<br />RESOLUTION NO. 99-078 <br /> <br />WHEREAS, the City Council of the City of Paris finds that the public interest and welfare <br />will be served by the adoption and establishment of a policy to guide the City regarding the matter <br />addressed in this resolution; NOW, THEREFORE, <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, that <br /> <br />1. The term "work done by the City and paid for by the day as such work progresses," as used <br />in the City Charter, shall be defined to mean a contract which is completed when the other <br />party has worked for the day and the city has paid for such work. Additional work may be <br />contracted for and paid, again on a daily basis, as needed, as the work progresses. However, <br />a contract is not one for work performed and paid for by the day as the work progresses <br />simply because it is payable in daily installments. A contract that obligates the city to pay for <br />all future work, or for a party to provide day labor to do the future work, on a project is not <br />a contract for work performed and paid by the day notwithstanding payment on a daily basis. <br /> <br />2. No individual compensated under the definition of "work done by the City and paid for by the <br />day as the work progresses" shall be hired for more than 20 working days in any three month <br />period. <br /> <br />3. This resolution shall be effective immediately, and shall apply to all projects initiated by the <br />City in the future. As to projects which are currently underway, the implementation of <br />competitive bidding shall be commenced as soon as possible if such competitive bidding is <br />required under Chapter 252 ofthe Local Government Code of the State of Texas, with the <br />stipulation that no work or project currently underway shall be ceased or delayed if such <br />cessation or delay would impair the health or safety of the residents ofthe City. <br /> <br />PASSED AND ADOPTED this 14th day ofJune, 1999. <br /> <br /> <br />I!}~~~ <br /> <br />ATTEST: <br /> <br />~t\.~L~,->~"",,,<,~~~J <br />Mattie Cunningham, City Clerk <br /> <br />APPROVED AS TO FORM: <br /> <br />~y~ <br /> <br />Acting City Attorney <br /> <br />
