The City Council of the City of Paris met for a regular session at 5:30 p.m. on Monday,
November 13, 2017, at the City Council Chamber, 107 E. Kaufi-nan, Paris, Texas.

Opening Agenda
Call meeting to order.
Mayor Clifford called the meeting to order at 5:30 pm.
2. Invocation.
Gene Anderson gave the invocation,
1 Pledge of Allegiance.
Council Member Drake led the pledge.
4, A. CCitizens' Forum,
Bryan Raney, 1.425 S. Church, Blankenship Oil — fie said he was speaking about item 14.
He told City Council that they were a local company and everything they did was in the
community. He also said they were the low bidder. Mayor Clifford inforined Mr. Raney he had
been speaking for two minutes but that he would be allowed to speak when they got to itern 14.
Don Wilson, 3110 Stacy Lane — he questioned the streets that were selected for bond
money and said the streets scheduled for repair were all in one district. He referenced 7"'
Northwest Street and Cherry Street between 20t" and 25`" Streets, and said Cherry should not be
placed ahead of streets in his district. Mr. Wilson also said there were other streets more heavily

traveled and they were not on the master plan. He requested this be placed on a further agenda
for discussion,
B. Proclamation declaring Noveumber 2017 as Hospice Care Month.
Mayor Clifford read the proclamation and presented it to representatives from Cypress
Basin Hospice.
Consent Agenda
Mayor Clifford inquired of Council Members if they wished to pull any items from the
consent agenda for discussion. Council Member Knox asked that item 6B be pulled for
discussion. She referenced a resolution attached to the Historic Preservation Cominission
minutes of October 11, and asked if they were approving this resolution at this meeting. Council
Member Knox said HPC had been working on this for several months and it was time to present
it to City Council for action. City Attorney Stephanie Harris said they were not approving this
resolution but it could be placed on a future agenda. Council Member Knox questioned why it
was not on their agenda when the Ceff,co item was, just approved and presented to, them.
Following additional discussion, Mr. Godwin explained the minutes frorn boards were being
received by City Council, not approved. Mr. Godwin said the resolution would be on their next
agenda.
A Motion to approve the consent agenda was made by Council Member Portugal and
seconded by Council Member Trenado. Motion carried, 6 ayes — 0 nays.
5. Approve minutes from the meeting on November 13, 2017.
G. Receive reports and/or minutes frorn the following boards, commissions, and committees:
a. Paris Economic Development Corporation (9-22-2017)
b. Historic Preservation Coiniiiission(IO-11-2017)
c. Paris Public Library Advisory Board (9-20-2017)
d. Airport Advisory Board (7-20-2017 & 9-21-2017)
7. Receive September monthly financial report.
8. Approve the Final Plat of Lot 1, Block A, Church Street Homestead City Block 159,
located at 1031 South Church Street.
9. Approve the Master Plat for The Hills, located on the northwest side of FM 195,.
10. Approve the Re -plat of Lots 3A and 3B, Block A, CEFCO 4 1097 Addition 313, located
in the 5200 Block of Southeast Loop 286.

Authorize the City Manager to execute a Ground and Tower Lease Agreement with T -
Mobile West, LLC for the purpose of installing telecommunications at the West Water
Tower site, 2009 Bonham Street, City of Paris, Block 205, Lots 3 & 4,
12. Reject all bids for construction. of the new EMS Station.

13. Conduct a public hearing, discuss and act on an Ordinance considering the petition of
Eddy Thomas for a change in zoning from a Single Family Dwelling District No. 2 (S,F-
2) to a Mixed Use Planned Development District (PD�), on Lots 7-A and part of 8, City
Block 331, being located at 3787 N.W. Loop 286,
Mayor Clifford said this item was to be tabled, and made a Motion to table this item,
which was seconded by Council Member Drake. Motion carried, 6 ayes 0 nays.
14. Discuss and act on RESOLUTION NO, 2017-038: A RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF DARTS, TEXAS CANVASSING THE RETURNS FOR
THE NOVEMBER 7, 2017, SPECIAL ELECTION REGARDING THE ABOLITION
OF THE SALES AND USE 'TAX FOR ECONOMIC DEVELOPMENT AND THE
ADOPTION OF A SALES AND USE TAX FOR THE REPAIR AND MAINTENANCE
OF STREETS IN THE CITY OF PARIS, TEXAS; MAKING OT14ER FINDINGS AND
PROVISIONS RELATED TO THE SUBJECT.
With regard to the recent election, Mayor Clifford asked if there were any questions.
There being none, a Motion to approve this item was made by Mayor Clifford and seconded by
Council Member Knox. Motion carried, 6 ayes -- 0 nays.
15. Discuss and act on RESOLUTION NO. 2017-039: A RESOLUTION OF THE crry
COUNCIL OF THE CITY OF PARIS, TEXAS APPROVING AND AUTHORIZING
AGREEMENTS TO AMEND AND TO TERMINATE AN ECONOMIC INCENTIVE
AGREEMENT DATED JANUARY 30, 2014 BETWEEN THE PARIS ECONOMIC
DEVELOPMENT CORPORATION AND CAMPBELL SOUP SUPPLY COMPANY
LLC; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE
SUBJECT; AND DECLARING AN EFFECTIVE DATE.
City Attorney Stephanie Harris said in 2014, City Council approved an incentive
agreement between the PEDC and Campbell Soup regarding their Single Serve Beverage Line.
She also said at Campbell's request, the PEDC Board voted to amend and terminate that
agreement and to approve a performance incentive for a new Plum Organics Line. Ms. Harris
recommended amending and terminating the 2014 agreement between the P'EDC and Campbell
Soup.
A Motion to amend and terminate the agreement was made by Mayor Clifford and
seconded by Council Member Trenado. Motion carried, 6 ayes — 0 nays.

16. Receive bids and award a contract for furnishing and delivery of unleaded gasoline and
diesel fuel for use by various departments of the City of Paris.
Finance Director Gene Anderson explained that the City periodically took proposals for
the purchase of fuel to be used by City departments and proposals were received from three
vendors proposing a total of six different options, He further explained that staff reviewed the
bids, considered controllable vendor prices, administrative software, equipment, vendor
reputation, alternate fueling locations, and likely total cost over the contract period plus any
optional extensions of the contract. Mr. Anderson said the staff believed that McCraw Oil Bid B
offered the best combination of these factors. He said there had been complaints from
department heads about employees not being able to get receipts when they get gasoline. Bryan
Rainey said he agreed with nearly everything Mr. Anderson said. Mr. Rainey said they weren't
perfect and they had an issue with the receipt printer. Ile said he wasn't familiar with the system
the City was looking at and then referenced the cost between the bids. He said Blankenship was
local and they were lower, Mr. Rainey also said lie knew they had some issues, but he would not
be complaining if the other company was lower. He asked Council to consider Blankenship Oil.
Council Member Knox made note that Blankenship had been working with the City for
ten years and asked about the issues, Mr. Anderson said there were a number of complaints from
employees with regard to several issues, one being they were not able to get printed receipts after
getting fuel. Mr. Anderson said this made it difficult to reconcile and some employees were
taking pictures of the pump to send to the finance department. Mr. Anderson said lie Could ask
department heads to come up and speak, about the matter if Council wanted them to do so. Mr.
Anderson explained the City had been complaining for years, and Blankenship had time to fix
the issues but had not. Mr. Anderson said the City staff felt going out for bids and putting in
pumps was the best solution. He said with the purrips would be software that would
clectronically read the information instead of the City having to print reports. He said right now
employees had to take a picture of their fuel purchases with a cell phone and turn that in for
reconciliation put -poses.
Council Member Portugal said she wanted to go with the local vendor when possible, but
the City needed to get the best service. Mr. Anderson said McGraw had two local stations and
an office in Paris. Council Member Portugal said they had to trust staff because they were the
ones using this service, Mayor Clifford agreed with Council Member Portugal. Council
Member Trenado asked if they could sit down with the Mr. Raney and work this out, because
they gave a lot to the community. City Manager John Godwin said these complaints had been
ongoing for the last 5 112 years and that the City had been and was receiving a poor quality of
service. He said there were a lot of details that he preferred not to go into, in a public meeting.
.He said the Raneys were good people but that was not the issue,
A Motion to approve Bid I B front McGraw Oil Company was made by Mayor Clifford
,and seconded by Council Member Portugal. Motion failed, 2 ayes — 4 nays, with Council
Members Drake, Lancaster, Trenado and Knox casting the dissenting votes. A Motion to
approve a contract with Blankenship Oil was made by Council Member Trenado and seconded
by Council Member Knox. Motion carried, 4 ayes 2 ayes, with Mayor Clifford and Council
Member Portugal casting the dissenting votes,

17. Discuss and act on ORDINANCE NO. 2017-048: AN ORDINANCE AMENDING
ARTICLE XI OF CHAPTER TWO, SECTIONS 2-551, OF THE CODE OF
ORDINANCES OF THE CITY OF PARIS, TEXAS TO PROVIDE FOR THE
EXPANSION OF THE MUNICIPAL BAND COMMISSION FROM FIVE (5)
MEMBERS TO SIX (6) MEMBERS, ONE OF WHOM IS THE BAND DIRECTOR;
'to PROVIDE THAT THE BAND DIRECTOR SHOULD SERVE WITHOUT A TERM
LIMIT; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE
SUBJECT; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES ON
CONFLICT HEREWITH; PROVIDING AN EFFECTIVE DATE.
Council Member Drake said she was the band liaison and they had requested the addition
of one new member, who would be required to be an active band member. She said the other
change they requested was that the band director serve without ten'n limits, and in an ex -officio
position.
A Motion to approve this item was made by Mayor Clifford and seconded by Council
Member Portugal Motion carried, 6 ayes — 0 nays,
18. Discuss and provide direction to city staff on an application for disannexation of property
filed by Case and Ashley Johnson.
City Attorney Stephanie Harris said after she wrote this memo, two more disannexation
requests were filed from the same area. She recommended tabling this item and considering all
three together.
A Motion to table this item was made by Council Member Drake and seconded by Mayor
Clifford. Motion carried, 6 ayes — 0 nays.
19. Convene into Executive Session pursuant to Section 551.087 of the Texas Goverru-nent
Code, (1) to discuss or deliberate regarding commercial or financial information that the
governmental body has received from a business prospect that the governmental body
seeks to have locate, stay or expand in or near the territory of the governmental body and
with which the governmental body is conducting economic development negotiations; or
(2) to deliberate the offer of a financial or other incentive to a business prospect described
by Subdivision (1), as follows: Project Orange Fire.
Mayor Clifford convened City Council into executive session at 6:11 p.m.
20. Reconvene into Open Session and possibly take action on those matters discussed in the
Executive Session.
Mayor Clifford reconvened City Council into open session at 6:47 pm. and said Council
had discussed a business prospect and incentives,

21, Consider and approve future events for City Council and/or City Staff pursuant to
Resolution No. 2004-081.
Mr. Godwin rerninded City Council of their special work session scheduled for Saturday,
December 9, at 9-00 arn,
22, Adjournment.
There being no further business, a Motion to adjourn was made by Mayor Clifford and
was seconded by Council Mernber Drake. Motion carried, 7 ayes — 0 nays. The meeting was
adjourned at 6.47 p.m.
