05/15/25017 MINUTESMINUTES OF THE REGULAR MEETING OF THE BUILDING AND STANDARDS COMMISSION MONDAY, MAY 159 2017 3:30 P.M. 1. Johnny Norris called the Building and Standards Commission Meeting to order at 3:30 P.M. Roll was called. A. The following members were present: Matthew Allen (arrived at 3:32) Sally McEwin Johnny Norris Ben Vaughan Charles Richards Joseph Scott B. Staff present: Robert Talley Clyde Crews Stephanie Harris Debra Burge C. Others present: 2. Approval of minutes from previous meetings. (April 17, 2017) Second page, Item 3.A., under Robert Talley's Recommendations, correct to `demolishing the shed if it was not reparable.' Recommend in future, minutes reflect who votes against a recommendation and their objection. Joseph Scott recommended NOT approving the minutes until amended and brought before BSC at next meeting, seconded by Sally McEwin. Motion carried unanimously. 6 -0 3. Public Hearing to consider presentations by City of Paris Code Inspectors and owner(s) and/or lien holder(s) of the below properties who have been given notice of a violation of Article III of Chapter 7 of the Code of Ordinances of the City of Paris, Paris, Texas, entitled "Substandard and Dangerous Buildings and Structures;" Article II of Chapter 17, entitled "Control of Weeds, Junk, and Other Objectionable, Unsightly, or Unsanitary Matter of Private Premises;" Chapter 1 -6 of the Code of Ordinances of the City of Paris, Paris, TX: A. 1507 W Houston; City Block 198, Lot 14 Owner: Lois Pollard, 7016' SE, Paris TX 75460 Robert Talley stated no contact with property owners. Large hole in roof in front, most all roof covering is damaged or missing. House is sunken in on side; wall collapsing in and window popping out. Unsecure. Large portion of back of house missing. Don't think property is securable. Robert Talley's recommendation: Declare nuisance; demo within 30 days, or city has right to do so. Commission questions. Q — How long will it take for this to be demoed? A — Minimum 3 months, but will prioritize with contractor. Q — Will building in back be demoed? A — Yes. Motion made by Joseph Scott, seconded by Ben Vaughan to accept Robert's recommendation. Motion carried unanimously. 6 -0 B. 1518 W Houston; City Block 191, Lot 10 Owner: RL Jenkins, 1212 W Cherry St, Paris TX 75460 Robert Talley stated no contact with owner, but have had contact with daughter, Denise Williams. Said her dad wants to sign right of entry. Deterioration along roof on east side. Rafters have started popping through roof covering. Missing and deteriorated wood/siding. Unsecure. Back of house starting to sink. Past evidence of people going into house, stripping. Roof leaking. Robert Talley's recommendation: Declare nuisance; demo within 30 days, or city has right to do so. Motion made by Johnny Norris, seconded by Joseph Scott to accept Robert's recommendation. Motion carried unanimously. 6 -0 C. 1217 W Shiloh; City Block 84, Lot 23 Owner: Vincent E. Clegg, 815 Fitzhugh, Paris TX 75460 Robert Talley stated this property has been brought before BSC in past. Owner died; went into receivership with Nathan Bell Realty. Were charged with demoing or selling. Current owner approached Code Enforcement in past; once he became owner, put him in touch with Nathan Bell Realty. Mr. Clegg has had possession of property for several months, and no progress /change. Missing and deteriorated wood. A couple of windows appear to be new. Deterioration along roofline, roof covering beginning to come off. Unsecure. No floor inside, vegetation growing inside where floor should be. Ceiling and walls inside deteriorating. Shed in back yard, pile of lumber in back yard. Robert Talley's recommendation: Declare nuisance, demo within 30 days, or city has right to do so. Commission questions. Q — Is there power to the house? A — No. Q — How long has current owner been in possession? A — July 2016. Motion was made by Ben Vaughan, seconded by Joseph Scott to accept Robert's recommendation. Motion carried unanimously. 6 -0 D. 1321 Belmont; Belmont Addition Block 4, Lot 3 Owner: Zollie Mae Rodgers, 1263 FM 2121, Paris TX 75462 Robert Talley stated has had contact with owner's daughter. Agrees house needs to be demoed. Told her she would have minimum of 30 days after this meeting. They're looking for contractor and pricing it. Were informed could have city do it. Large hole in roof, beginning to collapse. Unoccupied for many years. Robert Talley's recommendation: Declare nuisance and demo within 30 days, or city has right to do so. Motion was made by Joseph Scott, seconded by Sally McEwin to accept Robert's recommendation. Motion carried unanimously. 6 -0 4. Code Enforcement update. Repair update asked for in last meeting. Robert briefly reviewed 19 properties. Q — What is city's recourse if orders issued by BSC are not executed? A — Only recourse is to assess civil penalties. Could take to court and try to fine, but elderly occupant may not be able to afford to fix. Just because not repaired, may not meet definition for demo. Regarding addressing these properties, would recommend a written report in monthly packet. Q — Do we have an ordinance where we can condemn properties that do not get repaired when orders have been issued? A — Can condemn property with no one living there, but when there's a legal occupant, that becomes very difficult due to laws. Also, assessing civil penalties is a very costly process for the city. Effective in situation of commercial or multi -unit properties. What used to be Flip's Alternator on South Loop, requested Robert to look at. Is being monitored by Code Enforcement and by Fire Marshal. West wall of old First Nat'l Bank bldg is secured. 5. Future agenda items. 6. Adjournment.
