1999-063-HOUSING AUTHORITY INTERLOCAL AGREEMENT
RESOLUTION NO. 99-063
WHEREAS, the City of Paris Police Department, in accordance with State and Federal
laws, currently provides criminal history record information and incident reports to the Housing
Authority of the City of Paris for use in applicant screening, lease enforcement, and eviction; and,
WHEREAS, the Housing Authority of the City of Paris has requested that the City of
Paris enter into an Interlocal Agreement for the provision of such records in order to provide
evidence to the Department of Housing and Urban Development of the cooperative agreement
between the Housing Authority and the Police Department, the result of which could mean higher
scores for the Housing Authority on its annual Public Housing Management Assessment Program
(PHMAP): and,
WHEREAS, the form of the Interlocal Agreement, attached hereto as Exhibit A, should,
in all things, be approved, and the City Manager, Michael E. Malone, should be authorized to
execute the same; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, that the
form of the Interlocal Agreement with the Housing Authority of the City of Paris for the provision
of criminal history record information and incident reports, attached hereto as Exhibit A, be, and
the same is hereby, approved; and,
BE IT FURTHER RESOLVED, that the City Manager, Michael E. Malone, be, and he
is hereby, authorized and directed to execute, on behalf of the City of Paris, the Interlocal
Agreement with the Housing Authority, under the terms and conditions and in the form shown in
Exhibit A, attached hereto.

THIS AGREEMENT is made this 14th day of June, 1999, by and between the CITY OF
PARIS, PARIS, TEXAS, a municipal corporation, acting by and through its City Manager, Michael
E. Malone, duly authorized, hereinafter referred to as CITY, and the HOUSING AUTHORITY OF
THE CITY OF PARIS, a public housing agency, acting by and through its Chairman, Curtis Fendley,
duly authorized, hereinafter referred to as PHA.
WITNE SSE TH:
For and in consideration of the mutual covenants and agreements hereinafter contained, the
parties hereto agree as follows:
1. In accordance with the provisions of the Housing Opportunity Program Extension Act of
1996 (U.S.C. @ 1437d(q)(l)(A)), CITY agrees to furnish to PHA, upon request, criminal
history record information (CHRI) regarding adult and juvenile applicants for public housing.
2. CITY agrees to access, upon request, the Interstate Identification Index (III) though the
National Crime Information Center (NCIC) for the purpose of determining whether an adult
or juvenile tenant of or applicant for public housing has a criminal history record indexed.
3. CITY agrees to provide to PHA complete copies of all reports of incidents occurring at the
George W. Wright Homes, Booker T. Washington Homes, Jackson Court, the complexes at
Price Circle and 13th Street S.E., and the Westgate Apartments.
4. PHA agrees that any and all CHRI information and incident reports provided to it by CITY
will be used exclusively by PHA and only for the purposes of applicant screening, lease
enforcement, and eviction. PHA further agrees that, if an NCIC search indicates a criminal

history record, the PHA must pursue such records through the Identification Records Section
of the Federal Bureau ofInvestigation ifit wishes to obtain the same.
5. PHA agrees to make criminal complaints of violations of the law in a timely manner. Upon
learning of the commission of a drug-related, weapon-related, or violent crime by a resident
of public housing, the PHA agrees to timely commence eviction proceedings.
6. This agreement shall remain in force until such time as the passage of any law forbidding the
activities described in this contract or upon agreement of both parties hereto to cancel the
same.
