RESOLUTION NO.

WHEREAS, the City Council of the City of Paris did heretofore, on the 10th day of July,
1989, in Resolution No. 89-080, authorize the conveyance of a part of a street known as Walnut
Street, which was closed by Ordinance No. 89-029, to Estella Veach, with the City of Paris
reserving unto itself a utility easement; and,
WHEREAS, the Quit Claim Deed conveying said property should have been to Harlow
S. Redding and wife, Daisy E. Redding, since Estella Veach only had a life estate in said
property; and,
WHEREAS, it is deemed appropriate that said Quit Claim Deed be replaced with a Special
Warranty Deed, the form of which is attached hereto as Exhibit A, to the appropriate property
owners; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, that the
form of the Special Warranty Deed, attached hereto as Exhibit A, be, and the same is hereby,
approved; and,
BE IT FURTHER RESOLVED, that the Mayor, Charles H. Neeley, be, and he is
hereby, authorized and directed to execute, on behalf of the City of Paris, the Special Warranty
Deed, under the terms and conditions and in the form shown in Exhibit "A," attached hereto.

KNOW ALL MEN BY THESE PRESENTS:
STATE OF TEXAS
That, whereas, the City of Paris, as grantor did, on or about the 10th day of July, 1989,
execute a Quit Claim Deed to Estella Veach, as grantee, for the consideration therein mentioned,
a conveyance of the certain land situated in Lamar County, Texas, which was a part of a street
closed by ordinance No. 89-029, and hereinafter more particularly described, which said
conveyance is recorded in Volume 876, Page 8, Real Property Records, Lamar County, Texas;
and whereas, said deed should have conveyed said property to Harlow S. Redding and wife, Daisy
E. Redding; and, whereas, this deed replaces and supersedes said quit claim deed;
Now, therefore, the CITY OF PARIS, PARIS, TEXAS, a municipal corporation of the
County of Lamar, State of Texas, acting by and through its Mayor, Charles H. Neeley, duly
authorized by Resolution No. 99-
, for and in consideration of the sum of Ten and no/l 00
Dollars ($10.00) cash and other good and valuable consideration, to it in hand paid by Harlow S.
Redding individually and as heir at law of Estella Veach, deceased, and wife, Daisy E. Redding,
the receipt and sufficiency of which is hereby acknowledged; has Granted, Sold and Conveyed, .
and by these presents does Grant, Sell and Convey unto the said Harlow S. Redding and wife,
Daisy E. Redding, of the County of Lamar, State of Texas, whose mailing address is 5133
Highway 8 West, Mena, Arkansas 71953, all that certain tract or parcel of land situated in Lamar
County, Texas, and described as follows:
SITUATED within the corporate limits of the City of Paris, County of Lamar and
State of Texas, a part of the Hiram Williams Survey, and being a part of a street
closed by Ordinance No. 89-029 adjacent to Lot I, City Block 257D, and being
more particularly described as follows:

BEGINNING at the Southeast corner of Lot 1, City Block 257D, same
being in the West Boundary Line of 28th Street N.E.;
THENCE S 890 40' W, a distance of 120.7 feet to a point in the East
Boundary Line of North Collegiate Drive, same being the Southwest corner of Lot
I, City Block 257D;
THENCE S 00 16' W, a distance of 20 feet to the centerline of a 40 foot
street known as Walnut Street;
THENCE N 89040' E, a distance of 120.7 feet along the centerline of said
street to a point in the West Boundary Line of 28th Street N. E.;
THENCE N 00 16' E, a distance of 20 feet to the place of beginning.
SAVE AND EXCEPT a utility easement is retained by Grantor to the above
described property, which utility easement gives the right and privilege to Grantor
of placing utilities above, on and over said easement and the right to maintain any
all utilities placed therein.
TO HAVE AND TO HOLD the above described premises, together with all and singular,
the rights and appurtenances thereto in anywise belonging unto the said Harlow S. Redding and
wife, Daisy E. Redding, their heirs and assigns forever; and it does hereby bind itself, its
successors and assigns, to Warrant and Forever Defend all and singular the said premises unto the
said Harlow S. Redding and wife, Daisy E. Redding, their heirs and assigns, against every person
whomsoever lawfully claiming, or to claim the same, or any part thereof, by, through or under
it, but not otherwise.
