2006MINUTES OF THE REGULAR MEETING OF THE BUILDING AND STANDARDS COMMISSION Monday, March 20, 2006 4:00 P.M. 1. Chad Brown called the Building and Standards Commission Meeting to order at 4:00 P.M. Roll was called. A. The following members were present: Pike Burkhart, Alternate Chris Brown, Alternate Chad Brown Stephen Brown, Alternate Harrell Tippitt Mary Crumpler (arrived at 4:05) Zach Saffle, Alternate Ryan Lassiter B. The following members were absent: Brad Archer Greg Wilson Lucius Joe, Jr. Chairman Chad Brown reported for the records that Pike Burkhart, Zach Saffle, Chris Brown, and Stephen Brown would be seated as voting members since there were not enough regular members to make a quorum. 2. Approval of Minutes of previous meeting: A motion was made by Harrell Tippitt to approve the meeting minutes, and Chad Brown seconded the motion. The motion carried 7 -0. Mary Crumpler joined the meeting. 3. Public Hearing to consider presentations by City of Paris Code Inspectors and owner(s) and /or lien holder(s) of the below properties who have been given notice of a violation of Article III of Chapter 7 of the Code of Ordinances of the City of Paris, Paris, Texas, entitled "Substandard and Dangerous Buildings and Structures ": D. 4025 Clarksville and Highway 271; Lot 1, City Block 347 Don Hevron, 2910 Clark Lane, stated that the house is structurally sound. The section with the holes in the roof have been taken off. In the back where there is sagging, there were four windows —it will be put back. The house is being used for storage. The front porch has been removed and hauled off. All windows are secure. Mr. Hevron needs 30 days from the end of next month to make repairs. He plan to eventually put on a metal roof. A motion was made by Steve Brown, seconded by Pike Burkhart, Sr. For the property to be repaired within 60 days and brought back to the May 16 meeting for reconsideration. Motion carried unanimously. A. 555 20th Street S.E.; Part of Lot 10 and Lots 11 and 12, Block 6, Highland Park Addition Motion was made by Chad Brown, seconded by Ryan Lassiter for the property to be demolished within 30 days with a $1,000 per day civil penalty, and if the property is not demolished within the 30 day time period, the City will demolish. Motion carried unanimously. B. FM 195; Lot 13, City Block 322 Motion was made by Chad Brown, seconded by Chris Brown for the property to be demolished within 30 days with a $1,000 per day civil penalty, and if the property is not demolished within the 30 daytime period, the City will demolish. Motion carried unanimously. C. FM 139; Lot 11, City Block 322 Motion was made by Ryan Lassiter, seconded by Mary Crumpler for the property to be demolished within 30 days with a $1,000 per day civil penalty, and if the property is not demolished within the 30 day time period, the City will demolish. Motion carried unanimously. E. 1124 W. Cherry; Lot 4, City Block 84 Motion was made by Chris Brown, seconded by Steve Brown for the property to be demolished within 30 days with a $1,000 per day civil penalty, and if the property is not demolished within the 30 daytime period, the City will demolish. Motion carried unanimously. F. 1354 3rd Street S.W.; Lot 6, City Block 171 Motion was made by Mary Crumpler, seconded by Zach Saffle for the property to be demolished within 30 day with a $1,000 per day civil penalty, and if the property is not demolished within the 310 day time period, the City will demolish. Motion carried unanimously. G. 1366 3rd Street S.W.; Lot 7, City Block 171 This structure is right beside Rodgers -Wade. The roof is buckling and limbs from the trees have fallen through. The house is pulling loose from the chimney. The structure is unsecured with a rotten shed. Ms. Robert E. Lee's wife called and said that he is deceased. Motion was made by Steve Brown, seconded by Harrell Tippitt for the property to be demolished within 30 days with a $1,000 per day civil penalty, and if the property is not demolished within the 30 day time period, the City will demolish. Motion carried unanimously. 4. Status report related to properties on which the Commission has previously issued orders. Robert Talley presented the memo to the Commission. Public Hearing to consider presentations by City of Paris Code Inspectors and owner(s) and /or lien holder(s) of the below properties who have been given notice of a violation of Article III of Chapter 7 of the Code of Ordinances of the City of Paris, Paris, Texas, entitled "Substandard and Dangerous Buildings and Structures ": A. 5000 Block of Lamar Avenue; Lot 10, City Block 315 -A Bob Skidmore, owner of the structure, stated that he told his tenant, George House, a 1 %Z ago that the house needed to be torn down. Mr. Skidmore has no objection to tearing the house down. Motion was made by Ryan Lassiter, seconded by Harrell Tippitt for the property to be demolished within 30 days with a $1,000 per day civil penalty, and if the property is not demolished within the 30 day time period, the City will demolish. Motion carried unanimously. B. 5010 Lamar Avenue; Tract 10,1 Moore Survey Bob Skidmore stated that he did not know the structure was in the city limits. He will tear the house down. Motion was made by Chad Brown, seconded by Ryan Lassiter for the property to be demolished within 30 days with a $1,000 per day civil penalty, and if the property is not demolished within the 30 day time period, the City will demolish. Motion carried unanimously. C. 25 31' Street SE; Lot 1, City Block 285 Motion was made to recuse Zach Saffle by Chad Brown, seconded by Mary Crumpler. Motion carried unanimously. Chris Brown made a motion, seconded by Harrell Tippitt that the structure be repaired (broken windows replaced) within 30 days with a $1,000 per day civil penalty, and if the property is not repaired within the 30 day time period, the City will make the repairs. Motion carried unanimously. Motion was made for Zach Saffle to return to the meeting by Chris Brown, seconded by Ryan Lassiter. Motion carried unanimously. D. 1274 15' Street SE; Lots 3 & 4, Block 8, Gibbons - Braden Addition Motion was made by Steve Brown, seconded by Chad Brown for the property to be demolished within 30 days with a $1,000 per day civil penalty, and if the property is not demolished within the 30 daytime period, the City will demolish. Motion carried unanimously. E. 57815 Ih Street SE; Lots 7 & 8 -A, City Block 112 -C The owners want to tear the structure down but finances are holding them up. They are willing to start on it. The garage is the only part of the structure needing to be torn down since a tree fell through it. The tree was removed but the garage is still falling in. Motion was made to by Chad Brown, seconded by Harrell Tippitt for the property (garage only) to be demolished within 30 days with a $1,000 per day civil penalty, and if the property is not demolished within the 30 day time period, the City will demolish. Motion carried unanimously. 4. Status report related to properties on which the Commission has previously issued orders. Lisa Wright presented the report to the Commission. She advised the Commission that over sixty -five houses have been either demolished by the City or delivered to the contractor for demolition by the City. She also advised that numerous structures have been voluntarily demolished. Lisa Wright advised the Commission that Pike Burkhart is no longer a member of the Building and Standards Commission, therefore, his position is vacant. Also, Greg Wilson has submitted his resignation. She requested that Board members contact her if they wish to recommend someone. She also requested that any alternate wanting to move into a regular slot contact her to make that wish known. 5. Meeting adjourned at 4:30 P.M. Motion carried unanimously. B. 945 W. Garrett Street; Lot 3, City Block 101 Ruben Gray now owns this house. Mr. Gray just got possession of the structure. He has been trying for 3 years to get it down but has been sick. He will demolish the structure and salvage the lumber. Motion was made by Chris Brown, seconded by Ryan Lassiter for the property to be demolished within 30 days with a $1,000 per day civil penalty, and if the property is not demolished within the 30 day time period, the City will demolish. Motion carried unanimously. C. 935 W. Garrett Street; Lot 2, City Block 101 Mr. Gray said that the front is sound but the doors have been kicked in and the windows are broken out. The wiring has been stripped. Mr. Gray has repeatedly secured.the house. Mr. Gray would. like to take the back part off and eventually expand the house. Motion was made by Stephen Brown, seconded by Chris Brown to accept Robert Talley's recommendation that the property to be demolished within 30 days with a $1,000 per day civil penalty, and if the property is not demolished within the 30 day time period, the City will demolish. Motion carried unanimously. D. 519 5th. Street NW; Lot 5, City Block 82 Motion was made by Chris Brown, seconded by Ryan Lassiter for the property to be demolished within 30 days with a $1,000 per day civil penalty, and if the property is not demolished within the 30 daytime period, the City will demolish. Motion carried unanimously. E. 951 7th Street NE; Lot 8, City Block 72 -C The back of this house is worse than the front. The house is abandoned and the door is open. Motion was made by Ryan Lassiter, seconded by Chris Brown for the property to be demolished within 30 days with a $1,000 per day civil penalty, and if the property is not demolished within the 30 day time period, the City will demolish. Motion carried unanimously. F. 944 7th Street NE; Lot 1 -B, Block 4, Pickard Addition Motion was made by Stephen Brown, seconded by Chad Brown for the property to be demolished within 30 days with a $1,000 per day civil penalty, and if the property is not demolished within the 30 day time period, the City will demolish. Motion carried unanimously. G. 1133 16th Street SE; Lot Pt. 10, Block 13, Gibbons - Braden. Addition Motion was made by Chad Brown, seconded by Chris Brown for the property to be demolished within 30 days with a $1,000 per day civil penalty, and if the property is not demolished within the 30 daytime period, the City will demolish. Motion carried unanimously. H. 113916th Street SE, Lots l0A & 11, Block 13, Gibbons- Braden Addition The owner told Todd Varner that he would not do anything with the property. Motion was made by Ryan Lassiter, seconded by Stephen Brown for the property to be demolished within 30 days with a $1,000 per day civil penalty, and if the property is not demolished within the 30 day time period, the City will demolish. Motion carried unanimously. L 1055 22nd Street NE; Lot 15, Block 7, Hillcrest Addition The lienholder .has made an insurance claim and they plan to repair the house. Robert Hart, 603 N. Main, stated that he has a proposal from contractor Stephen Carter. The contractor gave no time frame for the repair. Motion was made by Ryan Lassiter, seconded by Stephen Brown to allow 120 days for repair or demolish the property within 120 days with a $1,000 per day civil penalty. If the property is not demolished within the 120 day time period, the City will demolish. Motion carried unanimously J. 923 Graham Street; Lot 6, City Block 46 This is a burned out structure that used to be a church. The owner wants to save what he can and turn it into a storage building. Bobby Stillwell, 647 S.W. 1 st, stated that he has already started work on the project. He wants to build a new house to the east of the property. He will secure the doors. Motion was made by Chad Brown, seconded by Ryan Lassiter to allow 60 days for repair or the property is to be demolished within 60 days with a $1,000 per day civil penalty, and if the property is not demolished within the 60 day time period, the City will demolish. Motion carried unanimously. K. 971 & 973 W. Kaufman; Lot 1, City Block 129 -A Motion was made by Stephen Brown, seconded by Chad Brown for the property to be demolished within 30 days with a $1,000 per day civil penalty, and if the property is not demolished within the 30 day time period, the City will demolish. Motion carried unanimously. L. 1317 Bonham; Lot 1, City Block 128 The:owner of the property moved off. The roof is gone from the structure. The owners said that they want to repair the structure but there has been no word from them. Motion was made by Chris Brown, seconded by Stephen Brown for the property to be demolished within 30 days with a $1,000 per day civil penalty, and if the property is not demolished within.the 30 day time period, the City will demolish. Motion carried unanimously. M. 753 E. Polk; Lot E -27 - 23 All 24, Block 2, Gibbons Park The °owner wants to repair. Don Gore was present on behalf of the owner. The tenant is doing repairs now. Mr. Gore wants to repair with fiberglass and the roof will be a tin roof. Don Gore, 840 Hearon, has been working the last couple of days on the property. He will be putting on tin roofing that will not be available until 30 days. He can start on the support work and should be able to finish within 60 - 90 days. Motion was made by Chad Brown, seconded by Chris Brown to allow 60 days for repair or the property is. to be. demolished within 60 days with a $1,000 per day civil penalty, and if the property is not demolished within the 60 day time period, the City will demolish. Motion carried unanimously. Lisa Wright advised Mr. Gore that he must contact the Building Division to get a roofing permit, and the materials used must comply with Code. She further advised that the entire house must pass Code or any work done will not qualify the house to be spared from demolition. 4. Status report related to properties on which the Commission has previously issued orders. Lisa Wright advised the Commission that, with a combination of voluntary demolitions and demolitions done by the City, approximately 100 houses had been torn down over the past several months. She also advised the Commission that she and Todd Varner had recently inspected the interior of the Faber house on 31 st S.E. under an administrative search warrant. She stated that the house was in very poor condition and may not be salvageable. She advised the Commission that this house, although unique and potentially historic, may be brought before the Commission at some point in the future. 5. Meeting adjourned at 4:50 P.M. Public Hearing to consider presentations by City of Paris Code Inspectors and owner(s) and /or lien holder(s) of the below properties who have been given notice of a violation of Article III of Chapter 7 of the Code of Ordinances of the City of Paris, Paris, Texas, entitled "Substandard and Dangerous Buildings and Structures ": E. 440 13th Street NW; Lot 4, Block 1, Gorham Addition - Calvin Gibson, 960 S. Main, spoke stating that there is a lot of work to be done to the front porch. The pictures were probably taken after the house was made into a duplex. Mr. Gibson would like time to redo what his tenant is doing. He said that as single man he will not be able to get the work done in 30 days. He can take a room at a time, work at it for about 6 months, and get it ready to live in. Motion was made by Chad Brown to allow 60 days to repair or demolish, seconded by Steve Brown. If the repairs are not made within 60 days, the city will demolish with a $1,000 per day civil penalty. Motion carried unanimously. L. 337 E. Washington; Lot 14, City Block 146 - The house to the east of this property caught on fire and the fire spread to this property and burned out the side. Mr. Doug Kelley, 1685 CR 42400, the owner, stated that the property is tied up in court. Mr. Kelley said that the house needs tearing down. He sold the house in 1998 to Dan and Rita Kirkland. The people have only about 2 years to pay it off. The house caught fire on July 1, and on July 25 Mr. Kelley had a bid to tear the house down. Mr. Kelley was served with a lawsuit and which delayed the demolition. Mr. Kelley is asking for an extension until it is through the courts. Robert Talley stated that the entire west side is probably secured. John Lestock recommended that the Commission continue this matter 30 days to the next meeting to determine if the litigation will take a long time or short time. Motion made by David Nabors, seconded by Steve Brown to table for 30 days to look at it again. Motion carried unanimously. O. 1600 W. Shiloh; Lot 16, Block 6, Colonial Addition - Ms. Rosemary Watson, Ms. Dake's daughter, 640 W. Connor, spoke on her behalf stating that her mother passed away. They have a potential buyer but she has a brother they will have to try to contact. Ms. Watson would like a 30 day extension. The house is secured. Motion was made by Chad Brown, seconded by Zach Saffle to allow 60 days for demolition and if the structure is not demolished within 60 days, the City will demolish with a $1,000 per day civil penalty. Motion carried unanimously. M. 2193 E. Cherry; Lot 1, City Block 258 -A - The owner of this property is Joe Grizzle. There has been no contact with Mr. Grizzle. The windows are broken out and the inside is in bad shape — probably 70 -80% gutted. Robert Talley stated the property was probably a drug haven. Chad Stevens, 3935 Miranda Drive, for Re- Max stated that he is trying to work out a deal to sell the property. Mr. Stevens is an intermediary between the buyer and seller, he does not represent either. Mr. Stevens had a letter of intent to purchase the property dated September 9, 2006. The buyer and seller have, agreed but there are some financial issues with the buyer. The seller asked Mr. Stevens to speak on his behalf to inform and verify that there is a contract versus just the word of mouth from the seller himself. Motion was made by David Nabors, seconded by Chris Brown to allow 90 days to repair or demolish. If the property is not repaired or demolished within 90 days, the City will demolish with a $1,000 per day civil penalty. Motion was made to amend the previous motion by Harrell Tippitt, seconded by Lucius Joe to include that the property be completely secured within 14 days. Motion carried unanimously. J. 627 14th Street NE; Lot 7, Block 3, Hicks 1st Addition - Motion was made to recuse David Nabors by Chad Brown, seconded by Lucius Joe. Motion carried 10 -0. Motion was made by Mary Crumpler, seconded by Harrell Tippitt to allow 30 days for demolition. If it is not demolished within 30 days, the City will demolish with a $1,000 per day civil penalty. He advised that he is selling the house effective January 1. Motion was made by Chad Brown, seconded by Lucius Joe, to allow 14 days to secure the property. If the property is not secured, the City may secure, with a $1,000 per day civil penalty. Motion carried unanimously. Motion was made by David Nabors, seconded by Chad Brown, to allow 90 days to repair or demolish. If the repairs are not made within 90 days, the City will demolish, with a $1,000 per day civil penalty. Motion carried unanimously. A. 762 6th Street S.E.; Lot 6, City Block 145 Motion was made by Chad Brown, seconded by Mary Crumpler, to allow 30 days to demolish. If the property is not demolished within 30 days, the City may demolish, with a $1,000 per day civil penalty. Motion carried unanimously. B. 605 and 60910th Street S.E.; North Part of Lot 14 and Lot 15, City Block 113 -A - Motion was made by Chad Brown, seconded by Harrell Tippett, to allow 30 days to demolish. If the property is not demolished within 30 days, the City may demolish, with a $1,000 per day civil penalty. Motion carried 9 -0 (David Nabors abstained due to personal knowledge of the property owners). C. 3050 W. Campbell; Lot 1, City Block 326 - Motion was made by David Nabors, seconded by Mary Crumpler, to allow 30 days to demolish. If the property is not demolished within 30 days, the City may demolish, with a $1,000 per day civil penalty. Motion carried unanimously. D. 67 11th Street N.W.; Lots 3 and 4, City Block 47 - Motion was made by Lucius Joe, seconded by Harrell Tippett, to allow 60 days to demolish. If the property is not demolished within 60 days, the City may demolish, with a $1,000 per day civil penalty. Motion carried unanimously. E. 1211 Ith Street N.W.; Lot 2, City Block 47 - Motion was made by David Nabors, seconded by Mary Crumpler, to allow 30 days to demolish. If the property is not repaired within 30 days, the City may make necessary repairs, with a $1,000 per day civil penalty. Motion carried unanimously. H. 26 2nd Street N.E.; Part of City Block 18, Original Donation (For Repair Only) - Motion was made by Chad Brown, seconded by David Nabors, to allow 30 days to repair. If the property is not repaired within 30 days, the City may make necessary repairs, with a $1,000 per day civil penalty. Motion carried unanimously. J. 1000 30th Street N.W.; Lot 4, City Block 325 - Motion was made by Mary Crumpler, seconded by David Nabors, to allow 30 days to demolish.
