12 - STOP SIGNSItem No. 12 memorandum TO: City Council John Godwin, City Manager FROM: Randy Tuttle, Assistant Chief of Police SUBJECT: STOP SIGNS DATE: September 06, 2017 BACKGROUND: At the beginning of this school year Paris ISD Head Start changed the parent drop off/pickup point from the west side to the east side of the school. This caused an increase in traffic at the intersection of 7th NE & Williams during beginning and end of school. There is currently no traffic control device at this intersection and Paris ISD request stop signs be placed at the intersection. STATUS OF ISSUE: On September 05, 2017 the City of Paris Traffic Commission considered this issue and voted to request the City Council consider placing stop signs for east and west traffic at 7th NE & Williams. BUDGET: Estimated cost of $200.00 from current budget. RECOMMENDATION: Approve change of official traffic control map to install stop signs. Draft ORDINANCE NO. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, AMENDING THE TRAFFIC CONTROL MAP ADOPTED IN SECTION 31- 65(b) OF THE CODE OF ORDINANCES OF THE CITY OF PARIS, TEXAS; ESTABLISHING STOP SIGNS STOPPING EASTBOUND AND WESTBOUND TRAFFIC AT THE INTERSECTION OF 7TH STREET NE AND EAST WILLIAMS STREET; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; PROVIDING A REPEALER CLAUSE, A SEVERABILITY CLAUSE, A SAVINGS CLAUSE, A PENALTY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Paris Traffic Commission is charged with reviewing and evaluating proposals to add or remove traffic control devices on City streets and roadways throughout the City of Paris; and, WHEREAS, the Traffic Commission has the authority to review the placement of stop signs at various intersections throughout the City; and, WHEREAS, the Traffic Commission, at its regular meeting of September 5, 2017, considered and evaluated a request for the placement of stop signs stopping eastbound and westbound traffic at the intersection of 7th Street NE and East Williams Street due to an increase of traffic created by a change in parent drop-off/pick-up at Paris Independent School District Head Start; and WHEREAS, The Traffic Commission found and determined that the placement of stop signs at this location in the City of Paris is necessary to protect the public health and safety and is in the best interests of the citizens of the City of Paris; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS: Section 1. That the findings set out in the preamble to this ordinance are hereby in all things approved. Section 2. That the Traffic Control Map of the City of Paris, Texas, as amended and as adopted in Paragraph (b) of Section 31-65, Chapter 31, of the Code of Ordinances of the City of Paris, Texas, be, and the same is hereby, further amended to include the following stop signs: "Stop signs stopping eastbound and westbound traffic at the intersection of 7th Street NE and East Williams Street." Section 3. That all provisions of the ordinances of the City of Paris, Texas in conflict with the provisions of this ordinance are hereby repealed, and all other provisions of the ordinances of the City of Paris not in conflict with the provisions of this ordinance shall remain in full force and effect. Section 4. That the repeal of any ordinance or part of ordinances affected by the enactment of this ordinance shall not be construed as abandoning any action now pending under or by virtue of such ordinance or as discontinuing, abating, modifying, or altering any penalty accruing or to accrue, or as affecting any rights of the municipality under any section or provisions of any ordinance at the time of passage of this ordinance. Section 5. That it is the intention of the City Council of the City of Paris that this ordinance and every provision hereof shall be considered severable, and the invalidity or partial invalidity of any section, clause, or provisions of this ordinance shall not affect the validity of any other portion of this ordinance. Section 6. That any person violating any provision of this ordinance shall be guilty of a Misdemeanor, and upon conviction, shall be subject to a fine in accordance with provisions of Sec. 1-6 of Chapter One of the City of Paris Code of Ordinances, and each and every day's continuance of any violation of the above -enumerated sections shall constitute and be deemed a separate offense. Section 7. That this ordinance shall become effective from and after its passage and publication as required by law. PASSED AND ADOPTED this 25th day of September, 2017. Steven J.
