04/18/2017 MINUTESMINUTES SPECIAL MEETING CITY OF PARIS BOARD OF ADJUSTMENT CITY OF PARIS - CITY HALL COUNCIL CHAMBERS CONFERENCE ROOM PARIS, TEXAS TUESDAY, APRIL 18, 2017 12:00 O'CLOCK P.M. The Board of'Adiustment meeting was called to order by David Hamilton, Chairman at 12:00 p. m. A. The following members were present: David Hamilton, Louise Hagood, Jerry Haning, Marilyn Smith and Mihir "Mark" Pankaj (Alternate Board Member) B. The following members were absent: Deanna Manning and Chris Fitzgerald (Alternate Board Member) C. Also present was Carla Easton, City Engineer; Ashley Fendley, City Staff, Stephanie Harris, City Attorney; Sue Lancaster, City Council; A.J. Hashmi, City Council and concerned citizens. Marilyn Smith arrived at 12:02pm. 2. Approval of minutes from previous meetings. (February 28, 2017) Motion was made by Louise Hagood, seconded by Jerry Haning to approve minutes for the February 28, 2017 meeting. Motion carried 5 -0. 3. Public hearing and consideration of and action on the petition of Arjumand Hashmi on Lots 4 & 4A, City Block 64B, being located at 605 Pine Bluff Street. A. Section 11.5 -3 (b) 0)(4) of the Fence Ordinance (b) Fence heights: (1) Front yard fence requirements. a. No fence shall be permitted in the front yard with the following exceptions: i. On lots zoned historic overlay district (HD) and in accordance with the design standards adopted by the historic preservation commission. ii. On lots in excess of two (2) acres in size which are used for single-family residential purposes. iii. On lots which are zoned and used for LI or HI purposes. The applicant is proposing to install a front yard fence at 605 Pine Bluff Street this property is not located in the historic overlay district, the lot does not exceed two (2) acres and is not zoned for industrial purposes. The applicant is requesting a variance to allow a front yard fence. B. Section 11.5 -3 (b)(1)(c) of the Fence Ordinance (h) Fence heights: (1) Front yard fence requirements. c. In residentially zoned areas, no fence over forty -two (42) inches in height above the average grade of the yard shall be permitted from the, fi-ow building line to the street right -of- -way line. The applicant is proposing to install a fifty -nine (59) inch front yard fence. The applicant is asking for a 17 inch variance in height. Public hearing was declared open. A. Two individuals spoke in favor of the petition. Arjumand Hashmi, 4510 FM 195, Paris, Texas, spoke in favor of the petition. Dr. Hashmi stated he wants to install a rod iron fence in the front of his three properties on Pine Bluff Street. Dr. Hashmi stated the fence is 50 inches with arrows on the top making it 59 inches tall. Dr. Hashmi stated he wants to have these fences installed for safety reason. Dr. Hashmi further stated that the property at 751 Pine Bluff Street had an existing front yard fence when he purchased the property. Dr. Hashmi stated he hopes they board will approve his variance request and to apply his comments to agenda item 4 and 5. Laurie Goodson, 739 Pine Bluff Street, Paris, Texas, spoke in favor of the petition. Mrs. Goodson stated that she hope the board will approve these variance requests for the three fences on Pine Bluff Street. Mrs. Goodson stated since the fence at 751 Pine Bluff Street came down people keep cutting across her front yard and coming up to her door asking for help. Mrs. Goodson stated she would feel safer at her home if the fence variances were approved and installed. B. No one spoke in opposition of the petition. Public hearing was declared closed. Motion was made by David Hamilton, seconded by Jerry Haning to approve the variance request item 3A. Motion carried 5 -0.
