1999-108-QUITCLAIM DEED TERMINATING UTILITY EASEMENT, SEE ORD 89-029 RESOLUTION NO. 99-108 WHEREAS, the City Council of the City of Paris did heretofore, on the 10th day of July, 1989, by Ordinance No. 89-029, close Walnut Street from the west right-of-way line of 28th Street N.E., west to the east right-of-way line of Collegiate Drive, retaining a utility easement; and, WHEREAS, the City Council of the City of Paris did heretofore, on the 10th day of July, 1989, in Resolution No. 89-080, authorize the execution of quitclaim deeds conveying the closed portion of Walnut street to the adjoining property owners retaining a utility easement; and, WHEREAS, there is no known municipal use for the utility easement retained, and it would be right and proper to terminate the same; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, that the utility easement retained in the portion of Walnut Street from the west right-of-way line of 28th Street N.E., west to the east right-of-way line of Collegiate Drive, closed by Ordinance No. 89-029, be, and same is hereby, terminated; and, BE IT FURTHER RESOLVED, that the Mayor, Charles H. Neeley, be, and he is hereby, authorized and directed to execute, on behalf of Ihe city of Paris, the quitclaim deed terminating easement in the form shown in Exhibit A, attached hereto. Harris, Assistant City Attorney OUlTCLAIM DEED TERMINATING EASEMENT THE STATE OF TEXAS ~ ~ ~ KNOW ALL MEN BY THESE PRESENTS: COUNTY OF LAMAR That the City of Paris, a municipal corporation of the County of Lamar, State of Texas, by and through its Mayor, duly authorized, for valuable consideration, receipt of which is acknowledged, grantor does release and forever quitclaim any interest it may have in that certain real property located in Lamar County, Texas, more particularly described as follows: SITUATED within the corporate limits of the City of Paris, County of Lamar and State of Texas, a part of the Hiram Williams Survey, and being parts of a street closed by Ordinance No. 89-029 adjacent to Lot 1, City Block 257D, and Lot 1, Block 7, Springlake Addition, and being more particularly described as follows: TRACT ONE: BEGINNING at the Southeast corner of Lot 1, City Block 257D, same being in the West Boundary Line of 28th Street N.E.; THENCE S 890 40' W, a distance of 120.7 feet to a point in the East Boundary Line of North Collegiate Drive, same being the Southwest corner of Lot 1, City Block 257D; THENCE S 00 16' W, a distance of 20 feet to the centerline of a 40 foot street known as Walnut Street; THENCE N 890 40' E, a distance of 120.7 feet along the centerline of said street to a point in the West Boundary Line of 28th Street N.E.; THENCE N 00 16' E, a distance of 20 feet to the place of beginning. TRACT TWO: BEGINNING at the Northeast corner of Lot I, Block 7, Springlake Addition, same being in the West Boundary Line of 28th Street N.E.; THENCE S 890 40' W, a distance of 120.4 feet to a point in the East Boundary Line of North Collegiate Drive, same being the Northwest corner of Lot I, Block 7 ofSpringlake Addition; THENCE N 00 16' W, a distance of 20 feet to the centerline of a 40 foot street; THENCE N 890 40 ' E, a distance of] 20.7 feet along the said centerline to a point in the West Boundary Line of28'h Street N.E.; THENCE S 00 16' E, a distance of20 feet to the place of beginning. EXHIBIT A This Quitclaim Deed is given specifically to release the easement reserved in City of Paris Ordinance No. 89-029 which closed Walnut Street between 28th Street N.E. and Collegiate Drive, and was reserved in deeds to Estella Veach, recorded in Volume 876, Page 8; to Harlow S. Redding and wife, Daisy E. Redding, recorded in Volume 876, Page 6 of the Lamar County Deed Records; and Special Warranty Deed to Harlow S. Redding and wife, Daisy E.
