07/12/2017 MINUTESREGULAR MEETING MIINUTES CITY OF PARIS HISTORIC PRESERVATION COMMISSION CITY COUNCIL CHAMBERS 107 EAST KAUFMAN PARIS, TEXAS WEDNESDAY, July 12.2017 4:00 P.M. Present: Absent: Chris Dux Sarah Barbee Glee Emmite David Alarid Linda Vandiver Guests: Skipper Steely Barbara Wilson Randy Hider Lyle Edwards Cheri Bedford HPO Carla Easton, City Engineer Stephanie Harris, City Attorney 1. Call meeting to order at 4:00 p. m. 2. All Commissioners took turns and introduced themselves and said why they wanted to be on the Commission. 3. Motion was made by Commissioner Dux to approve the May 10, 2017 minutes, Motion carried 6 -0 4. Nominations for Commission officers were taken, and a motion was made by acclimation to accept the following slate as officers for the year 2017 -2018: Chris Dux, Chairman, Skipper Steely, Vice Chairman, and Randy Hider, Secretary. Motion carried 6 -0. 5. Update on National Alliance of Preservation Commissions CAMP -July 26, 2017 Cheri informed the commission there was a code that they could use to register for the training, and it was important to go ahead and register for planning purposes. 6. --- CONSENT AGENDA - -- Discussion and possible action regarding the following structures considered by code inspectors to be in violation of Article III of Chapter 7 of the Code of Ordinances of the City of Paris, Paris, Texas, entitled "Substandard and Dangerous Buildings and Structures," to determine whether such buildings or structures can be rehabilitated and designated on the National Register of Historic Places, as a recorded Texas Historic Landmark, or as historic property as designated by the City Council of the City of Paris. A motion was made by Commissioner Emmite, and seconded by Commissioner Hider that the following houses be recommended to the Building and Standards commission for demolition because they cannot be rehabilitated or designated on the National Register of Historic Places, as a recorded Texas Historic Landmark, or as historic property as designated by the City Council of the City of Paris: 1804 W Houston, 1501 W Campbell, 424 Graham, 40810th NE, 60412th SE, and 40012 NE. The Commissioners requested that item 623 6th SE be pulled from the list for further discussion of the condition of the property in the next meeting. Motion carried 6 — 0. 7. Discussion of 205 E. Houston. COA # 2016 -57 denied at the December 14, 2017. Pictures were presented to the commission with the fireplace installed in front door opening building by Cheri Bedford. Carla Easton, City Engineer informed the commission that over the past few months the building department has been working with Mr. Edwards on some building code issues and all have been resolved and hadn 't forwarded any action on the COA violations, however it was next on the list. She confirmed that Cheri Bedford was communicating with Mr. Edwards. After reviewing pictures of the current building. Commissioner Dux stated the purpose of the Historic Preservation commission was not intending to prevent people from doing renovations to their property they would like to do, but its intent was to maintain the historical integrity and appearance of the buildings in the district. Commissioner Dux made some suggestions to Mr. Edwards with potential solutions that might be acceptable by the Commission. Suggestions were to recess the fireplace opening even with the existing doors, and replicate the design that was approved on the right and left side door openings. The other suggestions were to leave the fireplaces as is and create doors to match the existing doors without recessing the fireplace. Cheri Bedford let the commission members know that Mr. Edwards was aware of the violation, and wants to work on a solution, so he will present a new Certificate of Appropriateness at the August 2017 meeting for consideration. No action was taken. 8. Discussion and Possible action on COA #2016 -29, incomplete painting of trim on house. Mrs. McGlasson, 1028 Church Street- Code Enforcement officer is asking for a recommendation to take action to pursue a violation. Chairman Dux gave a background of the house paint issue. Minutes of the June 2016 minutes were presented to commission for review. The commission had given Mrs. McGlasson 6 months to paint the trim of the house. She started the work, but to date hasn't finished. Commissioner Alarid volunteered to get a crew to finish painting the trim on the house. The Commission asked Cheri Bedford to contact her and work with Commissioner Alarid to get the house trim painted. 9. HPO Report: Administratively approved COAs: 201 7 - 1 7 111 7 Church Street Paint exterior house. Belford Apartments update- Cheri Bedford began by explain Chief Larry Wright was not able to attend, but was going to come and give an update, however, there was a standing demolition order on the property. Commissioner Steely interjected that he wanted to understand why the building has to be demolished. Cheri Bedford stated that a structural engineering firm assessed the building a few years back and its findings were that the building was structurally unsound. Commissioner Steely stated that didn't think the building needed to be demolished, and asked Stephanie Harris, City Attorney if she could give some insight on the process of why it had to be demolished. Ms. Harris stated the building had appeared many years ago through HPC, and the Building and Standards Commission and the City's proper legal process is has been long done. The building owner had his chance to be heard in District court, the Appellate court, and there is a valid demolition order on the building. The owner will not repair nor demolished the structure. The legal situation is City of Paris has right to demolish it. Commissioner Steely asked if the HPC could make a recommendation the City foreclose on the building and sell it to a prospective buyer who will rehabilitate it. Ms. Harris stated that the building would then be the property of the City of Paris, and she is not the one to speak on behalf of the City of Paris as to if this is the direction it is willing to go. After more discussion, Ms. Harris told the Commission they could make a recommendation to Council under their enumerated powers, stressing that it would only be a recommendation, to work with the owner to find a potential buyer and look for a possible solution to try saving the building, but the demolition order would most likely still be valid should a new owner purchase the building. Commissioner Steely asked if the commission could make a recommendation that the City make an acquisition of the property and make an attempt to get it into the hands of a potential owner. Ms. Harris stated there were legal issues that would mitigate against that idea. Commissioner Hider mentioned that a buyer would have to be financially able to restore the building. Commissioner Dux asked if a possible resolution could be to work with the current owner on some mechanism where a prospective buyer could purchase the building at a reasonable price based on the condition of the building, and the buyer would need to demonstrate the financial resources, ability, acceptable timeline, and due diligence to rehabilitate the structure, if City Council would be willing to work with the buyer and current owner to give some relief by reducing some of the accrued fine? Ms. Harris made the recommendation she, Chairman Dux, and Cheri work on a resolution to present to council with the language in the form of a recommendation as discussed, and bring it back to the commission the following month for review. Updates on Lamar Hospital; Code enforcement is dealing with the owners in court. Review of website- Commissioner Hider asked if the tab for the favade grant can be changed to reflect that the grant is only available in the commercial district to remove confusion to residential district owners. Commissioner Dux stated that he attended he attended the commissioner training put on by the City Manager and if commissioners didn't attend they could get with Janice Ellis, City Clerk for print outs. He did discuss that it was mentioned at the meeting that only items that are placed on an agenda can be discussed at the meetings due to the public process. 11.
