2000-010-RES AUTHORIZING THE EXECUTION OF AN INTERLOCAL GOVERNMENTAL AGREEMENT RESOLUTION NO. 2000-010 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS, AUTHORIZING THE EXECUTION OF AN INTERLOCAL GOVERNMENTAL AGREEMENT FOR COMMUNITY POLICING DRUG ELIMINATION SERVICES WITH THE HOUSING AUTHORITY OF THE CITY OF PARIS; PROVIDING FOR SECURITY SERVICES BY AND THROUGH THE PARIS POLICE DEPARTMENT; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, funding for community policing and drug elimination and prevention services has become available to the Housing Authority of the City of Paris through the Public and Indian Housing Drug Elimination Program, and the Housing Authority has asked the City of Paris to furnish said community policing drug elimination services by and through the Paris Police Department, and it is deemed to be in the best interests of the residents of public housing that said services be provided; and, WHEREAS, the Interlocal Governmental Agreement for Community Policing Drug Elimination Services between the City of Paris and the Housing Authority, attached hereto as Exhibit A, should, in all things, be approved, and the City Manager, Michael E. Malone, should be authorized to execute the same; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS: Section 1. That the findings set out in the preamble to this resolution are hereby in all things approved. Section 2. That the form ofthe Interlocal Governmental Agreement for Community Policing Drug Elimination Services between the City of Paris and the Housing Authority, attached hereto as Exhibit A, be, and the same is hereby, approved. Section 3. That the City Manager, Michael E. Malone, be, and he is hereby, authorized and directed to execute, on behalf of the City of Paris, the Interlocal Governmental Agreement for the provision of security services by and through the Paris Police Department, upon the terms and conditions and in the form shown in Exhibit A, attached hereto. Neeley, Mayor ATTEST: ~ ~~~ t-tV Mattie Cunningham, City Clerk APPROVED AS TO FORM: INTERLOCAL GOVERNMENTAL AGREEMENT FOR COMMUNITY POLICING DRUG ELIMINATION SERVICES BETWEEN THE CITY OF PARIS AND THE HOUSING AUTHORITY OF THE CITY OF PARIS STATE OF TEXAS ) ) ) KNOW ALL MEN BY THESE PRESENTS: COUNTY OF LAMAR THAT, the CITY OF PARIS, PARIS, TEXAS, a municipal corporation, acting by and through its City Manager, Michael E. Malone, duly authorized, hereinafter called CITY, and the HOUSING AUTHORITY OF THE CITY OF PARIS, TEXAS, a public housing authority, acting by and through its Chairman of the Board of Commissioners, Curtis Fendley, duly authorized, hereinafter called PHA, do hereby contract and agree as follows: 1. CITY covenants and agrees that it will furnish community policing drug elimination services, in addition to ordinary police patrol services currently furnished to PHA, to consist of one (1) police officer, certified by the Texas Commission on Law Enforcement Officer Standards, who has been trained in multi-ethnic cultural and sensitivity training, with personal communication pack, and one (1) fully equipped and marked police patrol unit for one thousand five hundred and thirty-four (1,534) hours for the contract period. Hours are to be scheduled weekly as agreed between the Chief, Paris Police Department, and the Executive Director of the Housing Authority, or her designee, and reduced to a written schedule in the form of Exhibit A, attached hereto, and the schedule may be amended upon agreement of the same parties. 2. CITY also agrees to provide officers to attend monthly meetings of the residents' organization council, which said officers will consist of the Crime Prevention Officer, the Police Athletic League Officer, and the Drug Abuse Resistance Education Officer. The Chief shall meet Page 1 EXHlBlT A quarterly with the Executive Director of the Housing Authority, or her designee, in order to review progress of the grant and discuss recommendations for improvements, if needed. 3. Police Officers of the City of Paris shall strive to walk, ride bicycles, and utilize the patrol unit, or any other mechanism and equipment, to police the PHA housing in a community policing effort to improve the safety of residents and relationship between residents and law enforcement, with a primary objective being to eliminate illegal drugs, their use and trafficking. 4. PHA agrees to pay and CITY agrees to accept $39,762.00 for one year of said service. 5. This agreement shall be effective and the term hereof shall commence on the 1 st day of February, 2000, and shall end on the 31st day of January, 2001. 6. In the event that PHA desires continued community policing drug elimination services beyond the term of this agreement, PHA shall give written notice to CITY on or before ninety (90) days before the termination date of this agreement of its desire for such service for an additional term, and, upon receipt of said notice, CITY will assist in making application for grants, if available. If no grant is available, City will deliver to PHA, within thirty (30) days, the annual cost at which City could deliver services, and thereafter, on or before thirty (30) days from the termination date of this agreement, PHA will execute the agreement for services for an additional annual term upon the same terms and conditions as stated herein at the cost stated in the new agreement.
