 10 -1020 to reduce the required number of parking spaces f -om "one (1)
space.for each two hundred (200) square feet of floor area, " to one (1) space for each two
hundred sixty -nine (269) square feet of floor area, on Lot 1, Block- A, Kroger Addition,
being number 1310 Clarksville Street.
Public hearing was declared open.
CEI Engineering, Inc., representing Kroger spoke in favor of the petition.
No one spoke in opposition.
Public hearing was declared closed.
Motion was made by Chester Martindale, seconded by Rick Hundley to approve the
variance. Motion carried 4 -0.
5. Meeting adjourned at 12:15 pm.
