09/18/2017 MINUTESMINUTES OF THE REGULAR MEETING OF THE BUILDING AND STANDARDS COMMISSION MONDAY, SEPTEMBER 18, 2017 3:30 P.M. 1. Johnny Norris called the Building and Standards Commission Meeting to order at 3:30 P.M. Roll was called. A. The following members were present: Matthew Allen Sally McEwin Johnny Norris Ben Vaughan Mike Folmar Ken Kohls B. Staff present: Robert Talley Stephanie Harris Larry Wright Clyde Crews Debra Burge C. Others present: Joyce Freeman 2. Approval of minutes from previous meeting. (August 21, 2017) Motion made by Ben Vaughan, seconded by Sally McEwin to approve minutes. Motion carried unanimously. 6-0 3. Public Hearing to consider presentations by City of Paris Code Inspectors and owner(s) and/or lien holder(s) of the below properties who have been given notice of a violation of Article III of Chapter 7 of the Code of Ordinances of the City of Paris, Paris, Texas, entitled "Substandard and Dangerous Buildings and Structures;" Article II of Chapter 17, entitled "Control of Weeds, Junk, and Other Objectionable, Unsightly, or Unsanitary Matter of Private Premises;" Chapter 1-6 of the Code of Ordinances of the City of Paris, Paris, TX: A. 3508 1h NE; City Block 67, Lot 3 Owner: Joyce Freeman, 2211 E Polk, Paris TX 75460 Robert Talley stated property owner is present. Property is in disrepair. Old lumber in yard. Roof covering beginning to buckle. Needs to be repaired/replaced. Shed in back, hole in back of roof from tree falling onto it. Unsecure. Owner would like to repair main structure, agrees back structure needs to be demoed. Robert Talley's recommendation: Repair main structure within 60 days or back to BSC. Demo back structure. Joyce Freeman, 2211 E Polk. House was rented when tagged. Tenant went to Dallas for family medical, and could not reach him. Went over and cleaned up house and yard as best could do. Commission questions. Q — Has Mr. Talley explained his recommendation on this property? A — Yes. House is level, roof does not leak, could put metal roof over it. Last renter pulled roof off carport. Q — What can BSC do to help you? A — Would like to see someone take care of vandals. Q — This commission is concerned with order on this property to repair within 60 days. Will you be able to do that? A — Going to try. Q — No problem with demoing structure in back? Are you going to do it or have city do it? A — No, not going to have city do it. Q — Is intention to get house in rentable condition? A — Rented now. Tenant has been evicted. Q — Is carport roof included in repair? A — Yes. Motion was made by Mike Folmar, seconded by Ken Kohls to accept Robert's recommendation. Motion carried. 6-0 B. 3398 th NE; City Block 64-B, Lot 17 Owner: Glenn Jensen, 339 8' NE, Paris TX 75460 Robert Talley stated Code Enforcement has dealt with this property in the past. Were waiting for tenant to vacate. Roof covering beginning to peel, sag, buckle. Unsecure. Trash and rubbish inside. Large portion of floor missing in living room. Indication inside roof is leaking. Shed in back had tree fall onto it. Robert Talley's recommendation: Declare a nuisance, demo within 30 days, or the city has a right to do so. Commission questions. Q — No communication with owner? A — In the past, we dealt with the tenant who was a relative of the owner. But she had some mental issues that caused her to not remember conversations we had with her regarding the property. Q — Where does she live? A — No sure. Q — Did letter come back? A — Not yet. Q — How long have you been working with this house? A — About 4 years. Motion made by Sally McEwin, seconded by Matthew Allen to accept Robert's recommendation. Motion carried unanimously. 6-0 C. 988 W Sherman; City Block 131, Lot 25 Owner: M E Darnell Sr, 961 W Sherman, Paris TX 75460 Stephanie Harris: Items 3.C., 3.D., 3.E., & 3.17. are properties we've addressed before. Last time before BSC, we did not issue an order to abate. So we need to issue that order for us to move forward. Robert Talley's recommendation: Clean up within 30 days, or the city has a right to do so. Motion was made by Sally McEwin, seconded by Ken Kohls to abate these 4 properties. Motion carried unanimously. 6-0 D. 943 W Sherman; City Block 133, Lot 3 Owner: M E Darnell Sr, 961 W Sherman, Paris TX 75460 Robert Talley's recommendation: Clean up within 30 days, or the city has a right to do so. Motion was made by Sally McEwin, seconded by Ken Kohls to abate these 4 properties. Motion carried unanimously. 6-0 E. 951 W Sherman; City Block 133, Lot 2 Owner: M E Darnell Sr, 961 W Sherman, Paris TX 75460 Robert Talley's recommendation: Clean up within 30 days, or the city has a right to do so. Motion carried unanimously. 6-0 F. 961 W Sherman; City Block 133, Lot 1 Owner: M E Darnell Sr, 961 W Sherman, Paris TX 75460 Robert Talley's recommendation: Clean up within 30 days, or the city has a right to do so. Motion carried unanimously. 6-0 G. 625 W Washington; City Block 154, Lot 1 Owner: Family Haven Crisis, c/o Jeffrey McIntosh Chicago IL, 830 6`t' SW, Paris TX 75460 Robert Talley stated no contact with anyone representing owner, Family Haven. Large tree has fallen through roof and collapsed part of it. Unsecure. Trash and rubbish inside. Mold on ceilings. Robert Talley's recommendation: Declare nuisance, demo within 30 days, or city has right to do so. Commission questions. Q — Does this need to be moved up? How long has it been like this? A — Not sure. Motion was made by Johnny Norris, seconded by Mike Folmar to accept Robert's recommendation. Motion carried unanimously. 6-0 H. 646 Pine Bluff, City Block 35, Lot 3 Owner: Nadine Ausbie, 646 Pine Bluff, Paris TX 75460 Robert Talley stated spoken with owner. Does not want to demo, wants to repair. If repairs don't start soon, it will need to be demoed due to condition. Willing to give 90 days; if repairs not started, consider civil penalties. Siding is busting off and cracking. Exterior wood beginning to deteriorate and rot. Owner does not currently live there, but wants to repair and move back. Covering over front porch beginning to buckle and fall. Signs foundation is beginning to sink. Needs new roof. Robert Talley's recommendation: Repair within 90 days, including roof, foundation, missing and deteriorated wood, or back to BSC. Commission: Would like to reach out to groups/people in the community who help out people like Ms. Ausbie to assist in repairing this house. Motion was made by Ken Kohls, seconded by Matthew Allen to accept Robert's recommendation. Motion carried unanimously. 6-0 I. 115316 1h SE; Gibbons -Braden Addition Block 13, Lot 12 Owner: Janice Buetikofer, 509 CR 34300, Brookston, TX 75421 Robert Talley stated property is a total burn out. Unsecure. No contact with owner. Fire Marshal has had no contact with owner, just last tenant. Robert Talley's recommendation: Declare nuisance, demo within 30 days, or city has right to do so. Motion was made by Johnny Norris, seconded by Ben Vaughan to accept Robert's recommendation. Motion carried unanimously. 6-0 4. Code Enforcement update. 6 structures demoed last month. 533 E Price; this property was held up in court, but finally got demoed. 5. Future agenda items. Q — Update on bank and Kamer building. A — Bank building, the wall that came before this commission has been taken down. A — Have demo order ready to do on Kamer building, just need council to allocate funds to move forward. Q — Several buildings 3rd & 4th block of Bonham, North side of road in bad condition. A — 300 block, demo permits have been pulled; had dumpsters and were working on removing roof. Q — 29th NE, 200 300 blocks; please check out grass and weeds. Q — Structure on S Church next to land company. A — Will check all of S Church. Election of officers on next month's agenda. 6.
