1999-065-INTERLOCAL FIRING RANGE AGREEMENT RESOLUTION NO. 99-065 WHEREAS, it is has been brought to the attention of the City of Paris that the Paris Junior College Law Enforcement Academy has requested to use the Paris Police Department Firing Range; and, WHEREAS, in order to allow the Paris Junior College Law Enforcement Academy to use said firing range, it is necessary for the City of Paris and the Paris Junior College to enter into an interlocal agreement for said use; and, WHEREAS, the form of Interlocal Firing Range Agreement, attached hereto as Exhibit A, should, in all things be approved, and the Mayor Pro Tem, Mary Ann Fisher, should be authorized to execute the same; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, that the form of the Interlocal Firing Range Agreement with Paris Junior College allowing the PJC Law Enforcement Academy to use the Paris Police Department Firing Range, attached hereto as Exhibit A, be, and the same is hereby, approved; and, BE IT FURTHER RESOLVED, that the Mayor Pro Tem, Mary Ann Fisher, be, and she is hereby, authorized and directed to execute, on behalf of the City of Paris, the Interlocal Firing Range Agreement, under the terms and conditions and in the form shown in Exhibit A, attached hereto. WtbrtYJ1tdtlA J M y A Fisher, Mayor Pro Tem ATTEST: ,="tt. .L-, ._~~~,-' Mattie Cunningham, City Clerk APROVED AS TO FORM: ~yE~~ Acting City Attorney INTERLOCAL FIRING RANGE AGREEMENT STATE OF TEXAS } KNOW ALL MEN BY THESE PRESENTS: COUNTY OF LAMAR } THAT, the CITY OF PARIS, PARIS, TEXAS, a municipal corporation, acting by and through its Mayor Pro Tem, Mary Ann Fisher, duly authorized, hereinafter called CITY, and PARIS JUNlOR COLLEGE, acting by and through its President, Bobby Walters, duly authorized, hereinafter called PJC, do hereby contract and agree as follows: 1. CITY agrees to allow the PJC Law Enforcement Acadamy to use the Paris Police Department Firing Range located at Cox Field Airport in accordance with a schedule approved by the Chief of the Paris Police Department. 2. The schedule is subject to change at any time in the event of any unexpected police operations. 3. CITY has a right to halt activities when the Chief of Police deems any activities or actions to be dangerous. 4. PJC's use of the Police Department Firing Range shall be for official Law Enforcement Acadamy purposes only. 5. PJC will be responsible for its own clean up and will assist in maintenance from time to time. 6. PJC agrees to indemnify, save, keep, and hold harmless CITY from and against any and all demands, debts, liabilities, suits, claims, and causes of action of every kind and character whatsoever for damage or injuries to persons and/or property occurring on the leased premises resulting from PJC's, its members', invitees', agents', servants', or employees' use, and CITY shall not be liable to PJC, its members, invitees, agents, servants, employees, licensees, or visitors due to the buildings or other structures thereon being improperly constructed or being or becoming out of repair, PJC hereby waiving any defects therein and agreeing to hold and save CITY harmless from all claims for any such damages or injuries. 7. PJC shall and must at all times during the term of this Lease, and any extensions hereof, keep and maintain in full force and effect a policy or policies of insurance, naming CITY as an additional insured, and providing, at least $250,000.00 for each person and $500,000.00 for each single occurrence for bodily injuries or death and $100,000.00 for each single occurrence for injury to or destruction of property, indemnifying all persons " EXHIBIT A for any and all damages, personal injuries or property damages sustained in or upon the premises of said lease property, or any part thereof, as the result of the negligence of PJC, its members, invitees, agents, servants, or employees, and shall pay all premiums due thereon when due. It is expressly provided that such insurance policy or policies shall and must be written and issued by a reputable insurance company or companies, subject to approval by the City Attorney of the City of Paris, and PJC or its insurance carrier or carriers shall deliver a copy of any such policies to the City Clerk of the City of Paris, or furnish to said City Clerk a current letter or certificate from such company or companies, evidencing the fact that such insurance is in full force and effect at all times during this Lease and any extension hereof. 8. This agreement shall be on a year to year basis, commencing on July I, 1999. 9. CITY and PJC have the right to unilaterally terminate this agreement at any time with the party desiring termination of the agreement giving at least thirty (30) days notice in writing to the other party.
