2000-011-RES AUTHORIZING THE EXECUTION OF AN INTERLOCAL GOVERNMENTAL AGREEMENT RESOLUTION NO. 2000-011 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS, AUTHORIZING THE EXECUTION OF AN INTERLOCAL GOVERNMENTAL AGREEMENT FOR DRUG ELIMINATION AND PREVENTION WITH THE HOUSING AUTHORITY OF THE CITY OF PARIS; PROVIDING FOR SERVICES BY AND THROUGH THE POLICE ATHLETIC LEAGUE; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, funding for community policing and drug elimination and prevention services has become available to the Housing Authority of the City of Paris through the Public and Indian Housing Drug Elimination Program, and the Housing Authority has asked the City of Paris to provide, by and through the Police Athletic League, round-trip transportation and other services for children in public housing in an effort to remove them daily from the public housing sites and any crime and drug-related activity that might occur there, and it is deemed to be in the best interests of the residents of public housing that said services be provided; and, WHEREAS, the Interlocal Governmental Agreement for Drug Elimination and Prevention between the City of Paris and the Housing Authority, attached hereto as Exhibit A, should, in all things, be approved, and the City Manager, Michael E. Malone, should be authorized to execute the same; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS: Section 1. That the findings set out in the preamble to this resolution are hereby in all things approved. Section 2. That the form of the Interlocal Governmental Agreement for Drug Elimination and Prevention between the City of Paris, acting by and through the Police Athletic League, and the Housing Authority, attached hereto as Exhibit A, be, and the same is hereby, approved. Section 3. That the City Manager, Michael E. Malone, be, and he is hereby, authorized and directed to execute, on behalfofthe City of Paris, the Interlocal Governmental Agreement, upon the terms and conditions and in the form shown in Exhibit A, attached hereto. Section 4. That this resolution shall be effective from and after its date of passage. Charles H. Neeley, Mayor ATTEST: ~ ~tr\..> ~"-~. _ ~~~ Mattie Cunningham, City Clerk APPROVED AS TO FORM: INTERLOCAL GOVERNMENTAL AGREEMENT FOR DRUG ELIMINATION AND PREVENTION BETWEEN THE CITY OF PARIS AND THE HOUSING AUTHORITY OF THE CITY OF PARIS STATE OF TEXAS ) ) ) KNOW ALL MEN BY THESE PRESENTS: COUNTY OF LAMAR THAT, the CITY OF PARIS, PARIS, TEXAS, a municipal corporation, acting by and through its City Manager, Michael E. Malone, duly authorized, hereinafter called CITY, and the HOUSING AUTHORITY OF THE CITY OF PARIS, TEXAS, a public housing authority, acting by and through its Chairman, Curtis Fendley, duly authorized, hereinafter referred to as PHA, do hereby contract and agree as follows: I. CITY covenants and agrees that it will travel to each public housing site owned by the PHA six (6) days per week for each week of the contract period and pick up children who reside in public housing, targeting children from ages thirteen (13) to eighteen (18) years old, and transport them to the Police Athletic League for educational, recreational, or other constructive activities in an attempt to remove them from the public housing sites and any crime and drug- related activity that might occur there. To accomplish this, CITY agrees to provide round-trip transportation from the public housing sites, along with all related costs, in the amount of four thousand nine hundred sixty (4,960) miles over the contract period, CITY also agrees to provide a part-time driver-recreation aide for six and one-quarter (6,25) hours per week at $7.00 per hour for each week of the contract period, totaling three hundred twenty-five (325) hours. Hours of pick-up and return of children are to be scheduled weekly as agreed between the Director of the Police Athletic League, or designee, and the Executive Director of the Housing Authority of the I EXHIBiT A City of Paris, or her designee, and reduced to a written schedule in the form of Exhibit A, attached hereto; and the schedule may be amended upon agreement of the same parties. In the event CITY does not have available transportation, CITY shall, in the alternative, provide only the part-time recreation aide at the compensation and for the hours stated above, and PHA shall provide the transportation. If it becomes necessary for PHA to provide such transportation services, the amount for mileage stated herein shall be excluded from the amount paid to CITY, 2. PHA agrees to pay and CITY agrees to accept $4,543.00 for one year of said service as follows: only in the event CITY has available transportation, $1,488.00 for four thousand nine hundred sixty (4,960) miles of round-trip transportation from public housing; $2,275.00 for three hundred twenty-five (325) hours of service by the part-time driver-recreation aide; and $780.00 for membership fees for seventy-eight (78) children at $10.00 per child. 3. This agreement shall be effective and the term hereof shall commence on the 1st day of February, 2000, and shall end on the 31st day of January, 2001. 4. In the event that PHA desires continued services beyond the term of this agreement, PHA shall give written notice to CITY on or before ninety (90) days before the termination date of this agreement of its desire for such service for an additional term, and, upon receipt of said notice, CITY will assist in making application for grants, if available. If no grant is available, CITY will deliver to PHA, within thirty (30) days, the annual cost at which CITY could provide services, and thereafter, on or before thirty (30) days from the termination date of this agreement, PHA will execute the agreement for services for an additional annual term upon the same terms and conditions as stated herein at the cost stated in the new agreement. 2 Executed this 3rd day of February, 2000.
