07 - PRIVATE TAX RESALEItem No. 7 memorandum TO: Mayor & City Council FROM: John Godwin, City Manager SUBJECT: PRIVATE TAX RE -SALES DATE: April 18, 2017 BACKGROUND: Through a previously rarely used provision of state law, The Pounders Law Firm has arranged for the private sale of twenty -three tax delinquent properties that failed to get bids during previous public tax sales. STATUS OF ISSUE: The twenty -three trustee tax properties will be sold to multiple persons for a total of $10,539.50. This sale will move six properties from the city's care to private maintenance, and at the same time place them back on tax rolls. BUDGET: The city will receive unbudgeted revenue of $1,900. RECOMMENDATION: Approve Resolution Approving the Private Re -Sale of Multiple Tracts of Bid -Off Tax Foreclosed Properties. Draft RESOLUTION NO. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, APPROVING THE PRIVATE RE -SALE OF MULTIPLE TRACTS OF BID -OFF TAX FORECLOSED PROPERTIES TO ONE OR MORE BUYERS, AND AUTHORIZING THE MAYOR TO EXECUTE DEEDS WHEREAS, twenty -three tracts of real property (the "Trustee Properties ") were bid off to the City of Paris as Trustee for itself, Lamar County, Paris ISD and Paris Junior College at public tax sales conducted on July 3, 2007, January 6, 2015, February 2, 2016 and March 7, 2017; and WHEREAS, Texas Property Tax Code Section 34.05(i) provides that the Trustee Properties may be sold by private sale, at any price, in lieu of a public sale under Texas Property Tax Code Section 34.05(c) & (d), with the approval of all taxing units entitled to receive proceeds from the sale, being the City of Paris, Lamar County, Paris ISD and Paris Junior College; and WHEREAS, private offers to purchase several of the Trustee Properties have been received by the City of Paris (the "Private Sale "), and there are no competing offers to purchase the Trustee Properties as of this date; and WHEREAS, this conveyance is made for public purposes, including but not limited to (1) lessening the burden of government in caring for tax foreclosed properties bid -off to the City of Paris pursuant to tax warrant or order of sale in a delinquent tax suit, and (2) to return those properties to tax paying status; NOW, THEREFORE, BE IT RESOLVED AND ORDERED by the City Council of Paris, Texas, that: Section 1. Subject to the Private Sales also being approved by Lamar County, Paris ISD and Paris Junior College, and the receipt of the amounts bid for purchasing the Trustee properties, the Mayor is hereby authorized to execute a tax deed conveying the Trustee Properties to the Purchaser or designee. Any prior approval to re -sell any tract of the Trustee Property is hereby withdrawn. Section 3. That this conveyance is made for public purposes, including but not limited to (1) lessening the burden of government in caring for tax foreclosed properties bid -off to the City of Paris pursuant to tax warrant or order of sale in a delinquent tax suit, Resolution Approving Sale of Tax Foreclosed Properties, Page 2 of 3 and (2) to return those properties to tax paying status. Section 4. That the conveyances shall be made subject to, for a two year period, (1) the owner(s) keeping the property in a clean and well cared for state, and (2) the timely payment of ad valorem taxes on the property. Section 5. The proceeds of the Private Sales shall be distributed in accordance with the Texas Property Tax Code and the orders of the District Courts of Lamar County, Texas.
