01/05/2017 MINUTESMINUTES SPECIAL MEETING CITY OF PARIS BOARD OF ADJUSTMENT CITY OF PARIS - CITY HALL COUNCIL CHAMBERS CONFERENCE ROOM PARIS, TEXAS THURSDAY, JANUARY 5, 2017 12:00 O'CLOCK P.M. The Board of Adjustment meeting was called to order by David Hamilton, Chairman at 12: 00 p. m. A. The following members were present: David Hamilton, Marilyn Smith, Louise Hagood and Jerry Haning B. The following members were absent: Deanna Manning C. Also present was Carla Easton, City Engineer; Ashley Fendley, City Staff; Stephanie Harris, City Attorney; Sue Lancaster, City Council. 2. Approval of minutes from previous meetings. (December 1 S, 2016) Motion was made by Louise Hagood, seconded by Marilyn Smith to approve minutes for the December 15, 2016 meeting, with corrections. Motion carried 4 -0. 3. Public hearing and consideration of and action on the petition of Michael and Kenda Pickering on Lot 1, Block A, of the MK Properties Addition CB 286 being located at the corner of E. Price and 27`h Street N.E. A. Section 9 -501 (2) of the Zoning Ordinance which provides that "The minimum frontage setback for a commercial development in a General Retail District (GR) is 20 feet. " The applicant is asking for a 13 foot setback, which is a 7 foot variance. Public hearing was declared open. Carla Easton, City Engineer reviewed the variance request with the board members. A. One individual spoke in favor of the petition. Michael Pickering, Paris, Texas, spoke in favor of the petition. Mr. Pickering stated he is requesting the 7 foot variance due to an existing sewer line on the east side of the proposed building site. Mr. Pickering stated that this shift in the building would not create any issues at the corner of E. Price and 27" Street N.E. Mr. Pickering further stated he hopes the board will approve this variance so that he can move forward with his development. B. No one spoke in opposition of the petition. Public hearing was declared closed. Motion was made by Jerry Haning, seconded by Louise Hagood to approve the variance request for item 3A. Motion carried 4 -0. 4. Public hearing and consideration of and action on the petition of Michael Rhodes on Lot 11A, City Block 257B, being located at 2531 Pine Bluff Street. A. Section 9 -102 (1) of the Zoning Ordinance which provides that "The minimum lot area for a residential home in Single Family Dwelling District No. 2 (SF -2) be 7,500 square feet. " The applicant is proposing to subdivide the existing lot into two lots having 5,824 Square Feet to 5,824 Square Feet respectively. A variance for 1, 676 Square Feet is requested for the lots. B. Section 9- 301(1) of the Zoning Ordinance which provides that "The minimum lot depth for a residential home in Single Family Dwelling District No. 2 (SF -2) be 100 feet deep. " The applicant's property is 91 feet deep. The applicant is asking for a 9 foot variance for the lot depth. Proposed lots would be 91 feet deep. Public hearing was declared open. Carla Easton, City Engineer reviewed the variance request with the board members. A. Three individuals spoke in favor of the petition. Wendell Moore, Paris, Texas, spoke in favor of the petition. Mr. Moore stated he is the surveyor on this project. Mr. Moore stated that the applicant has hired him to plat the property into two lots. Mr. Moore stated that the applicant is proposing to construct two homes on these lots. Mr. Moore further stated he wishes the board would approve these variance requests. Gary Brown, Paris, Texas, spoke in favor of the petition. Mr. Brown stated that this project would be great and would enhance the neighborhood. Mr. Brown further stated that he believes the board should approve the variance requests. John Saunders, Paris, Texas, spoke in favor of the petition. Mr. Saunders stated he would be the contractor on the job. Mr. Saunders further stated Mr. Rhodes wants to build two homes that would match the house across the street. Mr. Saunders further stated this would be a good development in this neighborhood and hopes the board approves the request. B. No one spoke in opposition of the petition. Public hearing was declared closed. Motion was made by Jerry Haning, seconded by Marilyn Smith to approve the variance request for item 4A. Vote was 3 -1, in favor with Louise Hagood in opposition. Motion failed due to Zoning Ordinance Section 16 -300 Actions of the Board Item b. that states "The concurring vote of four (4) members of the board shall be necessary to revise any order, requirement, decision or determination of any such administrative official, or to decide in favor of the applicant on any matter upon which it is required to pass under this ordinance or to affect any variance in said ordinance. Motion was made by Marilyn Smith, seconded by Jerry Haning to approve the variance request for item 4B. Vote was 3 -1, in favor with Louise Hagood in opposition.
