2005-032-ORD AMENDING SECTION 34-23 (c) OF CODE OF ORDINANCES TO ADJUST SURCHARGES APPLICABLE TO WASTEWATER DISCHARGES ORDINANCE NO. 2005-032 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS, AMENDING SECTION 34-23 (c) OF THE CODE OF ORDINANCES OF THE CITY OF PARIS TO ADJUST SURCHARGES APPLICABLE TO WASTEWATER DISCHARGES WHICH EXCEED ACCEPTABLE LIMITS, IN ACCORDANCE WITH THE CITY'S RECENT RATE STUDY, AND TO OMIT CERTAIN OBSOLETE LANGUAGE REGARDING CALCULATION OF RATES; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE DATE. WHEREAS, in accordance with state and federal regulations, the City of Paris as a publicly owned treatment works is required to treat municipal sewerage as well as sewerage from other sources whose strength exceeds the ordinary or permissible limits for municipal sewerage; and, WHEREAS, additional costs are incurred by the City in treating such excessive strength sewerage; and, WHEREAS, in conformance with state and federal regulations, the City assesses a surcharge which is charged the generator of such excessive strength sewerage to defray the additional cost incurred by the City in treating such excessive strength sewerage, such surcharge being based on the strength of biochemical oxygen demand (BOD), total suspended solids (TSS), and anunonia (NHJ); and, WHEREAS, the City has not adjusted its excessive strength surcharge rate since 1999; and, WHEREAS, the City has recently conducted a rate study based on the City's cost of treating such waste, and said rate study supports implementation of increased excessive strength surcharge rates to adequately and accurately compensate the City for its cost in treating such waste; and, WHEREAS, the City Council desires to increase such surcharge rates to accurately reflect the cost incurred by the City in such treatment; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS: Section 1. That the findings set out in the preamble to this ordinance are hereby in all things approved. Section 2. That Section 34-23 (c) of the Code of Ordinances ofthe City of Paris, the same being "Sewer rates - For customers using city water", shall be and is hereby in all things amended to increase the excessive strength sewer charge rate stated therein and to omit certain language no longer applicable to the City's method of determining such surcharge rates, such amended Section 34-23 (c) to read as follows: "Sec. 34-23 Sewer rates - For customers using city water. * * * (c) Users desiring to discharge sewage into the City's sewerage system, the strength of which sewage exceeds two hundred fifty (250) parts per million biochemical oxygen demand (BOD), two hundred fifty (250) parts per million of total suspended solids, (TSS), or thirty (30) parts per million of anunonia (NH3), and which is acceptable under article III of this chapter, may do so upon written permission of the city and by paying a monthly treatment charge in the amount of seventy-eight cents ($0.78) per pound of biochemical oxygen demand (BOD) in excess of the allowable biochemical oxygen demand (BOD); forty-three cents ($0.43) per pound of total suspended solids (TSS) in excess of the allowable total suspended solids (TSS); and fifty cents ($0.50) per pound of anunonia (NH3) in excess of the allowable anunonia strength. The city shall make the necessary tests of the user's sewage strength to determine this charge. The charge prescribed by this subsection shall be in addition to the charges prescribed in subsection (a) hereof. " Section 3. The surcharge adjustments authorized herein shall be charged with the billing cycle beginning August 1,2005. Section 4. That this ordinance shall be effective on August 1, 2005.
