RESOLUTION NO. 99-078 WHEREAS, the City Council of the City of Paris finds that the public interest and welfare will be served by the adoption and establishment of a policy to guide the City regarding the matter addressed in this resolution; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, that 1. The term "work done by the City and paid for by the day as such work progresses," as used in the City Charter, shall be defined to mean a contract which is completed when the other party has worked for the day and the city has paid for such work. Additional work may be contracted for and paid, again on a daily basis, as needed, as the work progresses. However, a contract is not one for work performed and paid for by the day as the work progresses simply because it is payable in daily installments. A contract that obligates the city to pay for all future work, or for a party to provide day labor to do the future work, on a project is not a contract for work performed and paid by the day notwithstanding payment on a daily basis. 2. No individual compensated under the definition of "work done by the City and paid for by the day as the work progresses" shall be hired for more than 20 working days in any three month period. 3. This resolution shall be effective immediately, and shall apply to all projects initiated by the City in the future. As to projects which are currently underway, the implementation of competitive bidding shall be commenced as soon as possible if such competitive bidding is required under Chapter 252 ofthe Local Government Code of the State of Texas, with the stipulation that no work or project currently underway shall be ceased or delayed if such cessation or delay would impair the health or safety of the residents ofthe City.
