05 - MINUTES OF 09/11/2017 AND 09/18/2017 COUNCIL MEETINGSItem No. 5 MINUTES OF THE REGULAR CITY COUNCIL MEETING OF THE CITY OF PARIS, TEXAS September 11, 2017 The City Council of the City of Paris met for a regular session at 5:30 p.m. on Monday, September 11, 2017, at the City Council Chamber, 107 E. Kaufinan, Paris, Texas. Present: Mayor: Steven Clifford Council Members: Billie Lancaster; Aaron Jenkins; Billy Trenado; Linda Knox; Cleonne Drake; and Paula Portugal City Staff John Godwin, C3 Manager; Stephanie Harris, City Attorney; Janice Ellis City Clerk; Gene Anderson, Finance Director; Cala Easton, City Engineer; Larry Wright, Fire Chief, Bob Hundley, Police Chief; Clyde Crews, Fire Marshal; Kent Klinkerman, EMS Director; Doug Harris, Utilities Director; Alan Efrussy, Plann, Director; and Priscilla McAnally, Library Director Opening Agenda 1. Call meeting to order. Mayor Clifford called the Meeting toy girder at 5:30'0.m. and asked for a moment of silence for the 9/11 victims and victims of the two hurricanes. 2. Invocation. Following a moment of silence, Gene Anderson gave the invocation. 3. Pledge of Allegiance. Council Member Drake led the pledge. 4. Citizens' Forum. Carol Hufnagel, 720 Bunker — she said she reads the Paris News and likes to come to the Council meetings to see what is going on. She said it was good to read the mayor's editorial in the paper on Sunday about PEDC and somehow the City needed to get the word out. Ed Darnell, 961 W. Sherman — he said the City of Paris had been harassing him for fifteen years for no reason. He said he had building material at his house, it was not rubbish and he had been selling the materials. Regular Council Meeting September 11, 2017 Page 2 Jenene Lauren, 1760 30 NE — she said the City Council should study and review the City's development plans, programs, zoning ordinances, the Cox Field ordinance, the Lake Crook ordinance, and policies. She said she spent a lot of money to get all of these documents and it was going to be a long process. Michael Glatfelter — he said he was speaking about item #11, the contract with B. Bray. He said the history was that Tri-State Recycling purchased a piece of property from Barney Bray when he was on the Planning and Zoning Commission, and that was a conflict. He also said a permit was issued within four days and then rescinded, and the City ended up in Court and it cost the City $75,000. Consent Agenda Mayor Clifford inquired of Council Members if they wished to pull any items from the consent agenda for discussion. There being node, a, Motion to approve the consent agenda was made by Council Member Lancaster and ended by Council Member Trenado. Motion carried, 7 ayes — 0 nays. 5. Approve minutes from the meetings on August 14, August 28 and September 5, 2017. 6. Receive reports and/or minutes from the following boards, commissions, and committees: a. Paris Visitors & Convention Council (6-26-2017) b. Traffic Cortumission (�-1-2017) 7. Approve the Final Plat of Lot 1, Block A, Christian Fellowship Church Addition, located in the 3300 to 3400 Block of North Main. 8. Approve the Replat of Lot ,l, Block A,.A1 Stor-N-Go Addition CB 323, located at 2420 FM 79. Regular Agenda 9. Conduct a public hearing, discuss and act on an Ordinance considering the petition of Lawrence Thompson for a change in zoning from Single -Family Dwelling District No. 2 (SF -2) to a Single -Family Dwelling District No. 2 (SF -2) with a Specific Use Permit #36 (Recreational Facility -Private), on Sperry's 1St Addition, Block 2, Lot North PT 1, being located at 2815 West Campbell Street. A Motion to remove this item from the table was made by Mayor Clifford and seconded by Council Member Drake. Motion carried, 7 ayes — 0 nays. Planning Director Alan Efrussy explained that the applicant requested a zoning change with a specific use permit and that he wished to build a basketball court on this property. Mr. Efrussy said initially staff recommended approval but following the Planning & Zoning meeting last Thursday, staff recommended denial. Regular Council Meeting September 11, 2017 Page 3 Mayor Clifford opened the public hearing and asked for anyone wishing to speak in support or opposition of this item, to please come forward. Applicant Lawrence Thompson spoke in favor of the zoning change. Alice Hearne, 795-29t` NW, opposed the zoning change citing traffic issues, no bathrooms and late hours. Carolyn Briley, 2510 W. Campbell, spoke against the zoning change based on concerns of unwanted individuals, traffic, sanitation, bus stops and churches. She also said they had several parks in the area, as well as the Trail de Paris. Ms. Briley read a statement at the request of Ms. Bennie Battle, 1025 W. Houston, who also opposed the zoning change for reasons stated by the others. With no one else speaking, Mayor Clifford closed the public hearing. Council Member Portugal said she believed people should have a right to do with their property as they pleased, as long as it was not a nue to, ethers. Mayor Clifford said he opposed the zoning change for the reasons set out' by the ladies�o spoke in opposition to the zoning change, and he further expressed concern about what coulppen to the neighborhood in the future. A Motion to deny this item was made by Mayor Clifford and seconded by Council Member Drake. Motion carried, 7 ayes - 0 nays. 10. Conduct the second public heaping on the City's proposal to increase tax revenues from the preceding tax year and to set the tax rate for 2017. City Manager John Godwin said this was the:s conal public hearing as required by law. Mayor Clifford opened the public hearing and asked for anyone wishing to speak about this item, to please come forward. With no one speaking, Mayor Clifford closed the public hearing. 11. Discuss and authorize the City Manager to execute a contract in the amount of $274,975.50 with B. Bray Construction, Inc. for construction of the TxCDBG Dickson Orange Infrastructure Improvements Project. City Engineer Carla Easton explained the City applied for a grant through the Texas Community Development Block Grant Program for replacement of water lines, sewer lines and street repair on Dickson Street from 9h NW to 11 1h NW, and also a sewer line replacement along Orange Street. Ms. Easton said the City was awarded a grant in the amount of $275,000 toward plan development and construction of the proposed improvements. She also the City received three bids but irregularities were found in the bid form from one of the companies so they had two good bids. Ms. Easton said staff recommended authorizing a contract with B. Bray Construction including the base bid, add alternate #1 and add alternate #2 in the amount of $274,975.50, the lowest bid. Mayor Clifford said he had questions, as he had been trying to track this online and saw it on CivCast. He inquired if Ms. Easton posted it on CivCast or if they picked it up from another site. Ms. Easton said she posted it on CivCast and then answered questions about the addendum. Regular Council Meeting September 11, 2017 Page 4 Mayor Clifford said CivCast was set up to make on-line bidding easy and inquired if there was a reason the City did not do that or if the City had looked into doing so. Ms. Easton said staff had not looked into it. She also said other places she had worked were not fully set up because there was some prep work to receive secure bids and to make sure no one could see them until the bid opening. Mayor Clifford said he does not know if it is something that was for the City, but it might help the City get more bids. Mayor Clifford reiterated he was not saying the City should or should not do this, but asked Ms. Easton to look into it and get back to the Council. Council Member Knox questioned the wide discrepancy amount in the bids. Ms. Easton said she thought there was a local advantage. Council Member Portugal wanted to know if B. Bray's safety and quality record was acceptable. Ms. Easton said safety was not a part of the bid form. Mayor Clifford confirmed with Ms. Easton there had been a past issue ,with B. Bray on West Houston when concrete had to be jack hammered up, because it was not up to code. Council Member Drake wanted to know if someone from the City would be overseeing this project to make sure this issue does not happen again. Ms. Easton said yes, that they would have a construction inspector assigned to it. Mayor Clifford said it needs to be done according to code, and all required inspections done. A Motion to approve the contract with B. Bray Construction was made by Mayor Clifford and seconded by Council Member Lancaster. Motion carried, 7 ayes — O'nays. 12. Discuss and act on ORDINANCE' `. COUNCIL OF THE CITY OF PAR A SOLID WASTE 2017-034: AN ORDINANCE OF THE CITY CEXAS, AUTHORIZING THE ISSUANCE OF MIT TO COUNTY WASTE COLLECTIONS, LLC, D/B/A TRASHY BUSINESS FOR TH,E°''URPOSE OF ENGAGING IN THE BUSINESS OF COLLECTING AND/OR TRANSPORTING SOLID WASTE FROM COMMERCIAL AND INDUSTRIAL UNITS WITHIN THE CITY LIMITS OF THE CITY OF PARIS, TEXAS; FINDING A PUBLIC NECESSITY AND CONVENIENCE FOR ISSUANCE OF SAID PERMIT; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE DATE. Mr. Godwin said County Waste Collections and Sanitation Solutions were the two commercial solid waste haulers and currently held permits from Paris. He also said these were annual permits. Mayor Clifford inquired if they could vote on items 12 and 13 together and Mr. Godwin answered in the affirmative. A Motion to approve =items 12 and 13 was made by Mayor Clifford and seconded by Council Member Drake. Motion carried, 7 ayes — 0 nays. 13. Discuss and act on ORDINANCE NO. 2017-035: AN ORDINANCE OF THE CITY OF PARIS, TEXAS, AUTHORIZING A SOLID WASTE COLLECTION PERMIT TO SANITATION SOLUTIONS, INC. FOR THE PURPOSE OF ENGAGING IN THE BUSINESS OF COLLECTING AND/OR TRANSPORTING SOLID WASTE FROM COMMERCIAL AND INDUSTRIAL UNITS WITHIN THE CITY LIMITS OF THE CITY OF PARIS, TEXAS; FINDING A PUBLIC NECESSITY AND CONVENIENCE FOR ISSUANCE OF SAID PERMIT; MAKING OTHER FINDINGS AND Regular Council Meeting September 11, 2017 Page 5 PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE DATE. 14. Discuss and act on ORDINANCE NO. 2017-036: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, AMENDING SEC. 26-1, "COMPOSITION OF DEPARTMENT," OF CHAPTER 26, "POLICE," OF THE CODE OF ORDINANCES OF THE CITY OF PARIS, TEXAS BY REDUCING THE NUMBER OF OFFICERS EMPLOYED BY THE PARIS POLICE DEPARTMENT BY THREE, BY REDUCING THE NUMBER OF LIEUTENANT POSITIONS FROM EIGHT TO SEVEN, AND BY INCREASING THE NUMBER OF SERGEANTS FROM FOUR TO FIVE; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; PROVIDING A REPEALER CLAUSE, A SEVERABILITY CLAUSE, A SAVINGS LAUSE; AND DECLARING AN EFFECTIVE DATE. Chief Bob Hundley explained the reason for this needed change was NLISD formed a police department, and the Paris Police Department furnished three officers by contract to NLISD who were no longer needed. He said the total officer positions for the police department would reduce from forty-three to forty and a lieutenant position would be converted to a sergeant position upon a retirement effective' 004ber 31. A Motion to approve this item was made by Mayor Clifford and seconded by Council Member Trenado. Motion carried, 7 ayes— 0 nays. 15. Discuss and act on the fiscal year 2017-18 Annual Program of Work and Budgets for Love Civic Center and the 'visitors & Convention Council. A Motion to remove this item from the table was made by Mayor Clifford and seconded by Council Members Knox and Drake. Motibn carried, 7 ayes — 0 nays. Chamber Executive Director Ken Higdon said he had provided to them a line item budget and asked if they had any questions. Council Member Knox said it looked great and that is exactly what she asked for. She also said she was glad to see the Plan of Works. A Motion to approve the budgets was made by Council Member Knox and seconded by Mayor Clifford. Motion carried, 7 ayes — 0 nays. 16. Consider and approve future events for City Council and/or City Staff pursuant to Resolution No. 2004-081. Council Member Drake referenced the Main Street "From Farm to Table" Event scheduled for Saturday. Regular Council Meeting September 11, 2017 Page 6 17. Adjournment. Discuss and act on ORDINANCE NO. 2017-037: AN ORDINANCE OF THE CITY COUNCIL OF, TI4E CITY OF PARIS, TEXAS, AUTHORIZING AND DIRECTING THE DIRECTOR OF FINANCE TO TRANSFER UNENCUMBERED FUNDS FROM VARIOUS DEPARTMENTS TO OTHER DEPARTMENTS WHICH ARE EXPECTED TO OVER -EXPEND. THEIR ,ORIGINAL BUDGET APPROPRIATIONS; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; PROVIDING A REPEALER CLAUSE, A SEVERABILITY CLAUSE, A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE. Finance Director Gene Anderson explained this was an annual year end housekeeping ordinance increasing certain departmental budgets to cover anticipated expenditures. He further explained these increases were offset by decreasing other departmental budgets which had an appropriation surplus. Mr. Anderson said the total budget was not being increased. A Motion to approve this item was made by Mayor Clifford and seconded by Council Members Trenado and Portugal. Motion carried, 6 ayes — 0 nays. 3. Discuss and act on ORDINANCE NO. 2017-038: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, ADOPTING A BUDGET FOR THE ENSUING FISCAL PERIOD BEGINNING OCTOBER 1, 2017, AND ENDING SEPTEMBER 30, 2018, IN ACCORDANCE WITH THE CHARTER OF THE CITY OF PARIS; APPROPRIATING THE VARIOUS AMOUNTS THEREOF; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; PROVIDING Special Council Meeting September 18, 2017 Page 2 A REPEALER CLAUSE; A SEVERABILITY CLAUSE, A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE. Mr. Anderson said the budget had been discussed over the last several months, the two required public hearings were conducted and this was the ordinance adopting the budget. Discuss and ratify the property tax increase reflected in the budget as required by Local Government Code Section 102.007(c) Mr. Anderson said State Law required the City Council to take a separate vote to ratify the property tax increase reflected in the 2017-18 I3?1get. A Motion to ratify the property tax irittease was made by Mayer Clifford and seconded by Council Member Trenado. Motion carried, 6ayes — 0 nays. 5. Discuss and act on ORDINANCE NO. 2017-039. -N ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, FIXING THE TAX RATE AND THE TAX LEVY AND LEVYING AD VALOREM TAXES FOR THE CITY OF PARIS FOR THE CALENDAR YEAR 2017 UPON ALL TAXABLE PROPERTY WITHIN THE CITY OF PARIS IN CONFORMITY WITH THE CHARTER PROVISIONS AND ORDINANCES OF THE CITY; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; PROVIDING A SAVINGS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. Mr. Anderson explained that each year the City Council must adopt a property tax rate sufficient to fund the city budget as adopted by the Council.
