04/17/2017 MINUTESMINUTES OF THE REGULAR MEETING OF THE BUILDING AND STANDARDS COMMISSION MONDAY, APRIL 17, 2017 3:30 P.M. 1. Johnny Norris called the Building and Standards Commission Meeting to order at 3:30 P.M. Roll was called. A. The following members were present: Matthew Allen Sally McEwin Johnny Norris Ben Vaughan Charles Richards Joseph Scott Ken Kohls B. Staff present: Robert Talley Thomas McMonigle Stephanie Harris Debra Burge C. Others present: William Freeman Manuel Darnell, Jr. Gary Waite, Attorney -at -Law 2. Approval of minutes from previous meetings. (March 20, 2017) Joseph Scott recommended approving the minutes, seconded by Sally McEwin. Motion carried unanimously. 7 -0 3. Public Hearing to consider presentations by City of Paris Code Inspectors and owner(s) and/or lien holder(s) of the below properties who have been given notice of a violation of Article III of Chapter 7 of the Code of Ordinances of the City of Paris, Paris, Texas, entitled "Substandard and Dangerous Buildings and Structures:" A. 2418 W. Kaufman; City Block 203, Lot 11 Owner: William Freeman, 286 Creekwood Dr., Sunnyvale TX 75182 B. C. Robert Talley stated owner is here. Holes in roof; sections of roof covering peeled off; missing and deteriorated wood. Underpinning curling under indicating beginning to sink. Shed has tree fallen onto it, inside shows half of roof is gone /collapsed. Robert Talley's recommendation: Declare nuisance; demo within 30 days, or city has right to do so. Owner: William Freeman, 286 Creekwood Dr., Sunnyvale TX. Would like to see if shed is reparable, and would like to repair house. The commission discussed the ability to repair the structure with the owner and possibility of demolishing the shed if it was not reparable. Motion made by Ben Vaughan, seconded by Joseph Scott to grant 90 days to repair or demo. Motion carried unanimously. 7 -0 406 SW 9th; City Block 131, Lot 4 Owner: Jason Johansen, 360 16th SW, Paris TX 75460 Robert Talley stated no contact with owner, but certified letter signed for. Missing and deteriorated wood along roof and on the south side and back; unsecure; roof beginning to sag; inside has extensive damage. Robert Talley's recommendation: Declare nuisance; demo within 30 days, or city has right to do so. The commission discussed the condition of the property and the structure. Johnny Norris, seconded by Sally McEwin to accept Robert's recommendation. Motion carried unanimously. 7 -0 988 W. Sherman; City Block 131, Lot 25 Owner: Manuel Darnell, Sr., 355 13th SW, Paris TX 75460 Robert Talley stated Items 3C., 3D., 3E., & 3F, and explained that the properties met the criteria of junk and rubbish ordinance #2017 -009, amending chapters 7 and 17 of the Code of Ordinances, passed and adopted on 03/27/2017. The owner of the property and his attorney were present. Each property was addressed separately. New ordinance was highlighted by Robert Talley, specifically the items included. Also discussed zoning ordinance and zoning map pointing out these properties are not located in a Heavy Industrial zone. This property is in a Light Industrial zone. Junk and rubbish included old truck bed, lumber, metal, concrete, piles of bricks, old metal tanks, screening/caging, galvanized pipe, compressor, tires, machinery parts, barrels, rubbish, litter, carpet, tarp, plastic pallets, part of a wood frame building. High grass and weeds, vines, trees all over lot growing up and around these items indicating they've been there a long time, not organized, not being maintained. Robert Talley's recommendation: Declare junk and rubbish a nuisance; remove all junk and rubbish from property within 30 days, or city has right to do so. Gary Waite, representing Mr. Darnell, stated that Mr. Darnell has owned the properties since 1990s, always with the same business. He discussed how it didn't always look this way. He said in the last 4 -5 years that the owner has had severe health problems, but wants to cooperate and get the junk cleaned up. He also discussed the history of the properties pertaining to code enforcement's involvement in filing cases in municipal and county court. The commission discussed the length of time needed to clean the property and also the current and previous cases filed against the owner in court. Motion was made by Johnny Norris, seconded by Ben Vaughan to extend 90 days to owner to clean up property, or back to BSC. Motion carried. 5 -2 Charles Richards and Joseph Scott voted nay stating they felt Mr. Darnell had been given ample time to clean up this property. D. 943 W. Sherman, City Block 133, Lot 3 Owner: Manuel Darnell, Sr., 355 1P SW, Paris TX 75460 Robert Talley stated this property is zoned multi - family, and that there is no specific -use permit on this or any of these properties. Mr. Talley discussed the high grass, weeds, brush, limbs, metal, wires, electrical boxes, trailers full of rubbish, lawn mower parts and car frames on the property. Robert Talley's recommendation: Declare junk and rubbish a nuisance, remove within 30 days, or city has right to do so. Mr. Waite stated at one point owner was told to get items onto a trailer and it would be OK. The commission discussed the property. Motion was made by Ken Kohls, seconded by Johnny Norris to extend 90 days to owner to clean up property, or back to BSC. Motion carried. 5 -2 Charles Richards and Joseph Scott voted nay stating they felt Mr. Darnell had been given ample time to clean up this property. E. 951 W. Sherman, City Block 133, Lot 2 Owner: Manuel Darnell, Sr., 355 13th SW, Paris TX 75460 Robert Talley stated this is the property directly beside Mr. Darnell's house. Mr. Talley described more trailers full of junk and rubbish, high grass and weeds around trailers and rubbish. Mr. Talley stated that it's not organized or sorted, and described tires, lumber, metal pipes, concrete and buckets were also scattered on the property. Robert Talley's recommendation: Declare junk and rubbish a nuisance, remove within 30 days, or city has right to do so. Motion was made by Ken Kohls, seconded by Johnny Norris to extend 90 days to owner to clean up property, or back to BSC. Motion carried. 5 -2 Charles Richards and Joseph Scott voted nay stating they felt Mr. Darnell had been given ample time to clean up this property. F. 961 W. Sherman; City Block 33, Lot 1 Owner: Manuel Darnell, Sr., 355 13th SW, Paris TX 75460 Robert Talley stated this is Mr. Darnell's residence. Mr. Talley described rubbish, metal, pipes, lumber, and junk scattered on the property. Mr. Talley stated that the lumber appears to be rotted and unusable. Mr. Talley also showed photographs where the middle of the house is collapsed. Mr. Talley discussed the high grass and weeds growing around the rubbish and junk in yard. Mr. Talley also stated the lean -to in the back yard has collapsed. Robert Talley's recommendation: Declare junk and rubbish a nuisance, remove within 30 days, or city has right to do so. The commission discussed the property. Motion was made by Ken Kohls, seconded by Johnny Norris to extend 90 days to owner to clean up property, or back to BSC. Motion carried. 5 -2 Charles Richards and Joseph Scott voted nay stating they felt Mr. Darnell had been given ample time to clean up this property. 4. Code Enforcement update. 1 structure demolished by contractor. Discussed moving up properties as priorities; city now has a track hoe and have demolished 2 properties with it. 5. Future agenda items.
