ORDINANCE NO. 2005-006
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS,
TEXAS, AMENDING CHAPTER 14, ARTICLE II, DIVISION 2, SECTION
14-34 (a) OF THE CODE OF ORDINANCES OF THE CITY OF PARIS TO
INCREASE THE ANNUAL PERMIT FEE FOR FOOD ESTABLISHMENTS;
CREATING A NEW SUB-SECTION (b) THERETO ESTABLISHING A
PERMIT FEE FOR TEMPORARY FOOD ESTABLISHMENTS; REVISING
CURRENT SUB-SECTIONS (b) and (c) TO (c) AND (d); AMENDING
CHAPTER 14, ARTICLE II, DIVISION 3, SECTIONS 14-51 THROUGH 14-
55 OF THE CODE OF ORDINANCES OF THE CITY OF PARIS TO
PROVIDE FOR A FOOD HYGIENE CERTIFICATE RATHER THAN A
FOOD HYGIENE DECAL AND TO INCREASE THE ANNUAL FEE FOR
FOOD HYGIENE TRAINING; PROVIDING A REPEALER; MAKING
OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND
DECLARING AN EFFECTIVE DATE.
WHEREAS, Section 14-34 of Article II, Division 2 to Chapter14 of the Code of Ordinances
of the City of Paris provides for annual permit fees for the inspection offood establishments; and
WHEREAS, Article II, Division 3 to Chapter 14 ofthe Code of Ordinances of the City of
Paris provides for a fee for the issuance of an initial and annual decal related to food hygiene
training; and
WHEREAS, the City Council has determined the need to provide for the issuance of a food
hygiene certificate rather than a food hygiene decal and to increase the aforesaid fees and to add a
new fee for temporary food establishments to offset the additional costs incurred by the Paris Lamar
County Health Department in providing the services associated with the issuance of said permits and
the provision of said training; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS,
TEXAS;
Section 1. That the findings set out in the preamble to this ordinance are hereby in all things
approved.
Section 2. That Chapter 14, Article II, Division 2, Section 14-34 of the Code of Ordinances
of the City of Paris dealing with permitting fees for the inspection of food establishments within the
City, shall be and is hereby in all things amended to read as follows:
"Chapter 14. Food and Food Establishments.

"Division 2. PERMIT

"Section 14-34. Fee.
(a) The annual fee for each food establishment, other than for dairies, creameries,
and milk plants shall be as follows:
1-5 Employees: One-Hundred Fifty Dollars ($150.00)per year
6-9 Employees: Two-Hundred Dollars ($200.00)per year
Over 9 Employees: Two-Hundred Fifty Dollars ($250.00)per year"
(b) The permit fee for any temporary food establishment operating seven (7)
consecutive days or less shall be Fifty Dollars ($50.00) for one (I) to three (3) days
of operation, and Ten Dollars ($10.00) per day for each day thereafter, up to a total
of seven (7) days. Each subsequent period of operation shall require a separate
permit.
(c) Any time that re-testing is required due to the fact that "permittee has a
discrepancy," which is discovered by a regular inspection or a re-inspection, then a
fee equal to the permit fee will be charged for the re-inspection.
(d) Food establishments, the net earnings of which are used in whole for charity,
church funds, or public welfare, shall be exempt from payment of the fee prescribed
by this section, but shall be subject to all other provisions of this Article."
Section 3. That Chapter 14, Article II, Division 3, Sections 14-51 through 14-55 of the Code
of Ordinances of the City of Paris shall be and are hereby amended to read as follows:
"Chapter 14. Food and Food Establishments.

"Division 3. FOOD HYGIENE CERTIFICATE.

"Section 14-51. Certificate required.
It shall be unlawful for any person to operate a food establishment within the
City of Paris for more than thirty (30) days without holding a current Food Hygiene
Certificate.
"Section 14-52. Certificate application.
Each person, within thirty (30) days of becoming an operator of a food handling
establishment, shall file with the Paris-Lamar County Health Department a written
application for a Food Hygiene Certificate and shall satisfactorily complete a Food
Hygiene Training Course conducted by the Paris-Lamar County Health Department.
"Section 14-53. Food Hygiene Training Course.
The Paris-Lamar County Health Department shall conduct a food handlers'
training course, consisting of courses of instruction as prescribed by the director of
such health unit, including but not limited to sanitary food handling, state statutes and
city ordinances relating to food handling, food-borne disease, prevention of disease,
personal hygiene, good housekeeping practices, and other related information, such
course to be conducted monthly as needed.
"Section 14-54. Fee.
The initial and annual Food Hygiene Certificate fee shall be Twenty Dollars
($20.00).
"Section 14-55. Issuance of Certificate.
A Food Hygiene Certificate applied for under this division shall be issued by
the Paris-Lamar County Health Department initially upon the payment of the fee and
satisfactory completion of the food hygiene training course. Such Certificate may be
in the form of an identification card or other form as the Health Department shall
determine is appropriate. The Certificate may be renewed by the payment of the
annual fee for the two (2) years succeeding the initial issuance. After the expiration
of three (3) years, an application for a new Certificate must be processed which will
not be issued until the satisfactory completion of the Food Hygiene Training Course.
Sections 14-56 - 14-65. Reserved."
Section 4. That all ordinances or portions of ordinances in conflict with the terms and
provisions of this Ordinance shall be and are hereby in all things repealed to the extent of such
conflict.
Section 5. That this ordinance shall become effective the 1st day of March, 2005.
