1999-034-SOLD LOT 2, CITY BLOCK 322, 4.37 ACRES, RES 90-083 RESOLUTION NO. 99-034 WHEREAS, the City Council of the City of Paris did heretofore, on the 24th day of September, 1990, in Resolution No. 90-083, declare surplus and authorize the sale of Lot 2, City Block 322; and, WHEREAS, bids for 4.37 acres of said property were received until 3:00 p.m., Tuesday, March 23, 1999, and the highest bid by a responsible bidder was from Donald Morrell in the amount of $45,200.00; and, WHEREAS, the form of the Special Warranty Deed to Donald Morrell for the conveyance of said 4.37 acres being a part of Lot 2, City Block 322, attached hereto as Exhibit A, should, in all things, be approved, and the Mayor, Charles H. Neeley, should be authorized to execute the same upon the date of closing, which shall occur no sooner than thirty (30) days from the date of passage of this resolution in accordance with Section 145 of the Charter of the City of Paris; NOW, THERE}'ORE, BE IT RESOLVED BY THE CITY COUNCIL 01<' THE CITY OF PARIS, that the bid of Donald Morrell in the amount of $45,200.00 for a 4.37 acre tract, being a part of Lot 2, City Block 322, be, and the same is hereby, accepted and let; and, BE IT }'URTHER RESOLVED, that the Mayor, Charles H. Neeley, be and he is hereby, authorized and directed to execute, on behalf of the City of Paris, a Special Warranty Deed to Donald Morrell, under the terms and conditions and in the form shown in Exhibit A, attached hereto, upon the date of closing, which shall occur no sooner than thirty (30) days from the date of passage of this resolution in accordance with Section 145 of the Charter of the City of Paris. Foster, City Attorney SPECIAL WARRANTY DEED COUNTY OF LAMAR } } } KNOW ALL MEN BY THESE PRESENTS: STATE OF TEXAS That the CITY OF PARIS, PARIS, TEXAS, a municipal corporation of the County of Lamar, State of Texas, acting by and through its Mayor, duly authorized by Resolution No. 99- _, for and in consideration of the sum ofTen and no/100 Dollars ($10.00) cash and other good and valuable consideration, in cash, to it in hand paid by Donald Morrell the receipt and sufficiency of which is hereby acknowledged; has Granted, Sold and Conveyed, and by these presents does Grant, Sell and Convey unto the said Donald Morrell of the County of Lamar, State of Texas, whose mailing address is P. O. Box 777, Paris, Texas 75461 all that certain tract or parcel of land situated in Lamar County, Texas, and described as follows: SITUATED within the corporate limits of the City of Paris, County of Lamar, and State of Texas, a part of the Redding Russell Survey No. 786, being a 4.37 acre tract of land which is a part of Lot 2, City Block 322, being a part of the same property described in deed from E. W. Lovell and wife, Anna Lovell, to the City of Paris, dated February 12, 1935, and recorded in Volume 238, Page 621, Deed Records, Lamar County, Texas, and being more particularly described as follows: BEGlNNlNG at a set iron rod at the Southwest corner of the said 4.37 acre tract of land, said corner also being in the North right-of-way line of Loop 286, said corner also being N 57" 09' W, a distance of 457.05 feet from a found iron rod at the Southeast corner of the remaining City of Paris acre tract of land; THENCE N 27" 12' 13" E, with the West Boundary Line of the said 4.37 acre tract of land, a distance of 837.96 feet to a found thirty-two inch oak tree at the North corner of the said 4.37 acre tract of land, said corner also being the North corner of the said 7.85 acre tract of land; THENCE N 000 03' 04" E, with the East Boundary Line of the said 4.37 acre tract of land and the East Boundary Line of the said 4.37 acre tract of land, a distance of 993.20 feet to a found iron rod at the Southeast corner of the said 4.37 acre tract of land, said corner also being in the North right-of-way line of the said Loop 286, 63.00 feet at right angles from survey station 147+47.31; THENCE N 570 09' W, with the North right-of-way line of the said Loop 286, a distance of 457.05 feet to the place of beginning, and containing 4.37 acres of land. The above field notes being taken from an actual survey made on the ground by Kenneth Ray Jones, Register Public Land Surveyor No. 3332 of Texas, January eXHIBIT A 26, 1999, reference being here made to all instruments and records for all necessary purposes.
