1999-093-4.028 ACRES DONATED SPECIFICALLY FOR PARK USE, BY WILLIAM AND ELIZABETH HAYDEN
RESOLUTION NO. 99-093
WHEREAS, the City Council of the City of Paris is in receipt of a deed of donation from
William deG. Hayden and wife, Elizabeth D. Hayden, conveying approximately 4.028 acres,
located in the 1000 block of West Kaufman Street, Paris, Texas, and described in Exhibit A,
attached hereto, which property is to be used specifically by the City of Paris as a park; and,
WHEREAS, the generosity of Dr. and Mrs. Hayden is appreciated, and it is deemed to
be in the best interests of the citizens of Paris that such donation be accepted; NOW,
THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, that the
donation of property by William deG. Hayden and wife, Elizabeth D. Hayden, to be used
specifically by the City of Paris as a park, same being a 4,028 acre tract located in the 1000 block
of West Kaufman Street, Paris, Texas, which property is described in the deed attached hereto as
Exhibit A, be, and the same is hereby, in all things accepted.

be used specifically for a park, all that certain tract or parcel of land situated in Lamar County,
Texas, and described as follows:
SITUA TED within the corporate limits of the City of Paris, County of Lamar,
State of Texas, being a part of the Asa Jarman Survey No. A-479, being the same
property described in deed from Union Pacific Railroad Company to William deG.
Hayden, M.D. recorded Volume 768, Page 294 of the Lamar County Real Property
Records, as Parcel One; all that property as described in deed dated June 8, 1896,
from E. W. Rush et ux, to Texas Midland Railroad, recorded July 1, 1896 in Volume
82, Page 122, Official Records, EXCEPTING therefrom that portion as conveyed by
deed dated May 21, 1980 from Southern Pacific Transportation Company, to Fred M.
Willoughby, recorded July 21, 1980 in Volume 626, Page 671, Official Records.
Parcel Two' all that property described as the "First Tract" as conveyed by deed dated
July 2, 1896, from D. F. Latimer to Texas Midland Railroad, recorded August 1, 1896
in Volume 82, Page 164 Official Records, Parcel Three' all that property described
as "Second Tract" as conveyed by deed dated July 2, 1896, from D. F. Latimer to
Texas Midland Railroad Recorded August I, 1896 in Volume 82, Page 164 Official
Records, EXCEPTING therefrom that portion as conveyed by deed dated November
19, 1984, from Southern Pacific Transportation Company to Joe Mercer, recorded
November 19, 1984, in Volume 678, Page 559, Official Records, and being more
particularly described as follows:
BEGINNING at a point for corner being in the south boundary line of Kaufman
Street, being the northwest corner of Lot 6. City Block 129-A;
THENCE south along the west boundary line of said Lot 6 a distance of 284 feet,
to a point for corner;
THENCE easterly, a distance of approximately 130 feet to the southeasl corner
of said Lot 6, a point for corner;
THENCE south passing the southeast corner of Parcel One, also being the
northeast corner of Parcel Three at 110 feet, continuing along the east boundary line
of said Parcel 3 for a total distance of 466 feet to a point for corner;
THENCE west a distance of 113.28 feet to a point for corner;
THENCE southwesterly a distance of 219.37 feet to the centerline of Sherman
Street to a point for corner;

THENCE West along the centerline of Sherman Street a distance of 107.24 feet
to a point for corner being the southwest corner of said Parcel 3;
THENCE North along the west boundary line of said Parcel 3 passing the
northwest corner of said parcel at 552 feet continuing north along the west boundary
line of property described in Parcel 2 for a total distance of 946 feet to a point in the
south boundary line of Kaufman Street, being the northwest corner of said Parcel 2;
THENCE east a distance of approximately 125 feet to the point of beginning, and
containing approximately 4.028 acres, more or less.
TO HAVE AND TO HOLD the above described premises, together with all and singular,
the rights and appurtenances thereto in anywise belonging unto the said CITY OF PARIS, its
successors and assigns forever; and we do hereby bind ourselves, our heirs, executors and
administrators, to Warrant and Forever Defend all and singular the said premises unto the said
CITY OF PARIS, its successors and assigr,s, against every person whomsoever lawfully claiming,
or to claim the same or any part thereof.
