1999-085-PRO RATA SANITARY SEWER EXTENSION FOR THE COPE ADDITION
RESOLUTION NO. 99-085
WHEREAS, the City Council of the City of Paris did heretofore receive a request for a
new 8" sanitary sewer extension for the Cope Addition along Meadowlark, Mockingbird, Cope,
and Pine Mill Streets; and,
WHEREAS, it is deemed necessary for the protection of the health and welfare of the
above-described area for the City of Paris to extend the above-described line and act in the
capacity of sponsor under the terms of Section IX of Subdivision Ordinance No. 1315 of the City
of Paris with any refunds due under the pro rata charges being paid to the City of Paris water and
sewer fund; and,
WHEREAS, upon receipt of the above-described request, preliminary plans,
specifications, and estimate of the total cost of the project were prepared and delivered to the City
Manager and considered at the regular Council Meeting on the 14th day of June, 1999, and a
public hearing concerning the same was set for the 12th day of July, 1999, at which time such
public hearing was held; and,
WHEREAS, after hearing the matters presented at the public hearing, the City Council
is of the opinion that it is in the best interests of the citizens of Paris, and particularly the citizens
in the vicinity of the proposed project, that the City of Paris act as sponsor for said project which
is necessary for the protection of the health and welfare in this area; and,
WHEREAS, such project should be known as the "Pro Rata Sanitary Sewer Extension for
the Cope Addition," which has a total estimated cost of $351,972.00; and,
WHEREAS, the front foot method would be inequitable, and the tributary area method
described on Exhibit A attached hereto, as recommended by the staff, would be equitable; NOW,
THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, that the
pro rata sanitary sewer extension for the Cope Addition along Meadowlark, Mockingbird, Cope,
and Pine Mill Streets, containing approximately 8,320 linear feet of P. V.C. water main line, be,
and the same is hereby, approved and shall be known as "Pro Rata Sanitary Sewer Extension for
the Cope Addition"; and,
BE IT FURTHER RESOLVED, that the City of Paris act as sponsor of said pro rata
water main extension; and,
BE IT F1JRTHER RESOLVED, that the front foot rule would not be equitable, and the
tributary area method described in Exhibit A, attached hereto, is found to be equitable and is
adopted as the method to be used for refunding the cost of the sewer main extension to the water
and sewer fund of the City of Paris; and,

BE IT FURTHER RESOLVED, that the City Manager, Michael E. Malone, be, and he
is hereby, authorized and directed to proceed with said project, and that a pro rata contract is
waived with regard to this project, but, upon completion of the project, the actual costs of said
project shall be fixed and the price apportioned in accordance with the plan described in Exhibit
A, attached hereto, which shall be used for the purpose of the charging of the pro rata charges to
the property owners benefitting from the same and the amounts to be collected in the event of
connection to the line so constructed and paid to the water and sewer fund of the City of Paris.
