12/15/2016 MINUTESMINUTES SPECIAL MEETING CITY OF PARIS BOARD OF ADJUSTMENT CITY OF PARIS - CITY HALL COUNCIL CHAMBERS CONFERENCE ROOM PARIS, TEXAS THURSDAY, DECEMBER 15, 2016 12:00 O'CLOCK P.M. The Board of Adjustment meeting was called to order by David Hamilton, Chairman at 12:05 p. m. A. The following members were present: David Hamilton, Marilyn Smith, Louise Hagood and Jerry Haning B. The following members were absent: Deanna Manning C. Also present was Carla Easton, City Engineer; Ashley Fendley, City Staff; Stephanie Harris, City Attorney; Sue Lancaster, City Council. 2. Approval of minutes from previous meetings. (June 21, 2016) Motion was made by Marilyn Smith, seconded by Louise Hagood to approve minutes for the June 21, 2016 meeting. Motion carried 4 -0. 3. Public hearing and consideration of and action on the petition of Sign Installation Group, LLC on behalf of Gary Callaway on Lot 10 & 11, City Block 250, being located at 2350 North Main Street. A. Section 28 -4 (b) (2) of the Sign Ordinance which provides that "The sign area of detached signs shall be limited to one and one -half (I %) square feet per front foot of property upon which the same is placed. If the property on which the sign is located has multiple right -of -way frontages, each street frontage shall be counted for purposes of determining detached sign area. A property shall be permitted more than one (1) detached sign, provided no sign shall exceed three hundred (300) square feet in sign area. " The applicant has proposed 311 square feet of detached signage. The maximum allowed per sign ordinance is 300 square feet. The applicant is asking for an additional 11 square foot variance of detached signage. B. Section 28 -4 (b)(3) of the Sign Ordinance which provides that "Detached signs shall not exceed thirty (30) feet in height above the highest adjacent roadway surface. " The applicant has proposed the sign height to be 80 feet. The maximum allowed for the sign height is 30 feet. The applicant is asking for an additional 50 foot variance on the height of the sign. Public hearing was declared open. A. One individual spoke in favor of the petition. Pauline Wright, Fate, Texas, spoke in favor of the petition. Ms. Wright stated that item 3A regarding the sign area is not over the allowable if you do not include the free space around the sign. Ms. Wright further stated that the reasoning behind asking for a 50 foot variance on the sign height is to see the sign over the north interpass. Ms. Wright stated they are open to the idea of requesting a smaller sign height but would prefer the 80 foot sign. Ms. Wright further stated she hopes the board will approve the variances. B. No one spoke in opposition of the petition. Public hearing was declared closed. Motion was made by Louise Hagood failed due to the lack of a second to deny the variance request for item 3A. Motion was made by Jerry Haning, seconded by Marilyn Smith to approve the variance request for item 3A. Vote was 3 -1, in favor with Louise Hagood in opposition. Motion failed due to Zoning Ordinance Section 16 -300 Actions of the Board Item b. that states "The concurring vote of four (4) members of the board shall be necessary to revise any order, requirement, decision or determination of any such administrative official, or to decide in favor of the applicant on any matter upon which it is required to pass under this ordinance or to affect any variance in said ordinance. Motion was made by Louise Hagood, seconded by David Hamilton to deny the variance request for item 3B. Motion carried 4 -0. 4. Meeting adjourned at 12:20 p.m. APPROVED THE 5' DAY OF JANUARY
