SUBJECT: SPECIAL ELECTION CANVASSING OF RETURNS
DATE: November 8, 2017
BACKGROUND: On July 24, 2017 by ordinance number 20'17-028, City Council ordered a
special election for the purpose of voters to consider one proposition,
STATUS OF ISSUE: On November 7, 2017, the voters of the City of Paris, voted on Proposition
A for the abolition of a sales and use tax for the promotion and development of new and
expanded business enterprises at the rate of one-fourth of one percent within the City of Paris,
Texas,, as, permitted and authorized under the Local Government Code, Chapter 501, Type A
Corporations, and the adoption of a local sales and use tax in the City of Paris, Texas at the rate
of one-fourth of one percent to provide for maintenance and repair of municipal streets. The
proposition failed, with 420 votes cast for the proposition and 1,150 votes cast against the
proposition.
BUDGET: There is no impact on the budget.
RECOMMENDATION: Approve the resolution canvassing the returns for the Special Election
as required by State Law.

that the Resolution be passed; and, after due discussion, the motion, carrying with it the passage

2. That a true, full and correct copy of the aforesaid Resolution passed at the Meeting
described in the above and foregoing paragraph is attached to and follows this Certificate; that

and foregoing paragraph is a true, full and correct excerpt from the Council's minutes of the
Meeting pertaining to the passage of the Resolution, that the persons named in the above and
foregoing paragraph are the duly chosen, qualified and acting officers and rnernbers, of the

RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS,
CANVASSING THE RETURNS FOR THE NOVEMBER 7, 2017, SPECIAL
ELECTION REGARDING THE ABOLITION OF THE SALES AND USE TAX
FOR ECONOMIC DEVELOPMENT AND THE ADOPTION OF A SALES AND
USE TAX FOR THE REPAIR AND MAINTENANCE OF STREETS IN THE CITY
OF PARIS, TEXAS; MAKING OTHER FINDINGS AND PROVISIONS
RELATED TO THE SUBJECT
WHEREAS, this City Council ordered a special election to be held in said City on
Noven-iber 7, 2017 on the proposition hereinafter stated, and
WHEREAS, said City, Council has investigated all matters pertaining to said special
election, including the ordering. giving notice, appointing election officers, holding and making
returns ofsaid special election; and
WHEREAS, the election officers who held said special election have duly made the
returns of the result thereof, and said returns have been duly delivered to said City Council.
WHEREAS, it is hereby officially found and deteri-nined that the ineeting at which this
Resolution was adopted was open to the public, and public notice of the time,, place and purpose
of said meeting was given, all as required by Chapter 55 1, Texas Government Code.
THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PARIS, TEXAS:
I. That the City Council officially finds and determines that said special election was
duly ordered, that proper notice of said special election was duly given. that proper election
officers were duly appointed prior to said special election, that said special election was duly
held, that the City has complied with the Texas Election Code, that due returns of` the result of
said special election have been made and delivered, and that the City Council has duly canvassed
said returns, all in accordance with law and the Resolution calling said special election.
2. That the City Council officially finds and determines that the following votes were
cast at said special election, on the submitted PROPOSITION by the resident, qualified electors
of said City, who voted at the special election:
CITY OF PARIS PROPOSITION A
THE ABOLITION OF A SALES AND USE TAX FCR THE
PROMOTION AND DEVELOPMENT OF NEW AND
FOR 420 EXPANDED BUSINESS ENTERPRISES AT THE RATE OF

OF A LOCAL SALES AND USE TAX IN THE CITY OF
AGAINST 1,150 PARIS, TEXAS AT THE RATE OF ONE-FOURTH OF ONE

3. That the City Council officially finds, determines and declares the result of said
special election to be that a majority of the vote was cast AGAINST the aforesaid
PROPOSITION A, and that PROPOSITION A therefore has FAILED.
PASSED AND APPROVED, by a vote of for and against, this 13"' day November,
2017.
